Won ESD appeal but backpay still not received after a week - normal?
Finally won my appeal with ESD last Wednesday after fighting for almost 2 months! The judge ruled in my favor and said I was eligible for benefits from the beginning. The decision letter says I'm entitled to all back weeks (about $4,600 total), but it's been a week now and nothing has shown up in my account. My online portal still shows all those weeks as 'disqualified' even though I won the appeal. Is this normal? How long does it typically take for ESD to process backpay after winning an appeal? Should I be calling them or just keep waiting? Starting to get nervous since rent is due soon...

First off, congrats on winning your appeal! In my experience, it usually takes ESD about 10-14 business days to process backpay after an appeal decision is finalized. The system doesn't automatically update right away. They have to manually review and process each week you're owed. Don't worry that your portal still shows 'disqualified' - that's normal until they actually process everything. I'd give it at least another week before starting to worry.

•Thank you! That makes me feel better. I was getting worried since nobody mentioned a timeframe when I got the decision. Will try to be patient for another week.

The backpay timing can vary a lot based on claim complexity and ESD workload. After my appeal win, it took almost a month before I saw any movement in my account. The weeks stayed listed as 'disqualified' until they processed everything at once. I'd recommend calling just to check on the status - better to be proactive with ESD than wait too long. Try using Claimyr (claimyr.com) if you're having trouble getting through on the phone. I was getting nowhere with the regular ESD line, but Claimyr got me connected with an actual agent in about 20 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 The agent told me exactly when to expect my payment and explained why it was taking so long in my specific case.

•Does that Claimyr thing really work? I've been trying to get through to ESD for days about my standby status!

•It worked for me! Much better than spending hours on hold or getting disconnected. My case was similar - needed to sort out weeks of backpay after an appeal.

•Oh no, that sounds awful! Did you eventually get all your backpay? I'm worried because I can't afford to wait too much longer.

I work with unemployment claims and can clarify the process. After an appeal decision is entered in your favor, here's what happens: 1. The Office of Administrative Hearings (OAH) sends the decision to ESD 2. ESD's appeals unit reviews the decision and enters it into their system 3. The claim is then routed to a claims specialist for manual processing 4. Each disqualified week must be individually reviewed and reprocessed 5. Once processed, payment is authorized within 48 hours This entire sequence typically takes 2-3 weeks, but can take longer during high volume periods. I'd recommend waiting until the 2-week mark before calling. When you do call, specifically ask for the status of your appeal implementation, not just your claim status.

•Thanks for breaking it down! That makes a lot of sense why it's taking some time. I'll wait until the 2-week mark and then follow up if nothing has changed.

i had the same thing happen! won my appeal and then nothing for like 10 days and i was freaking out. then suddenly boom the money was all there at once! they don't really tell you what to expect after you win which is kinda frustrating.

when I won my appeal back in January it took about 16 days for the backpay to hit my account. but my friend got hers in like 5 days. seems like it's different for everyone? anyways congrats on winning!

One other thing to check - make sure you've been filing your weekly claims consistently, even for the weeks that were previously disqualified. Sometimes people stop filing during the appeal process, but you need those weeks already in the system for them to process the backpay correctly. If you missed filing for any weeks, you'll need to request to backfile those weeks once your appeal implementation is complete.

•Yes, I kept filing every week even when they were getting denied! The decision letter actually mentioned that I had properly continued filing, so I think I'm good there. Appreciate the heads up though!

just wondering did u have a lawyer for ur appeal? i have one coming up and not sure if i need one

•No, I represented myself. My case was pretty straightforward - they disqualified me because they thought I quit, but I had documentation proving I was laid off. The judge was fair and listened to my evidence. I think it depends on how complicated your case is.

Just to add to my earlier comment - the ESD website won't update your weeks from 'disqualified' to 'paid' all at once. It's normal to see them change status in batches as they're processed. And sometimes they'll all update at once right before payment is issued. The important thing is having your appeal decision number and the date it was finalized ready when you call, as this helps them locate where your case is in the processing queue.
