How long after appeal decision Washington ESD unemployment payments start?
Won my unemployment appeal hearing last Thursday and the administrative law judge ruled in my favor. Washington ESD originally disqualified me for voluntary quit but the judge agreed it was constructive dismissal. My question is how long does it typically take for payments to actually start flowing after a favorable appeal decision? The hearing officer said Washington ESD should process it within 10 business days but I'm wondering if anyone has real-world experience with this timeline. I've been without benefits for 6 weeks now and really need to know when I can expect the back pay and regular weekly payments to resume.

Congrats on winning your appeal! In my experience it took about 2 weeks after my favorable decision before I saw any money. The back pay came first as a lump sum, then regular weekly payments resumed the following week. Washington ESD has to update your claim status in their system and process all the retroactive payments.

•That's encouraging, thanks! Did you have to do anything special or did the payments just automatically start?

•Nothing special needed on my end. They automatically processed everything once the appeal decision was entered into their system. Just keep filing your weekly claims like normal.

The 10 business day timeline is generally accurate but can vary depending on workload. Since you won your appeal, Washington ESD will need to reverse the disqualification, calculate your back pay for the 6 weeks you missed, and restart your regular benefit payments. Make sure you continue filing your weekly claims even while waiting - this ensures you don't miss any weeks once payments resume.

•Good point about continuing to file weekly claims. I wasn't sure if I should keep doing that during the appeal process.

•Yes, always keep filing even during appeals. If you don't file for a week, you can't get paid for that week later even if you win.

If you're having trouble getting through to Washington ESD to check on your appeal status, I recently discovered Claimyr at claimyr.com. They help you actually reach a real person at Washington ESD instead of getting stuck in phone tree hell or having calls disconnect. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Might be worth checking out if you need to follow up on your appeal processing.

•Interesting, I hadn't heard of that service. Getting through to Washington ESD has been impossible during this whole appeal process.

•I used Claimyr too when my claim was stuck in adjudication. Actually got through to someone at Washington ESD within a few hours instead of weeks of failed phone attempts.

ugh im still waiting for my appeal hearing to even be scheduled. been 8 weeks since i requested it. how long did it take to get your hearing date?

Kaiya Rivera
•It took about 6 weeks from when I filed my appeal to get the hearing scheduled. Hang in there, the wait is brutal but worth it if you have a good case.

The Washington ESD system is so slow with everything. Even when you win an appeal they take forever to actually pay you. I swear they hope people just give up and go away.

•I get the frustration but in my case they were actually pretty quick once the decision was made. The appeal process itself takes forever but payment processing was reasonable.

•maybe i just had bad luck but everything with them has been a nightmare

One important thing to note - when your payments do resume, make sure to check that your weekly benefit amount is correct. Sometimes there are calculation errors after appeals, especially if your employment history was part of the dispute. Review your monetary determination to ensure it reflects the correct wages and benefit amount.

•Good tip! I'll definitely double-check those numbers when payments start. My case did involve some wage disputes so errors are possible.

•Yes! This happened to me - won my appeal but they calculated my benefit amount wrong. Had to file another appeal just for the monetary calculation.

Update: Just checked my account and the disqualification has been removed! Status now shows 'paid' for the weeks I was previously denied. Looks like the back pay should hit my account within the next few days based on what others have said.

•That's great news! Sounds like your case is moving right on schedule. The actual deposit usually takes 2-3 business days after the status changes to 'paid'.

•Awesome! Winning an appeal always feels like such a victory after all the stress and waiting.

For future reference, if anyone else is going through this - keep detailed records of everything during your appeal. Screenshots of your Washington ESD account, copies of all correspondence, notes from phone calls. It really helps if there are any issues with payment processing after you win.

•Definitely agree with this advice. I kept a whole folder of documents and it made the hearing go much smoother.

The waiting is the worst part of the whole appeal process. Even after you win you're still waiting for the money. At least you know it's coming now though!

•Exactly! The stress of not knowing if I'd ever see those benefits was killing me. Now it's just a matter of waiting for the system to catch up.

Just wanted to circle back on the Claimyr thing I mentioned earlier - if you need to follow up with Washington ESD about anything related to your appeal payments, it's been a game changer for actually getting through to speak with someone. Way better than spending hours on hold or getting disconnected.

•How much does something like that cost? Seems too good to be true.

•It's actually pretty reasonable for what it does. The main thing is it works - I was able to get answers about my claim status that I couldn't get any other way.

Constructive dismissal cases can be tricky but sounds like you had a solid case. What kind of evidence did you present at your hearing?

Kaiya Rivera
•I had documentation showing my employer changed my job duties drastically, cut my pay, and created a hostile work environment. Also had text messages from my supervisor that really helped prove their intent.

•That's exactly the kind of evidence you need. Glad the judge saw it that way too.

6 weeks without benefits during an appeal is rough. Hope the back pay helps you catch up on everything. The financial stress during these appeals is unreal.

•It really was tough. Had to borrow money from family just to pay rent. The back pay will definitely help me get back on track financially.

Make sure when you get your back pay that Washington ESD didn't deduct anything weird. Sometimes they take out overpayments from other years or random fees. Check the payment breakdown carefully.

•Thanks for the heads up! I'll definitely review the payment details when it comes through.

•This happened to me - they deducted an old overpayment from 2019 without telling me. Had to call to get it explained.

The fact that you kept filing weekly claims during the appeal was smart. I know someone who stopped filing and lost out on 3 weeks of benefits even after winning their appeal.

•Yeah, I almost made that mistake but someone on here advised me to keep filing no matter what. Really glad I listened to that advice.

Administrative law judges are generally pretty fair with these cases. If you had legitimate grounds for your appeal, they usually see through Washington ESD's initial determination. Glad you got a good outcome!

•The judge was very thorough and really listened to both sides. Much better experience than I expected honestly.

Once everything is processed and you're back to regular weekly claims, remember you still need to do your job search activities and report any work you do. The appeal win doesn't change those ongoing requirements.

•Good reminder! I've been keeping up with job searches during this whole process so I should be good to go.

•Yeah dont let your guard down on the job search stuff, they can still disqualify you for not meeting those requirements

Hopefully this thread helps other people going through appeals. It's good to see real timelines and outcomes instead of just the official Washington ESD information that doesn't tell you what really happens.

•That's exactly why I wanted to share my experience. The official timelines don't always match reality and it helps to know what to actually expect.

Congrats on winning your appeal! I went through a similar situation last year with Washington ESD - they initially denied my claim for misconduct but I won on appeal. The timeline they give you is actually pretty accurate. In my case, it took exactly 8 business days from the judge's decision to when I saw the money in my account. The back pay came first (all at once), then my regular weekly payments resumed automatically. Just make sure you keep filing your weekly claims during this waiting period. Also, double-check your payment amounts when they start - sometimes there are calculation errors after appeals get processed. The waiting is nerve-wracking but you're almost there!

•That's really reassuring to hear! 8 business days sounds very reasonable and gives me hope that I'll see the money soon. I've been diligently filing my weekly claims throughout this whole process, so hopefully that won't cause any delays. Good point about double-checking the payment amounts - with all the back and forth during the appeal, there's definitely room for errors in their system. Thanks for sharing your experience, it really helps to know what others went through with similar cases!
