ESD payment timeline after winning appeal? Not seeing funds
I finally won my appeal with ESD after a 2-month battle over being wrongfully disqualified for 'voluntarily quitting' (I was actually laid off). The judge ruled in my favor at the hearing 11 days ago, and my eServices account now shows 'eligible' instead of 'disqualified.' But I still haven't received ANY payments - not even for the weeks before the disqualification that were on hold! My bills are seriously piling up - I'm behind almost $4,200 on rent and utilities. Has anyone else gone through this? How long does ESD typically take to release funds after you win an appeal? Do I need to call them or will it process automatically? The decision letter said something about them implementing the judge's order, but gave no timeframe. Starting to panic!!

Congrats on winning your appeal! When I won mine in February it took about 14 days for the money to hit my account, but I had to call them first because they hadn't processed the backpay. The system doesn't automatically update fast enough. Your appeal victory should already be in their system, but the actual payment processing needs a human touch unfortunately.

•Thanks for the info! Did you have to call the regular customer service number? I've been trying that for days but can't get through.

•Hoping that happens for me too! Did you have to keep filing weekly claims during the appeal process? I did, but I'm wondering if I missed something.

The ESD system is completely BROKEN. After my appeal win last year, I waited 21 DAYS with nothing happening!! No communication, no updates, NOTHING! I called every single day for hours - never got through. My landlord was about to evict me! The judge's decision means NOTHING if they don't implement it!!! You need to get through to an actual agent who can manually release your funds, but good luck with that!!!

•This is unfortunately common with ESD. The OAH (Office of Administrative Hearings) makes the decision, but ESD has to implement it, and they're often backlogged. Per state regulations, they should process payments within 14 business days of receiving the judge's order, but it can take longer during high volume periods.

After I won my appeal last month, I used Claimyr to get through to an ESD agent. If you haven't heard of it, check out claimyr.com - they have a system that helps you skip the phone queue. You can see how it works in their video demo: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Once I finally talked to someone, they expedited my payment and I got it 2 days later. The agent told me that appeal decisions sometimes get stuck in their system and need manual intervention.

•Thanks for the suggestion! At this point I'm willing to try anything. Did they just need to push a button on their end or something? It's so frustrating that winning the appeal doesn't automatically trigger payment.

To answer your question more specifically: After an appeal victory, there are actually two processes that need to occur: 1. The judge's decision must be received by ESD's Benefits Accuracy & Quality team (typically takes 3-5 business days) 2. The BAQ team must manually implement the decision in the system and release any held payments (typically takes 7-10 additional business days) So in total, you're looking at approximately 10-15 business days from the date of decision, assuming there are no complications. However, if your case involves multiple weeks of backpay or if there were other issues with your claim besides the disqualification, it can take longer. Make sure you've continued filing your weekly claims during this entire process. If you haven't, that could cause further delays.

•Thank you for this detailed explanation! I didn't realize there was a separate BAQ team involved. Yes, I've been religiously filing my weekly claims throughout this whole mess. I'll give it a few more days and then try to get through to someone if nothing changes.

•What an IGNORANT comment! Unemployment insurance is NOT a handout - we PAY INTO IT with every paycheck! It's INSURANCE that we're ENTITLED to when we lose our job through no fault of our own. The OP already WON their appeal, proving they DESERVE these benefits. Not everyone can just "get a job" instantly in their field or at their previous salary level.

•I've been applying to jobs every day, but in my industry (medical coding), it's taking longer than expected to find something. That's why we have unemployment insurance - to bridge the gap during legitimate job searches. I've paid into the system for 14 years and this is the first time I've ever needed to use it.

Since you've passed the 10-day mark, I really recommend trying to reach an agent directly. When my husband won his appeal last year, absolutely nothing happened until he got someone on the phone who could actually see the decision in their system and manually release the payments. The computer systems at ESD don't always talk to each other properly.

•I've been trying to call but it's impossible to get through! Been trying different times of day but always get the message about high call volume. Did your husband have any tricks for getting past that?

•That's exactly why I ended up using Claimyr - I called for 2 weeks straight and couldn't get through. With their system I was talking to an agent within 25 minutes. The agent was able to see my appeal decision and manually process my payments right there on the call.

Update: FINALLY got through to ESD today! Used the Claimyr service that was suggested here (thanks for that tip!) and was connected to an agent in about 30 minutes. The agent confirmed my appeal victory was in their system but said it hadn't been properly "implemented" yet. She put in a request to expedite the processing and said I should see all my backpay within 3-5 business days. She also explained that appeal decisions don't automatically trigger payments - a claims specialist has to manually review and release them. Apparently they're working through a backlog right now. Finger crossed I'll see the money soon! Will update when it hits my account.

•Great news! Glad you were able to get through. That's exactly what happened with mine - it needed a human to actually implement the decision. Please do update when you get paid!

FINAL UPDATE: The money hit my account this morning! All 8 weeks of backpay plus the current week. What a relief! Timeline for anyone searching in the future: - Appeal hearing: May 3 - Decision received: May 7 - Called and spoke to agent: May 18 - Payment received: May 23 So it took 16 days from decision to payment, but honestly I think it would have taken much longer if I hadn't called and had the agent manually expedite it. Thanks everyone for your help!

•Congratulations! And thank you for providing the detailed timeline - that will be very helpful for others in the same situation. You're absolutely right that calling in to have an agent manually check on things made a significant difference. ESD should improve their automated processes for implementing appeal decisions, but until they do, getting an agent on the phone remains the most effective approach.
