How long does an appeal for unemployment take with Washington ESD?

Filed an appeal with Washington ESD three weeks ago after getting denied for my UI claim. They said I quit voluntarily but I was actually let go due to restructuring at my company. Haven't heard anything back yet and I'm starting to worry this could take months. Does anyone know the typical timeline for unemployment appeals in Washington? Should I be doing anything else while I wait?

Appeals can take anywhere from 6-12 weeks typically. The Office of Administrative Hearings handles them and they're pretty backed up. Make sure you submitted all your documentation when you filed the appeal.

I submitted my termination letter and emails from HR. Should I send anything else or just wait?

0 coins

That sounds good. Don't send duplicate stuff unless they specifically request it. Just be patient, the process is slow but thorough.

ugh the waiting is the worst part! i filed mine in september and didnt get my hearing until november. but i won so it was worth it

0 coins

That's encouraging that you won! Did you have a lawyer or represent yourself?

0 coins

represented myself, its not that hard if you have your documents organized. the judge was fair

I actually used Claimyr to get through to Washington ESD during my appeal process. Was able to speak with someone who confirmed my appeal was moving forward and got an estimated timeline. Way better than trying to call on my own - their system at claimyr.com gets you through the phone queue. There's even a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

Never heard of that service. Is it legit? I've been trying to call Washington ESD for weeks about my appeal status.

0 coins

Yeah it's real, I was skeptical too but it actually worked. Saved me hours of redialing and getting hung up on.

0 coins

I might try that. Been calling Washington ESD almost daily with no luck getting through.

THE WHOLE SYSTEM IS A JOKE! My appeal took 4 months and that was pre-pandemic. Now with all the backlogs it's probably even worse. Washington ESD doesn't care if people can't pay rent while waiting for their appeals.

0 coins

I feel your frustration but getting angry doesn't speed up the process unfortunately.

0 coins

Easy for you to say if you're not the one facing eviction while waiting for bureaucrats to do their job

During the appeal process, you should continue filing your weekly claims even though you're not getting paid. If you win the appeal, you'll get back pay for all those weeks. Don't stop filing or you'll lose those weeks forever.

0 coins

Wait really? I stopped filing because I thought there was no point since I was denied.

0 coins

You need to restart filing immediately! Call Washington ESD or use that Claimyr service someone mentioned to make sure you can still claim those missed weeks.

0 coins

This is correct - you must continue filing weekly claims during appeal or you forfeit back pay eligibility

just checking in - any update on your appeal timeline? mine's been pending for 2 months now

0 coins

Still waiting, it's been 5 weeks now. Starting to think I should look into that phone service to check status.

One thing to keep in mind - if your former employer contests the appeal, it can add time to the process. They have to respond and sometimes request extensions. But most appeals get scheduled within 8-10 weeks of filing.

0 coins

How do I know if my employer contested it? Would Washington ESD tell me?

0 coins

You should receive notice if they respond or contest. Check your SecureAccess Washington account regularly for updates.

My brother went through this last year. Took about 3 months total but he got all his back pay once he won. Just hang in there.

0 coins

Thanks for the encouragement. The waiting is really stressful financially.

Update on the Claimyr thing - I used it again yesterday to check on a different issue and got through in about 10 minutes. The Washington ESD rep was able to pull up my case immediately and give me real answers. Definitely worth it if you're stuck trying to get information.

0 coins

How much does it cost? I'm already tight on money waiting for my appeal.

0 coins

I think it's pretty reasonable compared to the time it saves, but check their site for current pricing. For me it was worth it to get actual answers instead of guessing.

Pro tip: If you haven't already, make sure you have copies of EVERYTHING related to your termination. Employment contracts, emails, witness statements if possible. The hearing judge will want to see documentation, not just hear your side of the story.

0 coins

I have the termination letter and some emails but no witness statements. Is it too late to get those?

0 coins

Not too late until the hearing. If you have former coworkers who witnessed the restructuring, ask them to write brief statements about what they observed.

0 coins

been there, the waiting is torture but most people do win their appeals if they were truly laid off and not fired for misconduct

0 coins

That's reassuring. I definitely wasn't fired for misconduct, just caught up in company downsizing.

0 coins

Check your online account regularly! Sometimes they schedule hearings and the notice gets lost in the mail. You don't want to miss your hearing date because you didn't know about it.

0 coins

Good point, I'll start checking daily. How much notice do they usually give for the hearing?

0 coins

Usually at least 2 weeks notice, sometimes more. But yeah definitely keep checking your SecureAccess Washington account.

0 coins

oh and make sure your contact info is updated with washington esd! my friend almost missed her hearing because they had her old phone number

0 coins

Just double checked and my info is current. Thanks for the reminder!

The whole appeals process feels like it's designed to make people give up. But stick with it - you have rights and if you were legitimately laid off you should get your benefits.

0 coins

Thanks for the encouragement. Some days I wonder if it's worth the stress but I need these benefits.

Final thought on getting status updates - I tried calling Washington ESD the old fashioned way for comparison after using Claimyr, and spent 2 hours getting disconnected repeatedly. The callback service is definitely the way to go if you need real information about your appeal timeline.

0 coins

I might have to try that service too. Been calling for weeks with no luck getting through to anyone.

0 coins

Yeah I think I'm going to give it a shot. This waiting without information is driving me crazy.

0 coins

Just remember that even if the appeal takes forever, you'll get back pay for all the weeks if you win. I know it doesn't help with bills right now but there is light at the end of the tunnel.

0 coins

That's what I keep telling myself. Just have to make it through these next few months somehow.

0 coins

One last piece of advice - start preparing for your hearing now even though it might be weeks away. Write down a timeline of events, gather documents, and practice explaining your side clearly and concisely. Being prepared makes a huge difference in the outcome.

Good advice. I'll start working on a timeline this weekend. Thanks everyone for all the help and encouragement!
