OAH appeal won but ESD stuck on 'in appeals process' - 21 weeks of payments pending
I'm super confused and getting worried about my unemployment situation. I won my appeal through the Office of Administrative Hearings (OAH) on May 17th. On the 22nd, my ESD account status changed to "in appeals process" which got me excited that things were moving forward. But when I checked again today (June 3rd), it STILL says "in appeals process" with TODAY'S date showing as the date of status change! What's going on? Does the status updating with today's date mean they're actually working on it or is something wrong? I have 21 WEEKS of back payments they owe me (around $14,300 total) and I'm starting to wonder if the large amount is causing delays. My landlord is getting really impatient and I'm almost out of options. Has anyone experienced this weird status situation after winning an OAH appeal? How long did it take to actually get your payments after winning?

Congrats on winning your appeal! The "in appeals process" status with updated dates usually means ESD is still implementing the judge's decision. This is normal especially with larger payment amounts. When I won my appeal last year, it took about 3-4 weeks after the OAH decision for ESD to process everything. They have to manually review each week claimed and verify your eligibility for each one separately. The fact that the date keeps updating is actually a good sign - it means someone is actively working on your claim. With 21 weeks pending, they're probably going through each week carefully.

same thing hapend to me last yr. took FOREVERRRR to get my $ after i won. like 6 weeks total after the judge said i won. esd is sooooo slow. the date changing means nothng probly just ther computer system updating automaticly.

I won an appeal back in February and had a similar situation. The status kept changing dates but saying the same thing for weeks. SO FRUSTRATING!! Eventually I got all my payments (about 14 weeks worth) but it took almost 7 weeks after winning the appeal. ESD is ridiculously slow with implementing OAH decisions.

•This is pretty typical unfortunately. The appeals implementation team at ESD is separate from regular claims processors, and they're chronically understaffed. They have to review each week individually to ensure the judge's decision applies correctly.

CALL THEM!!!!! Do not just sit around waiting! My brother-in-law had the exact same situation after winning his appeal and it turned out there was some stupid flag on his account that was preventing the payments from processing. He waited 2 months thinking it was just taking time, but as soon as he got through to someone they fixed it in 10 minutes and he had his money 3 days later. The system is totally BROKEN and if you don't advocate for yourself, no one will. The changing date could mean absolutely nothing - don't assume someone is actually working on it.

I went through this exact situation in January. The changing dates on the "in appeals process" status is actually the system automatically updating while your claim sits in the implementation queue. For large backpay amounts (anything over $10k), they have a special review process that takes longer. Have you tried using Claimyr to get through to an agent? I was in the same boat - couldn't get through on the phone for weeks. Used claimyr.com and got connected to an agent in about 15 minutes. Yes, it worked for me with ESD specifically. The regular phone lines are completely overwhelmed, but this service got me through pretty quickly. I had tried calling on my own for three weeks straight before using it.

When ESD is implementing an appeal decision, especially one involving multiple weeks of benefits, there are several stages it must go through: 1. Initial review by the appeals implementation team (1-2 weeks) 2. Individual review of each claimed week (varies based on number of weeks) 3. Quality assurance review for large payment amounts (1-2 weeks) 4. Final processing and payment authorization (3-5 business days) The status date updating daily is actually normal - it's the system acknowledging that your claim is still in the queue for processing. With 21 weeks pending, you're looking at what we call a "complex implementation" which unfortunately takes longer to process. If you do reach an agent, ask specifically for your claim to be escalated to the "Appeals Implementation Supervisor" for review. This can sometimes speed things up. Also, make sure you've submitted all requested documentation and that your address/payment information is current in the system.

Yes, absolutely continue filing your weekly claims without interruption. Any gap in filing could create additional complications. Even though you're waiting on the implementation of your appeal decision, maintaining current claim filing ensures there won't be any additional delays once they start processing your payments.

•And make sure you're doing your job search activities too! I've seen people win appeals but then get disqualified for new weeks because they stopped doing their job search activities while waiting for the appeal to be implemented. The system is designed to trip you up at every turn!

my cousin works at esd (not in claims tho) and she says they have a special team for imeplementing appeals and theres only like 5 people doing ALL of them for the whole state!!!! thats why it takes sooooooo long. the status date changing means ur still in the queue but not necessarily that anyone is actually looking at ur claim that day. good luck!!!!

UPDATE: I finally got through to ESD using that Claimyr service someone suggested above. The agent confirmed my appeal is in the implementation queue but said it's flagged for "large payment review" which adds 7-10 business days. She escalated it to a supervisor who promised to look at it by end of next week. The agent also confirmed that the date changing daily is just the system acknowledging the claim is still pending, not that someone actively worked on it that day. •Glad you got through! The escalation to a supervisor should help speed things up. When mine was escalated, it was processed within 5 business days. The "large payment review" is standard for any backpay over $10k, so that makes sense with your 21 weeks.
