Won my ESD appeal! How long until I actually get my benefits payment?
Finally got my initial order after my appeal hearing last week - I WON! The judge agreed that I was eligible for benefits all along. After 3 months of fighting ESD on this, I'm beyond relieved. The letter says I'll be getting approximately $5,800 in back benefits plus my weekly claims going forward. But now I'm wondering - how long will it actually take before I see any money? The order doesn't say anything about payment timeframes, and I've got bills piling up. Anyone who's won an appeal know how long ESD takes to process payments after an appeal victory? Will they send the back benefits as one lump sum or weekly installments?

congrats on winning!! when i had my appeal decided last year it took about 10 days for the back pay to hit my account. they did it all as one big payment not weekly. but i didnt have as much back pay as u, mine was only like $2400

•Thanks! 10 days doesn't sound too bad. I'm really hoping they process mine quickly too. Did you have to do anything extra like contact them, or did it just automatically show up?

Congratulations on your successful appeal! The payment timeline varies depending on several factors. Typically, after an initial order is issued in your favor, ESD takes between 7-14 business days to process and release payment. Back benefits are almost always paid as a lump sum. However, there are a few things that could affect this timeline: 1. If ESD decides to petition for review (they have 30 days to do this) 2. If there are any outstanding issues with your weekly claims 3. Current processing backlogs at ESD I recommend checking your eServices account daily - you'll see a payment status update there before the money actually arrives. Make sure all your payment information (direct deposit or debit card) is current in the system.

•wait can ESD still try to fight it after the judge ruled? thats messed up if they can

•Yes, ESD can petition the Commissioner's Review Office to review the judge's decision. They have 30 days from the mailing date of the initial order to do this. However, they don't pursue this option in most cases, especially if the judge's decision was well-supported by evidence and testimony.

I had a simular experience last year with an aappeal victory. It took them 3 WEEKS to pay me!! And I had to call them like 5 times. Their system is SO BROKEN it's unbelieveable, like they deliberately try to make it hard for us to get the money we desrve.

•Oh no, that's frustrating! 3 weeks is a lot longer than what others mentioned. Did they ever explain why it took so long in your case?

•They kept saying "it's in processing" whatever that means. Just excuses. They dont care that people have bills and families to feed while they sit on our money. Good luck hope u get urs faster!!!

After winning my appeal in January, I got my payment in exactly 8 business days. A few important things to know: 1. The payment won't process until after the appeal protest period ends (typically 30 days), BUT they often process payments before this if they don't plan to contest the decision. 2. Make sure you've filed for all weekly claims during the disputed period. If you haven't, you'll need to request backdated weekly claims through your eServices account or by calling ESD. 3. You can check your payment status in eServices under "Payment History" - it will show as pending before it actually gets processed. 4. Back payments almost always come as one lump sum with taxes withheld if you elected for that. Stay patient! The money will come, but ESD is notoriously slow with post-appeal processing.

•This is really helpful information. I'm in the middle of my own appeal right now - hearing is next week. Quick question: if you don't mind sharing, how long was your entire appeal process from filing to decision? Mine has been dragging on for nearly 3 months already and I'm getting anxious.

•My entire appeal process took about 4 months from when I first filed the appeal to receiving the decision. The hearing itself was scheduled for about 2.5 months after I filed. Then it took about 3 weeks to get the decision, and then another 8 business days for payment after that. The whole system is frustratingly slow, but hang in there!

Try calling ESD directly to check on the status - you might be able to speed things up. I had a similar situation in 2024 and called repeatedly until someone helped me. The problem is actually getting through to a real person at ESD since their phone lines are always jammed. I eventually used this service called Claimyr (claimyr.com) that got me connected to an ESD agent in under 10 minutes when I'd been trying for days. They have a video demo of how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Once I actually spoke to someone, they were able to tell me exactly when my payment would be processed and confirmed it would be a lump sum. The agent even put a note on my account to expedite it since I explained my financial hardship. Worth trying if you're desperate to know when your money is coming!

•Thanks for the suggestion! I've tried calling a few times already with no luck. I'll check out that service if I don't see any movement in my account by next week. Did they charge you a lot for it?

•It wasn't free but considering I was about to get evicted and needed to know when my benefits would arrive, it was worth every penny to actually speak to someone. The peace of mind alone was worth it since the agent could see exactly what was happening with my payment in their system and gave me a specific date.

Just wanted to follow up on my earlier comment - another important thing to check is whether your claim is still active. If your benefit year ended during the appeal process, you might need to file a new claim before payments can resume. This is a common issue that causes payment delays after successful appeals.

•That's a good point I hadn't considered. My benefit year started about 5 months ago, so I should be okay on that front. But definitely useful info for others in this situation!

•Oh no, that sounds like a nightmare! Have you tried contacting your state representative's office? I've heard they can sometimes help when ESD is giving people the runaround.

Does anyone know if having a debit card versus direct deposit makes a difference in how quickly you get paid after an appeal? I'm wondering if I should switch my payment method before my decision comes through.

•In my experience, direct deposit is usually 1-2 days faster than the debit card. When they issue payment, direct deposit typically arrives the next business day, while the debit card can take 2-3 business days to be loaded. If you're going to switch, do it now rather than after you get your decision to avoid any further delays.
