Won my ESD appeal but still showing overpayment - when will payments resume?

I've been fighting with ESD for the past 3 months over a disqualification they placed on my claim. They said I wasn't looking for work properly (even though I submitted all 3 job search activities every week!) and hit me with a $4,800 overpayment notice. I just received the decision letter from OAH yesterday saying my appeal was APPROVED, and the judge overturned ESD's decision! 🎉\n\nBut I'm confused about what happens next. My eServices account still shows the overpayment balance, and I haven't received any payments since they cut me off in February. Do I need to call ESD to get them to process the judge's decision? How long will it typically take before they remove the overpayment and start sending my weekly payments again? I've been using credit cards to survive and really need this resolved ASAP.

Congratulations on winning your appeal! This is actually a common situation. After an OAH decision, ESD typically needs 10-14 business days to process the judge's ruling and update your claim in their system. You don't need to call them to process it - the decision gets automatically transmitted from OAH to ESD.\n\nHere's what should happen:\n1. The overpayment balance will be removed from your account\n2. Any weeks they owe you will be paid retroactively\n3. Regular weekly payments will resume if you've continued filing claims\n\nMake sure you keep filing your weekly claims even while waiting for this to be processed! If you stop filing, you won't get paid for those weeks even after your appeal is implemented.

Thank you so much for the clear explanation! I have been filing every week (even though it felt pointless). I'll keep an eye on my account and hopefully see changes in the next couple weeks. It's such a relief to know I don't need to do anything else!

4 weeks? That's so long! 😩 Did they tell you why it took that long or did you just suddenly see the money appear one day?

CONGRATS ON WINNING!! ESD is THE WORST about implementing appeal decisions quickly. I won mine back in December and it took them THREE WEEKS to remove the overpayment and start paying me again. And get this - they didn't even send a notice or anything!! The money just showed up in my account! Make sure you keep filing those weekly claims though because they won't pay you for weeks you don't file!!!\n\nDid the judge give you a specific deadline for ESD to implement the decision? Mine had a 30-day deadline in the order.

Thank you! The decision letter doesn't mention any specific deadline for ESD to implement things. It just says the determination is reversed. Should there have been a deadline? Now I'm worried they'll take forever if there's no timeline they have to follow.

Don't panic! Not all judges add implementation deadlines. But ESD does have internal requirements to process appeal decisions within a \

If you're having trouble getting through to ESD to check on your appeal implementation, I'd recommend using Claimyr. I was in a similar situation where I won my appeal but nothing was happening with my payments. Called ESD for days without getting through. Then I found Claimyr (claimyr.com) which got me connected to an ESD agent in about 20 minutes instead of waiting on hold for hours. They have a video showing how it works: https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3\n\nThe agent I reached was able to expedite the implementation of my appeal decision. Worth it when you're waiting on thousands in backpay!

Yes, it worked for me when nothing else did. I was skeptical at first but was desperate after trying to call ESD directly for days. Got through to someone who could actually help with my claim within about 20 minutes.

I work as an employment counselor and can provide some insight on this process. When an OAH judge overturns an ESD decision, there's an administrative process that follows:\n\n1. OAH transmits the decision to ESD's Appeals Unit\n2. The Appeals Unit reviews the decision and sends implementation instructions to the Claims Center\n3. Claims Center staff update your claim status, remove overpayments, and process any retroactive payments\n\nThis typically takes 10-15 business days, but can sometimes take up to 4 weeks during high-volume periods. Continue filing weekly claims and maintaining your job search activities during this time.\n\nIf it's been over 3 weeks since your decision and you see no changes, you should contact ESD directly. Ask specifically for the \

This is SO helpful - thank you! I had no idea there was a specific Appeals Implementation Unit. The decision letter just arrived yesterday, so it sounds like I need to be patient for a couple more weeks. I appreciate knowing the exact process it goes through.

my cousin had this same thing happen last month and esd took FOREVER to fix it. he ended up having to call his state representative's office and they contacted esd on his behalf. suddenly esd fixed everything within 48 hours after the rep called them. might be worth trying if it goes beyond a few weeks

Contacting your state representative can indeed help in situations where ESD is taking too long, but I'd recommend waiting at least 3-4 weeks after the appeal decision before escalating to this level. ESD does have processes in place to implement decisions, and most are completed within their standard timeframe.

wait so are you supposed to keep filing weekly claims even when your benefits are paused? i stopped filing when they disqualified me. am i going to lose all that money now????

Unfortunately, yes - you're supposed to continue filing weekly claims even during a disqualification or appeal period. If you win your appeal, ESD can only pay you for weeks that you filed claims for. However, depending on how long ago this happened, you might be able to file for those weeks retroactively by calling ESD and explaining the situation. They sometimes allow backdated claims with good cause.
