Won my ESD appeal but backpay still showing 'disqualified' - how long until payment?
Just had my ESD appeal hearing yesterday and already got the decision today that they REVERSED the initial denial! I'm so relieved but now I'm wondering about the actual money. The decision letter says the 'initial determination is reversed' but when I log into my ESD portal, all those weeks (12 weeks worth about $8,200) still show as 'disqualified'. Has anyone gone through this process before? How long does it usually take for them to update my status and actually release the backpay? The bills are seriously piling up and I need to know if I should expect it this week or if it'll be another month-long wait. The portal is so confusing!

Congratulations on winning your appeal! In my experience, it can take ESD anywhere from 3-10 business days to actually process the reversal and update your payment status. Their system doesn't automatically update right away when a decision is reversed. You should see the status change from 'disqualified' to 'paid' for those weeks within that timeframe, and then the funds will be released to your preferred payment method (direct deposit or debit card).

OMG congrats!!! I just scheduled my appeal hearing for next month. Im so nervous about it. What was your hearing like? Did u have a lawyer? I got denied for something i definitely didn't do so im hoping i win too! My bills are STACKING UP

•No lawyer! I just made sure I had all my documentation organized. The judge was actually really fair and listened to my side. Just be prepared with dates and any communications you've had with employers. It was over the phone and lasted about 45 minutes. Good luck with yours!

The system typically takes 5-7 business days to process appeal reversals. What often happens is that a judge's decision gets entered into the Office of Administrative Hearings system first, but then has to be processed by ESD's benefits system separately. Your claim will go through what's called 'post-adjudication processing' where they recalculate your eligible weeks and payment amounts. If you don't see any change after 10 business days, call ESD directly. Make sure to have your decision number and hearing date ready when you call.

mine took almost 3 weeks to update after i won my appeal last year. its crazy how slow they are. but the good news is when it finally hit it was ALL at once so i got a big deposit. hang in there!

If you're having trouble getting through to ESD while waiting for your backpay to process, I'd recommend using Claimyr. After winning my appeal, I was in the same situation - status still showing disqualified after 2 weeks. I tried calling ESD directly but couldn't get through. The ESD system is BROKEN! Even after winning appeals they make people wait weeks or even MONTHS for their money. They hope you'll just give up! I won my appeal in February and it took 23 days for the money to show up. No explanation, no timeline, nothing. Just had to wait and keep checking my account. This is why people end up homeless - the system is designed to wear you down.

•While the wait is definitely frustrating, I don't think it's intentionally designed to make people give up. It's more about outdated systems and understaffing. But I do agree they should give clearer timelines and better status updates. 23 days is way too long when bills are due.

my friend just went thru this exact thing. his status changed after about a week but the money didnt actually hit his account til like 3 days after that. so dont freak out if the status changes but the $$ isnt there yet. also make sure ur payment method is still active if ur using direct deposit

One more thing to consider: make sure you check your overpayment tab in the ESD portal. Sometimes when appeals are reversed, there might be adjustments needed if you received any benefits during the appeal process. Also note that ESD will withhold taxes on your backpay if you previously elected to have taxes withheld, so the final amount might be slightly less than you calculated.

•I was denied for "voluntary quit" because my employer claimed I resigned, but I was actually laid off due to downsizing. They tried to make it look like I chose to leave to avoid paying unemployment. I had emails proving the layoff was their decision, which really helped my case.

To answer your earlier question - in my case, the portal updated all statuses at once, but I've heard others say theirs updated week by week. Usually direct deposit is faster than the debit card option, so if you have direct deposit set up, you might receive the funds 1-2 days after the status changes to 'paid'.

•GOOD LUCK getting through to anyone! I called 37 TIMES over 3 days and either got hung up on or was on hold for 2+ hours only to be disconnected. The phone system is a joke.

Update for anyone who finds this post later: It took 8 business days, but my portal finally updated today! All the previously disqualified weeks now show as 'paid' status. No deposit yet, but the representative I spoke with said it should show up in my account within 48 hours. So relieved to finally see movement on this!
