Won ESD overpayment appeal - will I get paid for disqualified weeks or just debt cancellation?

Just got my ESD appeal decision letter in the mail - I WON!!! After fighting a $5,800 overpayment for 4 months, the judge ruled in my favor. Super relieved about that part, but now I'm confused about what happens next. The weeks they had disqualified me for (which led to the overpayment notice) - will I actually get paid for those now? Or is the appeal win just wiping out the debt I supposedly owed them? My online account just shows the overpayment balance as $0 now, but there's nothing about backpay for those weeks they originally denied. Anyone been through this before? Should I be calling ESD to ask about this or just be happy they're not taking my money? Appreciate any insights from folks who've been in this situation.

congrats on winning your appeal!!! that's seriously not easy with esd. i had somethng similar happen last year but didnt win. i'd definitely call and ask about those weeks, dont just leave money on the table that you're entitled to

Thanks! Yeah, I feel like I should probably call, but their phone system is such a nightmare. I've spent hours on hold in the past and then got disconnected.

Typically when you win an overpayment appeal, it means two things: 1. The debt is canceled (which you've confirmed by seeing $0 balance) 2. You should receive benefits for any weeks that were part of the appeal decision However, ESD doesn't always automatically process backpay - their systems don't handle this well. You'll need to call them to ensure they process payments for those disqualified weeks. Make sure you have your appeal decision letter handy when you call, as they'll ask for specific information from it. Be prepared to wait several more weeks for processing even after you call. They have to manually review and release those payments in most cases.

Thanks for explaining! Do you know if there's a specific department I should ask for when I call? I'm worried about getting bounced around between reps who don't know how to handle this.

When I was in adjudication hell last year my neighbor told me about this service called Claimyr that gets you through to ESD agents without the hold time. Worked great for me! Just went to claimyr.com and they got me a callback from ESD in like 30 minutes after I spent days trying to get through. They have a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 - definitely worth it for something important like backpay!

Is that service legit though? Sounds sketchy to have a third party involved with unemployment stuff...

THE WHOLE SYSTEM IS RIGGED!! They make it IMPOSSIBLE to get your money even when you WIN!! They're hoping you'll just walk away grateful they removed the overpayment. I won my appeal in January and STILL haven't gotten my backpay despite calling 15+ times!!! They keep saying "it's in processing" but it's been MONTHS. Don't let them get away with this!!!

I'm sorry you're having such a difficult time. While there certainly can be frustrating delays, I've seen many cases where backpay was successfully processed after an appeal win. The key is persistence and documentation. Have you tried contacting your state representative? They often have liaisons who can help with ESD issues.

When you win an overpayment appeal with ESD, you're legally entitled to receive benefits for any weeks that were part of the decision, assuming you met all other eligibility requirements. Here's what you should do: 1. Call ESD's claims center at 800-318-6022 and specifically ask about the status of your backpay for the weeks covered by your appeal decision 2. Keep a detailed log of all calls - date, time, agent name, and what was discussed 3. If they say it's "in process," ask for a specific timeframe and when to follow up 4. If you don't see progress within 2 weeks, contact the Office of Administrative Hearings (OAH) that issued your appeal decision and ask about enforcement It's actually quite common to need to follow up after winning an appeal. The cancellation of the overpayment often happens automatically, but the backpay frequently requires manual processing by a claims specialist.

Thank you for such detailed info! This is exactly what I needed. I'll start calling tomorrow morning and will definitely keep records of everyone I talk to. Really hoping I don't have to contact OAH but good to know that's an option if things drag on. I really appreciate your help!

wait how much were those denied weeks worth? if its a lot maybe thats why theyre not paying u right away. my cousin said anything over like $3k gets extra review or something

It's about $4,200 for 7 weeks. That makes sense that larger amounts might get extra scrutiny. Just wish they'd at least show something in my online account about it.

I went through almost exactly this situation in March 2025. Won my appeal against a $7,200 overpayment, and like you, my online account just showed $0 balance right away. I called ESD every day for a week until I got through, and the rep told me they needed to process a "reverse disqualification" for those weeks. It took about 3 weeks after that call, but I did eventually receive all the backpay! The money appeared suddenly in my account with no advance notice or status update online. Definitely call them - be polite but persistent, and have your appeal decision number ready. Some reps know exactly what to do while others seem confused by the process, so you might need to call multiple times to get someone experienced.

This gives me hope! "Reverse disqualification" - that's a term I'll use when I call. Thank you for sharing your experience. I'll start calling tomorrow and keep at it until I get someone who knows how to handle this.

Based on your reply that it's about $4,200 for 7 weeks, that's definitely worth pursuing. While the system should automatically trigger these payments after an appeal win, there's often a disconnect between the Office of Administrative Hearings (OAH) and ESD's payment systems. Sometimes you need to specifically request what's called a "benefit reinstatement following appeal reversal" - that's the exact phrase that might help when talking to representatives. Also, make sure your current address and payment method are up-to-date in the system. I've seen cases where backpay was issued via paper check to an old address even when people had direct deposit set up.

Thank you! I'll definitely use that phrase when I call. And good point about checking my contact info - I moved about 6 months ago and though I updated my address in the system, it wouldn't hurt to verify everything is correct. Really appreciate the advice!
