How long does a Washington ESD unemployment appeal take - still waiting after 6 weeks
Filed an appeal with Washington ESD back in early January after they denied my UI claim for supposedly quitting my job (which I didn't - I was laid off due to company restructuring). It's been 6 weeks now and I haven't heard anything back except the initial acknowledgment letter. My former employer is fighting it even though they admitted in writing that it was a layoff. I'm running out of savings and really need to know what's normal for appeal timelines. Has anyone been through this process recently? How long should I expect to wait for a hearing date?

Appeals are taking forever right now. Mine took 3 months last year and that was considered fast.

•3 months?? I can barely afford rent as it is. Did you get backpay for the whole period once it was approved?

•Yes you get backpay for everything if you win the appeal, but only if you kept filing your weekly claims during the appeal process

The typical timeline for Washington ESD appeals is 8-12 weeks from filing to hearing, but it depends on their caseload. Make sure you're still filing your weekly claims even though you're not getting paid - this preserves your right to backpay if you win. Also gather any documentation that proves you were laid off, not quit.

•I have the layoff notice in writing and my supervisor's email confirming it was due to budget cuts. Should be pretty straightforward but my employer is being difficult.

•Same thing happened to my brother. Employer fought the appeal even though they knew it was BS. Some companies just do that automatically to try to keep their UI tax rates down.

I went through this nightmare last summer. Couldn't get through to anyone at Washington ESD for weeks to check on my appeal status. Finally used a service called Claimyr that got me connected to an actual agent in like 10 minutes. They were able to tell me exactly where my appeal stood and what documents they still needed. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Never heard of this. How much does it cost? I'm already broke from waiting for my appeal.

•It's way cheaper than missing more weeks of benefits. The peace of mind of actually talking to someone who could check my case was worth it.

•Seems sketchy. Why would you need a service to call the unemployment office?

•Because I was calling 50+ times a day and never getting through. This actually worked when nothing else did.

WASHINGTON ESD APPEALS ARE A JOKE. I waited 4 months for my hearing last year and when it finally happened the judge sided with me in 5 minutes because my case was so obvious. The whole system is designed to make you give up and go away.

•That's exactly what I'm worried about. Did you have to represent yourself at the hearing?

Malik Thomas
•Yeah but it wasn't as scary as I thought. Just be prepared with your documents and tell the truth. The administrative law judge was actually fair.

keep filing weekly claims!!! cant stress this enough even if youre not getting paid

•I am, it just feels pointless since I keep getting $0 payments every week

Oliver Weber
•Those $0 payments are actually protecting your claim. If you stop filing and then win your appeal, you lose those weeks forever.

What was the reason they gave for denying your claim? Sometimes the wording they use gives you clues about what evidence they're looking for.

•They said I 'voluntarily left work without good cause' which is completely wrong. I have the layoff paperwork showing it was involuntary termination due to company downsizing.

•That's a clear cut case if you have the documentation. Sounds like your employer reported it wrong initially or Washington ESD made an error processing it.

•My employer definitely reported it wrong on purpose. They're claiming I resigned when I never did any such thing.

Similar situation happened to me 2 years ago. Appeal took about 10 weeks total and I won easily once I got to the hearing. The waiting is the worst part but hang in there.

•10 weeks sounds about right based on what everyone is saying. Did you get any updates during that time or just radio silence?

Natasha Romanova
•Mostly silence except for a letter about 6 weeks in scheduling the hearing. That's when I knew it was finally moving.

I'm going through the same thing right now. Filed my appeal in December and still haven't heard anything. This system is completely broken.

Paolo Moretti
•December?? That's even longer than mine. Have you tried calling to check on it?

•I've called probably 200 times and either get hung up on or told they can't give me any information over the phone.

•This is exactly why I ended up using Claimyr. The regular phone system is useless but they can get you to someone who actually has access to your file.

Just want to mention that while you're waiting for your appeal, you should also be looking for work if you're able. The job search requirements still apply even during an appeal in most cases.

Paolo Moretti
•Yeah I'm still doing my job searches and logging them. Hoping I don't have to use them since this should be straightforward but better safe than sorry.

Oliver Weber
•Good thinking. Even if your appeal is successful, having those job search records shows you were meeting the requirements the whole time.

The appeals process in Washington is actually pretty fair once you get to the hearing stage. The problem is just getting there. Most people who have legitimate cases win their appeals.

Paolo Moretti
•That's reassuring. I'm confident about my case, just frustrated with how long everything takes.

Malik Thomas
•Fair? Maybe. But making people wait 3-4 months without income while they sort out their own mistakes isn't fair at all.

•I agree the timeline is terrible, but the actual hearings are conducted by independent judges who don't work for Washington ESD directly.

anyone know if you can expedite an appeal if you have financial hardship? like about to lose housing type situation?
0 coins
Oliver Weber
•You can request an expedited hearing but it's rarely granted unless there are very unusual circumstances. Financial hardship alone usually isn't enough since that affects everyone waiting for appeals.

•I looked into this too but didn't qualify. Seems like you need medical emergencies or something really extreme.

Make sure you check your SecureAccess Washington account regularly during the appeal process. Sometimes they request additional documents and if you miss the deadline it can delay things even more.

•Good point, I've been checking weekly. So far just the standard 'appeal in progress' status but I'll keep watching.

•Yeah they requested bank statements from me about 8 weeks in. Almost missed it because the notification was buried in my account messages.

I won my appeal last month after waiting 11 weeks. The hearing was by phone and lasted maybe 20 minutes. Judge asked basic questions and reviewed the documents. Got my decision letter 3 days later and backpay started the following week.

Paolo Moretti
•That gives me hope! Did you have a lawyer or represent yourself?

Freya Larsen
•Represented myself. For a straightforward case like yours sounds, you probably don't need a lawyer. Just be organized with your paperwork.

•How much backpay did you get? Was it everything from when you first filed?

•Got everything I was owed since my original claim date. Made sure to keep filing weekly claims the whole time even though I wasn't getting paid.

PSA: If your employer is claiming you quit when you were laid off, that's fraud and you should report it. Companies do this to avoid paying higher unemployment taxes.
0 coins
Paolo Moretti
•How do you report employer fraud to Washington ESD? I definitely think that's what's happening here.
0 coins
GalacticGladiator
•There's a fraud reporting form on the Washington ESD website. Document everything - emails, layoff notices, any communication about the termination.

Just wanted to circle back on the Claimyr thing since some people were skeptical. I used it again last week to check on a different issue and got through to an agent immediately. Way better than spending hours trying to call the regular number.

•Okay I'm convinced. If I can't get through by next week I might try it. This waiting game is killing me financially.

•Same, I'm going to check out that video demo. At this point I'll try anything to get some answers about my case.

The 8-12 week timeline mentioned earlier is pretty accurate in my experience. I handle these cases occasionally and that's what I usually tell people to expect. Sometimes shorter if the caseload is light, sometimes longer if there are complications.
0 coins
Paolo Moretti
•Are you a lawyer? What counts as complications that would make it take longer?
0 coins
Omar Zaki
•I do some employment law work. Complications usually mean multiple issues (like separation reason plus wage disputes) or cases where they need additional documentation from employers or third parties.

Thanks everyone for all the info. Sounds like I'm in for at least another month or two of waiting but at least I know that's normal. Going to keep filing weekly claims and maybe try that Claimyr service if I need to check on my case status.
