ESD appeal win - how long until I get my 6 weeks of back benefits?
Just won my appeal hearing against my former employer yesterday! They tried claiming I voluntarily quit when they actually laid me off due to 'business restructuring' (aka not enough work). The Unemployment Law Project represented me (seriously amazing service) and the judge ruled in my favor. I qualified for the maximum benefit amount ($925/week) and I'm owed back pay for 6 weeks while this mess was sorted out. Does anyone know how long it typically takes ESD to process the payments after an appeal decision? My rent is due next week and I've been scraping by on credit cards since this nightmare began. Will the back pay come as one lump sum or weekly installments? The judge didn't mention a timeframe and my ULP rep isn't available until Monday.

Congratulations on your win! When I won my appeal last year, I got my backpay in about 7-10 days as ONE LUMP SUM deposit. But I've heard it can take up to 3 weeks sometimes depending on how backed up ESD is. The good news is they usually prioritize backpay from appeal decisions. Make sure your payment method is set up correctly in your eServices account!

congrsts! i had almost same situation in january. boss said i no showed but i had txt messages proving they told me not to come in!!! took 14 days to get paid after appeal. they dont tell u this but u need to keep filing weekly claims during appeal or u wont get paid for those weeks

THIS IS WHY THE SYSTEM IS BROKEN!!!! Nobody tells you that you MUST keep filing weekly claims EVEN when you're disqualified and waiting for appeal!!! I lost out on 8 weeks of backpay last year because of this EXACT issue and ESD refused to let me backfile. Their stupid website should make this CLEAR!!! The entire system is designed to make people give up!!!

They can sometimes allow retroactive weekly claims filing in cases where you've just won an appeal. But you need to act quickly, ideally within 7 days of the appeal decision.

I've been through this exact situation and can tell you step by step what happens next: 1. The OAH (Office of Administrative Hearings) sends their decision to ESD within 2 business days 2. ESD takes 5-14 days to process and implement the decision 3. If you missed filing weekly claims, you have ONE opportunity to backfile claims after winning an appeal (most people don't know this) 4. Call the ESD claims center at 800-318-6022 and explain you need to backfile weekly claims after winning an appeal Here's the important part - you won't be able to get through on that phone number because of the insane wait times. I spent 3 weeks trying every day. I finally used a service called Claimyr (claimyr.com) that got me through to an actual ESD agent in less than 30 minutes. •Thank you for the detailed explanation! I used the Claimyr service mentioned above and finally got through to ESD. They're allowing me to backfile the weekly claims I missed (thank goodness). The agent said once that's done, I should see the payment in 5-7 business days. What a relief!

I hate to be that person but double check everything ESD does. When I won my appeal they still messed up my payments. They only paid 4 of the 7 weeks I was owed. Had to call multiple times to get it fixed. Screenshot everything and keep detailed notes of every conversation with them!!!

•Will do! And yes, ULP was incredible. My lawyer knew exactly how to counter every argument my employer made. She had statistics showing the business hadn't actually lost revenue when they claimed they had. Game-changer!
