ESD appeal decision in my favor - still waiting 3 weeks for payment
After 2 months of fighting with ESD, I finally won my appeal hearing last month (Feb 11, 2025). The judge ruled that I was eligible for benefits and overturned ESD's denial. It's been 3 weeks since I got the official written decision, but I still haven't received any payments. My eServices account just shows 'Decision: Allowed by OAH' but no payment processing or pending deposits. I've called ESD like 40 times but can't get through to anyone. How long does it typically take to actually get paid after winning an appeal? I'm seriously behind on rent and running out of options here. Has anyone gone through this before?

It took ESD exactly 17 business days to process my payment after I won my appeal in January. The system is CRAZY SLOW right now. The judge's decision has to go from OAH back to ESD, then someone at ESD has to manually review and implement it, THEN it goes to payment processing. And of course nobody tells you this! Try sending a secure message through eServices specifically asking for a timeframe on implementing your appeal decision. My experience is they respond to written questions faster than phone calls.

•Thanks for the info. I sent a secure message last week but haven't heard back. Did your eServices account update with any kind of status between 'Decision Allowed' and actually getting paid? I just want to know if there's something else I should be watching for.

•Six weeks?! That's insane. The system is so broken. I'm still fighting my appeal but stories like this make me lose hope.

The implementation process after an appeal decision typically takes 2-4 weeks, but can sometimes take longer depending on ESD's current workload and the complexity of your case. Here's the usual process: 1. OAH sends the decision to ESD's Appeals Unit 2. Appeals Unit reviews and sends to a Claims Specialist 3. Claims Specialist implements the decision (this can take time) 4. System processes retroactive payments 5. Direct deposit/debit card payment occurs You should know that if your claim has additional issues unrelated to what was decided in the appeal, those could still be holding up payment. You should be able to see if there are other pending issues in your eServices account under the "Pending Issues" section. If it's been more than 4 weeks, I would recommend escalating by contacting your state representative's office. They can often help move things along.

•Thank you for the detailed breakdown! I didn't realize there were so many steps after the appeal. I checked and there are no other pending issues listed in my account, so I guess it's just working through this process. I'll give it another week before trying the state rep route.

I was in almost the exact same situation last year! Won my appeal after being wrongfully denied for "refusing suitable work" (which I never did). After 3 weeks of no payment, I tried using Claimyr (claimyr.com) to get through to an actual ESD agent. They got me connected in about 15 minutes when I had been trying for days on my own. The agent was able to see that my appeal was just sitting in someone's queue and they expedited it. Got paid 3 days later. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. Literally saved me from being evicted.

•I've never heard of this service before. Did you have to give them a lot of personal information? I'm desperate at this point so I might try it.

•No, it just helps you get through the phone system to an actual agent. You still talk directly to ESD yourself. I was skeptical too but it worked when nothing else did. The agent told me appeals implementations are super backlogged right now.

Make sure you're still filing your weekly claims even while waiting for the appeal payment! This is super important. I won my appeal but missed filing for 2 weeks during the waiting period because I thought I didn't need to until the appeal was processed. Those weeks were never paid and I couldn't get them back. The system should be paying you for all eligible weeks once the appeal implementation is complete, but only if you've filed claims for those weeks.

•Oh my god, thank you for mentioning this! I actually DID stop filing for the last week because I was so frustrated with the process. I'm going to file immediately!

My cousin works at ESD (not in appeals tho) and she says they're SUPER understaffed right now since they laid off all the pandemic surge workers. The appeals implementation team is down to like 5 people for the whole state!!! That's why everyone's waiting forever. Not making excuses for them but that's why it's taking so long for everyone.

•That's terrible! But honestly not surprising. The whole department seems held together with duct tape and prayers at this point.

anybody else notice that ESD is super fast to TAKE money when they think u owe them but takes 10000 years to PAY U when they owe?? smh

•THIS!!! When they sent me an overpayment notice last year, they started garnishing my benefits IMMEDIATELY. But now that they owe me money after my appeal, suddenly it takes weeks to 'process.' The double standard is infuriating.

UPDATE: I tried the Claimyr service someone mentioned above and actually got through to an ESD agent today! The agent confirmed my appeal implementation is in progress but said it's in a backlog. She put a note on my account to expedite it due to financial hardship and said I should see payment within 5-7 business days. Fingers crossed this works! Thanks everyone for your help and advice.

•That's great news! The hardship escalation usually works. Make sure to keep an eye on your account daily now.

•Awesome! And don't forget to keep filing those weekly claims while you wait!
