How long after Washington ESD unemployment appeal hearing to get decision?

Had my appeal hearing with Washington ESD last Tuesday over a disqualification they hit me with. The hearing officer seemed fair and asked good questions about my job separation. My former employer's HR rep was there too but I think I presented my case well. Anyone know how long it typically takes to get the written decision after the hearing? I'm still filing my weekly claims but not getting paid obviously until this gets resolved. Really need to know what to expect timeline-wise.

Usually takes 2-3 weeks for Washington ESD to issue the written decision after your appeal hearing. The hearing officer has to review all the testimony and evidence before making their determination. Keep filing your weekly claims like you're doing - if you win the appeal you'll get back pay for all those weeks.

Thanks! That's what I was hoping to hear. Do they email the decision or just mail it?

0 coins

They mail it to your address on file. You can also check your SecureAccess Washington account online - sometimes it shows up there first.

Mine took exactly 18 days last year. But I've heard of some taking up to a month during busy periods. The important thing is you keep filing those weekly claims no matter what.

0 coins

18 days isn't too bad. Yeah I'm definitely keeping up with the weekly claims. Did you win your appeal?

0 coins

Yes I did! Got all my back pay too. Took another week or two after the decision for the payments to actually hit my account though.

If you need to talk to someone at Washington ESD about your appeal status, I had luck using Claimyr to get through to an actual person. Their system calls repeatedly until someone picks up - saved me hours of trying to get through myself. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than sitting on hold forever.

Never heard of that service. Is it legit? I've been trying to call Washington ESD for weeks with no luck.

0 coins

Yeah it's totally legit - claimyr.com. I was skeptical at first too but it actually worked. They handle all the calling and waiting for you.

0 coins

I used them too when I had issues with my adjudication. Worth every penny to actually talk to a human at Washington ESD instead of getting hung up on constantly.

The waiting is the worst part honestly. I'm going through the same thing right now - had my hearing 3 weeks ago and still nothing. Starting to wonder if they lost my paperwork or something.

0 coins

3 weeks is getting into the longer range. Have you tried calling to check on the status?

0 coins

Tried calling dozens of times but can never get through. The phone system is a nightmare.

0 coins

That's exactly why I mentioned Claimyr above - they'll keep calling until they get through for you. Might be worth checking out.

0 coins

what happens if you dont file weekly claims during the appeal? i forgot to do mine for 2 weeks and now im worried i screwed myself over

0 coins

You need to file those missed weeks ASAP. Washington ESD usually gives you some leeway but you don't want to risk it. Log into your account and see if you can still file for those weeks.

0 coins

ok will do that tonight. thanks for the heads up

I've been waiting 5 weeks for my decision. This is ridiculous. How is this legal to make people wait this long without income?

0 coins

5 weeks is definitely on the longer side. Have you tried contacting them to check on the delay?

0 coins

Can't get through on the phone. Sent multiple messages through SecureAccess Washington with no response. System is broken.

0 coins

This is exactly the kind of situation where Claimyr helps. They'll keep calling until they reach someone who can check on your appeal status.

Update: Just got my decision in the mail today! Took exactly 16 days from the hearing date. I WON! They reversed the disqualification and I should see my back pay within the next week or two. Thanks everyone for the timeline info - really helped manage my expectations.

0 coins

Congratulations! That's awesome news. The back pay should hit your account pretty quickly now.

0 coins

Great to hear! Winning an appeal is such a relief. Enjoy that back pay when it comes in.

0 coins

So jealous! Still waiting on mine. At least I know they're processing them.

0 coins

For anyone else going through this - make sure you have all your documentation organized. I almost lost my appeal because I couldn't find my termination letter during the hearing. Luckily the hearing officer gave me time to submit it afterward.

0 coins

Good advice! I had everything in a folder ready to go. Being prepared definitely helped.

0 coins

Yeah lesson learned for me. Now I keep copies of everything in one place.

0 coins

The whole appeal process is so stressful. Even when you win it takes forever to actually get paid. Meanwhile bills keep coming.

0 coins

I know exactly what you mean. The financial stress while waiting is brutal.

0 coins

At least you got a good outcome though. Gives me hope for my own appeal.

0 coins

Question - can you work part time while waiting for appeal decision? I got offered some temporary work but don't want to mess up my case.

0 coins

Yes you can work part time, just make sure to report all earnings on your weekly claims. Won't hurt your appeal at all.

0 coins

Perfect, thanks! I'll take the work then. Need some income while waiting.

0 coins

my hearing officer seemed really tough and kept interrupting me. not feeling confident about my chances

0 coins

Don't read too much into their demeanor during the hearing. Mine seemed tough too but I still won. They have to ask hard questions to get all the facts.

0 coins

i hope youre right. just felt like they had already made up their mind

0 coins

Anyone know if you can appeal again if you lose the first appeal? Asking for a friend who's worried about their case.

0 coins

Yes, you can appeal to the Board of Industrial Insurance Appeals if you lose at the hearing level. But the standards get more strict - they mainly look for legal errors rather than re-examining the facts.

0 coins

Good to know there's another option. Hopefully won't need it but nice to have a backup plan.

0 coins

The worst part is not knowing. I'd rather have a definitive no than this limbo state where you don't know if you'll get paid or not.

0 coins

I totally understand that feeling. The uncertainty is almost worse than the financial stress.

0 coins

Exactly! At least with a decision you can plan accordingly.

0 coins

Has anyone had success reaching Washington ESD by phone recently? I need to ask about my appeal timeline but the phone system is impossible.

0 coins

Like I mentioned earlier, Claimyr at claimyr.com is really the only reliable way I've found to actually talk to someone. They handle all the calling and waiting for you.

0 coins

I'll check that out. Tired of wasting hours trying to get through.

0 coins

Just want to add - even if your appeal takes longer than expected, don't give up filing weekly claims. I know someone who stopped filing and it complicated their case when they eventually won.

0 coins

Great reminder! I kept filing the whole time and it made getting back pay much smoother.

0 coins

Yeah it's tedious but so important to maintain that record.

0 coins

Does the employer get notified when you file an appeal? Mine was pretty hostile during the separation and I'm wondering if they'll show up to the hearing.

0 coins

Yes, they get notified and have the right to participate in the hearing. Whether they actually show up depends on the employer - some do, some don't.

0 coins

Mine showed up unfortunately. But I still won so don't let that discourage you.

0 coins

Three weeks and counting for my decision. Starting to think no news is bad news at this point.

0 coins

Don't assume that! Mine took over 2 weeks and I won. The timing doesn't necessarily indicate the outcome.

0 coins

Thanks for the reassurance. This waiting game is brutal.

0 coins

For those still waiting - try to stay positive and use the time productively. I spent my waiting period updating my resume and applying for jobs. Helped keep my mind occupied.

0 coins

That's great advice! I did some online training courses while waiting. Made me feel more productive.

0 coins

Exactly! Better than just sitting around worrying about the decision.

0 coins

This thread has been super helpful. Nice to know I'm not alone in this process. The waiting really is the hardest part but at least now I have realistic expectations.

0 coins

Glad it helped! This community is great for support during these stressful times.

0 coins

Definitely! Will pay it forward when I get through my own appeal process.
