ESD showing adjudication after winning appeal - stuck in limbo for a week

I'm seriously confused and getting desperate. I had my appeal hearing with an Administrative Law Judge two weeks ago over a separation issue (was let go but employer claimed misconduct). I actually WON the appeal and got the official decision letter last Monday (4/3). But when I check my ESD account, it still says 'adjudication in progress' since 2/3, and I haven't received any payments yet. It's been a full week since the judge ruled in my favor! Does anyone know what this means? Is my former employer appealing the judge's decision? How long should this take to update in the system? I've got rent due and already had to borrow money last month while waiting for the appeal.

There's actually a separate process that happens after you win an appeal. The OAH (Office of Administrative Hearings) decision gets sent back to ESD, and then ESD has to implement the judge's decision in their system. This typically takes 7-10 business days, but can take up to 2-3 weeks in some cases. Your status will continue to show 'adjudication in progress' during this implementation period. And yes, technically your former employer has 30 days from the ALJ decision date to file a Petition for Review with the Commissioner's Review Office, but that doesn't stop ESD from implementing the ALJ's decision in the meantime. Unless a stay is specifically ordered (which is rare), ESD should process your payments according to the ALJ decision.

Had the EXACT same situation in January! Won my appeal after fighting for 3 months, then had to wait another 2 weeks before anything changed in the system. What finally worked was calling ESD and specifically asking them to check if the 'implementation' of my appeal decision was complete. Turns out it was sitting in someone's queue waiting to be processed. Got paid 3 days after that call. The most frustrating part is nobody tells you about this extra step! The judge makes it sound like you'll get paid right away, but there's this whole other process.

THEY DO THIS ON PURPOSE!!! The whole system is designed to make people give up. I won my appeal too and waited THREE WEEKS with the same 'adjudication in progress' status. No explanation, no timeline, nothing. They hope you'll just stop checking and they can keep your money. Even when you win they still try to screw you over. AND ANOTHER THING - they owed me backpay for 7 weeks and when they finally did pay me, they shorted me one week! Had to call and fight about that too. CHECK YOUR PAYMENT AMOUNTS CAREFULLY when they finally do pay!

So here's what's actually happening behind the scenes: 1. The ALJ decision gets sent to ESD's Benefits Accuracy Unit 2. They review the decision and create an implementation plan 3. They update your claim in the system (this is where you are now) 4. Then they calculate and release any payments due To speed things up, call the Benefits Accuracy Unit directly at 360-486-2587 rather than the main ESD line. They're the ones who handle post-appeal implementation. Ask specifically about the "implementation status of your OAH decision." Keep track of who you speak with and when. If your employer filed a Petition for Review, ESD would notify you with a letter. Since you haven't received anything, it's more likely just the normal processing delay.
