How long for ESD back payments after winning appeal hearing?

Finally won my appeal hearing last week after fighting ESD's disqualification for 3 months! The judge ruled in my favor and said I'm eligible for all those weeks I was denied. Anyone know how long it typically takes for ESD to process these back payments? The judge said ESD would be notified of the decision within 2 business days, but my online account still shows $0 and 'disqualified' status for those weeks. I'm starting to worry because I've got about $6,800 in back benefits that I desperately need for rent and bills that piled up during this mess. Has anyone here gone through the post-appeal payment process? What should I expect?

Congrats on winning your appeal! It usually takes 2-3 weeks for ESD to process back payments after an appeal decision, but I've seen it take up to 6 weeks in some cases. The system doesn't update automatically - a claims specialist has to manually implement the judge's decision by removing the disqualifications and processing each weekly claim individually. Your online account status probably won't change until right before they issue payment. If you don't see movement after 3 weeks, I'd recommend calling ESD directly. Make sure you have your OAH (Office of Administrative Hearings) case number ready when you call.

Thank you! 3 weeks seems so long when bills are due... Do they at least send some kind of notification when they start processing it, or does the money just show up one day?

Mine took 5 weeks and that was after calling them every single day. The ESD system is ridiculous. Even after you win they drag thier feet.

5 weeks?! That's insane! Did you have to do anything special to get them to finally process it?

I went through this in January. After winning my appeal, it took exactly 17 business days for the back payments to hit my account. The key things to know: 1. Your online account will still show "disqualified" until they actually process everything 2. You won't get any notifications during processing 3. The OAH decision has to be manually implemented by an ESD specialist 4. All your weekly claims need to be reviewed individually 5. They typically process older weeks first, then move forward The money will appear as multiple separate deposits in your account (one for each week), usually all on the same day. Make sure you've selected direct deposit if that's what you want - otherwise they'll mail debit cards which takes even longer.

This is super helpful, thank you! 17 business days isn't great but at least it gives me a timeline to plan around. I've set up direct deposit already so hopefully that helps speed things up a bit.

I tried calling the regular ESD number after winning my appeal and it was IMPOSSIBLE to reach anyone. Spent 4 hours on hold only to get disconnected every single time. Finally used this service called Claimyr (claimyr.com) that got me through to an actual person at ESD in about 15 minutes. They have a video demo showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The ESD agent I spoke with was able to expedite my back payments after I explained I'd already won my appeal. Got my money 3 days later instead of waiting weeks. Definitely worth it when you need to actually talk to someone at ESD.

does that claimyr thing actually work? seems sketchy to me

It definitely works. I was skeptical too but was desperate after trying for days to get through. They basically call ESD for you and when they get an agent on the line, they connect you. Saved me hours of frustration.

I might try this if I don't see any movement by next week. The thought of waiting a whole month for money I'm legally entitled to is making me anxious.

BE PREPARED to still fight even after winning!!!! I won my appeal in July and ESD STILL tried to deny my back payments claiming I hadn't done proper job search activities for those weeks even tho the JUDGE SPECIFICALLY SAID I was eligible for all weeks!!!! Had to get my state rep involved to finally get paid. Took TWO MONTHS total. The system is designed to make u give up.

This is definitely not normal. Most appeal implementations are processed without additional issues. It sounds like you had a particularly difficult case, possibly involving both a quit/discharge issue and job search requirements. For the original poster, if the appeal was specifically about eligibility rather than job search compliance, the process should be more straightforward.

That's really good to know - thank you! I didn't even think about how the Boeing situation might be affecting processing times.

One more thing to be aware of - make sure you keep filing your weekly claims while waiting for your back payments to process. Many people stop filing after winning their appeal, thinking they don't need to anymore, but you absolutely should continue filing for any new weeks you're still unemployed. The appeal only addresses past weeks that were disqualified.

I've definitely been keeping up with my weekly claims! I learned that lesson early on - never miss a weekly claim no matter what.

Does anyone know if they take taxes out of back payments automatically? Or do we have to pay that all next year?

It depends on what you selected when you first filed your claim. If you opted for tax withholding (10% federal), they'll withhold it from back payments too. If you didn't select withholding, you'll receive the full amount but will need to pay taxes on it when you file. You can check your withholding selection in your ESD account settings.

UPDATE: Just want to let everyone know that I got my back payments today! It took exactly 19 business days after the appeal decision. The money came in as separate deposits for each week just like someone mentioned. My online account still shows the old disqualification status though, which is weird. Thanks everyone for your help and advice!

That's great news! Thanks for updating us. The online system often lags behind the actual payments. Those disqualification statuses might stay there forever or update in a few weeks - ESD isn't great about cleaning up the historical claim data in your account. The important thing is you got your money!
