How long after winning ESD appeal will I receive backpay for all claimed weeks?

Finally won my appeal after battling with ESD for 3 months!! The judge ruled in my favor last Wednesday (got the decision letter yesterday) but now I'm wondering how long I'll have to wait to actually get paid for all those weeks I've been claiming while in appeal status? That's 12 weeks of benefits I'm owed! Has anyone gone through this process recently? Do I need to contact ESD to let them know I won, or will the Office of Administrative Hearings communicate that automatically? My bills are seriously piling up and I need to know when I can expect this money.

Congrats on winning your appeal! In my experience, it took about 2-3 weeks after winning my appeal for the backpay to hit my account. The OAH does communicate with ESD, but I would still call ESD after about a week to make sure they're processing your payments. They sometimes need a nudge to get things moving. Make sure you keep filing your weekly claims while waiting - that's super important.

Thanks for the info! 2-3 weeks feels like forever when you're behind on bills, but at least there's an end in sight. I'll definitely call them next week to check on it.

How long did it take for you? When you say FOREVER do you mean like a month? Two months? Just trying to get a realistic timeline here.

DONT EXPECT IT TO BE QUICK!!!!!! I won my appeal in January and it took them 6 WEEKS to release my payments!!!! ESD claimed they "had to review the judges decision" which is total BS because the judge ALREADY DECIDED I was eligible. Just another way for them to hold onto OUR MONEY longer!!! 😡 They'll make you wait until you're about to be evicted and then act like they're doing you a favor when they finally pay what they owe you!!!

This happened to me too, although mine only took 4 weeks after winning. They do have to review the decision though - that's actually part of the process. The judge recommends but ESD has final say technically.

The process typically works like this: 1. OAH communicates the decision to ESD (takes 3-5 business days) 2. ESD reviews the decision (1-2 weeks) 3. ESD processes the payment (1-2 weeks) So realistically, you're looking at 2-4 weeks total. However, if there were any weeks where you didn't file claims properly, or if there are any other issues with your claim, it could take longer. I recommend calling ESD after 10 business days if you haven't seen any movement. Make sure you have your decision letter handy when you call because they may ask for specific information from it.

Thank you for breaking it down so clearly! I've been filing all my weekly claims religiously even though they weren't paying me, so hopefully that won't cause any delays. I'll give them two weeks and then start calling.

I had a similar situation back in November. After I won my appeal, I tried calling ESD to check on my payments but couldn't get through to anyone for days. I was so frustrated! Then I found this service called Claimyr (claimyr.com) that got me connected to an ESD agent in under 25 minutes. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 Once I actually spoke with an agent, they were able to expedite my backpay processing. Got all 8 weeks of my benefits just 3 days after that call. Might be worth trying if you can't get through on your own.

My cousin won his appeal last year and he got paid like 2 days later! But I think that's super rare. Most people I know waited at least a couple weeks. Probably depends on how backed up they are and maybe what kind of appeal you had? What was your disqualification for anyways?

It was a separation issue - they initially said I quit without good cause, but I was able to prove that the working conditions had become impossible. And wow, 2 days would be amazing but I'm not holding my breath based on all these responses!

Sometimes if you email your state representative they can help speed things up. I was waiting for weeks after winning my appeal and nothing was happening. I emailed my district rep, her office contacted ESD, and suddenly my payments appeared three days later. Worth a try if it drags on too long.

This is excellent advice. Legislative inquiries are often prioritized by ESD. If you go this route, be sure to include your claim ID number, contact information, and a brief explanation of your situation in your email to your representative.

UPDATE: Just wanted to let everyone know that I got my backpay! It took exactly 17 days from when I received the appeal decision. I did call ESD twice during that time - first call they just said it was "in process" but after the second call it seemed to move faster. Thanks everyone for your advice and support!

That's great news! Thanks for coming back to update us. It always helps to know how these timelines work out in real situations.
