How long after winning ESD appeal should I expect payment? (Just had hearing)
Had my appeal hearing yesterday and I'm pretty confident it went in my favor! The judge seemed sympathetic when I explained how my employer misclassified my separation as misconduct when I was actually laid off due to department restructuring. I presented emails from my manager acknowledging the restructuring and the judge nodded a lot. My question is - assuming I win, how long does it usually take for ESD to process the decision and release payments? I've been waiting nearly 6 weeks since my initial disqualification and my savings are basically gone. Bills are piling up fast. Will they back-pay all the weeks I've been filing while waiting for the appeal? This is my first time going through the appeal process and I'm really stressed about the timeline. Has anyone else gone through this recently?

Congrats on what sounds like a successful hearing! From my experience last year, expect to wait about 10-14 days for the written decision to arrive. The judge has to review their notes, write up the formal decision, and then it gets processed by OAH (Office of Administrative Hearings) before being sent to you and ESD. Once ESD receives the favorable decision, it usually takes them 3-7 business days to update your claim status and release payments. So all in all, you're looking at roughly 2-3 weeks total from hearing to money in your account. And yes, they'll backpay all eligible weeks you've claimed during the appeal process! Keep filing your weekly claims during this waiting period - that's super important!

my appeal took 24 days from hearing to getting paid!!! i was so broke by then i had to borrow money from my sister. keep filing your weekly claims even while u wait!!!! if u miss even one week you wont get backpay for that week even if u win the appeal

I went through this in January. Here's how it worked for me: 1. Hearing was on January 9th 2. Got decision letter on January 21st (12 days later) 3. ESD updated my claim status on January 25th 4. Money arrived in my account January 27th So about 18 days total from hearing to payment. The judge is supposed to issue a decision within 30 days, but most do it in 1-2 weeks. If your case was straightforward like it sounds, might be on the shorter end. One thing to know - if you win, ESD might still take a few days to review the decision before releasing funds. The system doesn't automatically update when the judge rules in your favor. And yes, they'll pay all weeks you've claimed during the appeal process as long as you continued filing and meeting all other eligibility requirements.

•this is exactly what happened to me too! except i got my decision letter in like 10 days and the money was in my account 5 days after that. MAKE SURE you keep filing those weekly claims cause my friend missed ONE week during his appeal and didnt get paid for that week even tho he won his appeal!!

LMAO the system is such a joke. I WON my appeal in February and I'm STILL fighting with them to get all my backpay. They randomly decided I was "not available for work" for 3 of the weeks despite me answering everything correctly on the weekly claims. Now I'm stuck in ANOTHER adjudication process just to get what they already decided I'm entitled to! The ESD phone lines are impossible - I've called 46 times in the last week and either get disconnected or told the wait is over 4 hours. Don't hold your breath waiting for a quick resolution even if you win.

i worked for esd for 3 years (quit in 2024). heres what happens behind the scenes: - judge has 30 days to write decision but usually does it in 7-14 days - oah sends decision to esd central processing - if u won, claim goes to payment processing queue (2-5 days) - if complicated issues, might need manual review (add 2-7 days) - payments are batched and processed overnight but heres the truth - some claims get "stuck" in the system for no good reason. if u dont get paid within 3 weeks of winning, CALL THEM. be persistent. the squeaky wheel gets the grease at esd trust me

my freind said it takes 4ever if u win but the judge thinks ur employer might appeal there decision... did ur employer seem like they mite appeal? if they do it wud take even longer i think

One thing to keep in mind - make sure you check your correspondence tab in eServices regularly. Sometimes they'll send you additional questionnaires or information requests while you're waiting for the decision processing. If you miss responding to these, it could further delay your payments. Also, did the judge ask you to submit any additional evidence after the hearing? If so, the 30-day decision clock doesn't start until after they receive all requested evidence.

After my appeal, I had to wait nearly 3 weeks for payment, but a friend of mine got hers in just 8 days, so it really varies. I think it depends on: 1. How complicated your case was 2. Whether your employer contests the judge's decision 3. Current ESD workload 4. If you have any other issues on your claim The most frustrating part is there's no good way to check the status during this waiting period. The online system just shows your original disqualification until suddenly it updates all at once when they process it.
