Won ESD appeal - when will backpay arrive after favorable ruling?

Finally got my appeal hearing last week and the judge ruled in my favor! Such a relief after waiting nearly 3 months. I've been faithfully filing my weekly claims this whole time (even when my account showed 'disqualified'), but now I'm wondering when I'll actually see the money? My ESD account still shows my claim as 'under review' despite winning the appeal. Does anyone know how long after winning an appeal the backpay usually comes through? Will they automatically process all those weekly claims I submitted during the waiting period, or do I need to call ESD to make sure they know I won? My rent is already late for this month and I'm getting anxious.

Congratulations on winning your appeal! In my experience, ESD needs about 10-14 business days to process the back payments after receiving the judge's final order. The judge has to submit their decision to ESD first, and then ESD has to manually adjust your claim. If your account still shows 'under review' after 2 weeks, I'd definitely call them to check the status. And yes, all those weekly claims you filed should automatically be processed for payment once the system updates with the appeal decision.

Thank you! That helps a lot - I'll give it the 2 weeks then. Do you know if they typically process all the back payments at once, or do they come in separate weekly deposits? Just trying to plan around when I might have enough to cover my bills.

i won my appeal last year took almost 3 weeks to get paid but they did backpay every week i claimed while waiting for the hearing no need to refile them or anything

3 weeks? Ugh, that's going to be cutting it close. But it's good to know they eventually paid you without you having to do anything extra!

ESD is TERRIBLE at processing anything in a timely manner! Won my appeal in Dec and didn't get paid until MID FEBRUARY! Had to call them SEVEN times before someone actually fixed the issue. Their system doesn't always update automatically after the judge's decision. DON'T WAIT - be proactive and call them!!! The longer you wait the longer it takes to get your $$$ that's rightfully yours!

That's awful! I definitely can't wait until February - I'd be evicted by then. Did they give you any explanation for why it took so long?

They gave me some BS about "processing delays" and "backlog of cases" - standard excuses. The real problem is their system doesn't automatically update after appeals. The ONLY reason I got paid is because I finally reached someone who manually pushed my payments through. Don't listen to anyone telling you to just wait patiently!

If you're struggling to reach an ESD agent (which is likely), I'd recommend trying Claimyr. Used their service last month when I was in a similar situation after winning my appeal. They got me through to an actual human at ESD within 25 minutes instead of spending days trying to get through. Their website is claimyr.com and they have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3. The agent I reached was able to expedite my backpay when I explained my situation.

I hadn't heard of this service before! I'll check out the video - at this point I'm willing to try anything to get through to someone who can help. Thanks for the tip.

That's unusual - there shouldn't be any additional forms needed after an appeal victory. The judge's order should be sufficient. Was this recently or during the pandemic when they had different procedures in place?

it was like 4 months ago? idk exactly what happened but she said they told her there was some verification thing they needed. maybe just her specific situation tho.

I'm a claims specialist (not with ESD but different state) and here's what happens behind the scenes: after the appeal ruling, the Office of Administrative Hearings sends the decision to ESD. Then ESD has to 1) update your claim status, 2) remove any disqualifications, 3) manually review all pending weeks, and 4) issue payments. Each step can take 2-3 business days depending on workload. If you're in a dire financial situation, call and ask for an expedited hardship review - mention potential eviction if that's your situation. This can speed things up significantly.

Thank you so much for breaking it down! I'll definitely call and mention the hardship situation. Is there specific terminology I should use when I call to make sure they understand I'm requesting an expedited hardship review?

Just be clear and direct - say "I'm requesting an expedited hardship review due to imminent eviction" or whatever your specific hardship is. Be prepared to provide some basic details about your situation. Also, make sure to have your claim ID and the date of your favorable appeal decision ready when you call. This helps them locate your file quickly.

wait u guys r getting thru to ESD on the phone?? ive been trying for days and it just says high call volume and hangs up on me lol

That's why I suggested Claimyr above - it's literally the only way I could get through after days of trying. Regular calling is basically impossible unless you get extremely lucky or start calling the second they open.

Quick update to my earlier comment - I just checked with a friend who won their appeal in January 2025. They received their backpay exactly 12 business days after the judge's decision. They did call ESD once during that time just to confirm everything was processing correctly. Their payments came as one lump sum for all the weeks they claimed during the appeal waiting period.

That's super helpful information, thanks for the update! A lump sum payment would actually be ideal for catching up on bills. I think I'll try calling next week if I don't see any changes to my claim status.

UPDATE: Finally got through to ESD this morning! They confirmed they received the judge's decision but it was still in their processing queue. The agent was able to expedite it when I explained my housing situation. She said I should expect to see the payments in my account within 3-5 business days. Thank you all for your advice - especially the tip about mentioning hardship review!

See? That's exactly what I was talking about! If you hadn't called, it would've sat in their "processing queue" for who knows how long. Glad you're getting it resolved!
