ESD appeal reversal - how long until benefits actually get paid?
Just got the BEST news ever! After fighting my disqualification for 11 weeks, the OAH judge reversed the decision in my favor yesterday! The letter says I'm eligible for all back benefits from when I was wrongfully disqualified ($6,680 total). I'm beyond relieved but also getting anxious because my landlord is breathing down my neck. Does anyone know how long ESD typically takes to process payments after a successful appeal reversal? The judge's decision came yesterday, but nothing has changed on my ESD account yet and no payment notification. Will they automatically deposit all back payments at once or do I need to do something to trigger it? This whole experience has been a nightmare (got disqualified because my former employer claimed I quit when I was actually laid off due to restaurant downsizing). Just want to know when I can finally stop panicking about bills!

Congratulations on winning your appeal! In my experience as someone who went through this last year, ESD typically takes 7-10 business days to process payments after a successful appeal. The system has to be updated to reflect the judge's decision, which isn't immediate. Once processed, you should receive all back payments as a lump sum to your designated payment method. You don't technically need to do anything to trigger the payment, but it doesn't hurt to call ESD to confirm they've received the judge's decision. This can sometimes speed things up, especially if there was any delay in the judge submitting the paperwork to ESD.

•7-10 business days isn't too bad, I guess. Do you know if there's any way to check the status online through eServices? I've been checking but nothing has changed yet.

•Same thing happened to my brother in 2024. The ESD payment system is completely separate from the appeals office and there seems to be zero communication between them. It's like you win your case but then have to wait for someone to manually enter it into another system.

I went through EXACT same situation last month! Restaurant fired me claiming "misconduct" when they were just cutting staff. My timeline: - Appeal won on March 4th - Called ESD repeatedly from March 5-15 (got hung up on 4 times) - Benefits showed as "pending" on March 16 - ALL back payments hit my account March 18 So about 2 weeks total. But I STRONGLY recommend calling ESD directly to make sure they're aware of your appeal decision. Sometimes the judges don't send the paperwork over promptly and your case just sits there! Call early (right when they open) and be prepared to wait. Good luck and congrats!!

•Thank you!! This is super helpful. Did you have to talk to a specific department when you called or just the general claims center?

After you won your appeal, do you still file weekly claims while waiting for the back pay? I'm in adjudication now (similar situation - employer lying) and wondering if I need to keep certifying.

•Yes, absolutely continue filing your weekly claims! Even while your appeal is pending or after winning but before payment, you must maintain those weekly certifications. If you stop filing, you'll only be paid for the weeks you properly certified, regardless of the appeal outcome.

I've been trying to reach ESD about my appeal for DAYS with no luck. Busy signals, disconnects, and wait times over 4 hours. Finally tried Claimyr (claimyr.com) and got through to an ESD agent in 25 minutes! They have a demo video if you want to see how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 I know it seems weird to use a service just to make a phone call, but honestly it was worth it to finally get answers about my appeal payment timeline. The agent was able to confirm my back pay was being processed and gave me an exact date.

•Thanks for the tip! I'm going to try calling normally first thing tomorrow, but if that doesn't work I'll check this out. Did the ESD agent seem annoyed you used a service or did they not care?

There's actually a specific protocol ESD follows after an appeal reversal: 1. The OAH sends the decision to ESD's Benefits Accuracy & Quality unit 2. BAQ reviews the decision (usually 3-5 business days) 3. BAQ sends instructions to the payment processing team 4. Payment processing calculates and issues payments (2-4 business days) So the total process typically takes 5-9 business days, but can stretch to 15 business days during high-volume periods. January-March 2025 has been particularly backed up. One important note: check your ESD correspondence tab daily! If there are any other issues with your claim (like missing job search activities), they might need resolution before payment can be issued.

Had this happen to me and the ESD system is SUCH a mess. My appeal was reversed but then they claimed I didn't have enough work hours in my base year even though the judge SPECIFICALLY addressed that in the decision. Had to appeal AGAIN. Check your eServices account CAREFULLY for any new "issues" they might suddenly discover.

•This is unfortunately pretty common. ESD loves to find new reasons to deny your claim after you win an appeal. Make sure to check for any new "alerts" or "issues" in your account daily until you get paid.

Update: I called ESD this morning at exactly 8:00am and miraculously got through after only a 45 minute wait! The agent confirmed they received my appeal decision and said my payment is being processed now. Should hit my account within 5-7 business days. Thanks everyone for your help and advice!

•Great news! Glad you were able to get through. If you don't see the payment by next Friday, definitely call again. Sometimes things get stuck in their system and need a little nudge.
