How long does an appeal take for unemployment benefits in Washington state?
I got disqualified for unemployment benefits last month and filed an appeal with Washington ESD. The letter said I was denied because they think I quit my job voluntarily, but I was actually laid off due to company downsizing. I submitted my appeal paperwork three weeks ago and haven't heard anything back yet. Does anyone know how long these appeals usually take? I'm getting stressed about my bills piling up while I wait for this to get resolved.

Appeals can take anywhere from 6-12 weeks depending on how backed up they are. I went through this last year and it took about 8 weeks for my hearing to be scheduled.

•8 weeks?! That's so long. Did you end up getting your benefits paid out retroactively once you won?

•Yes, they paid me back to when I first filed. But it was a long wait without any income coming in.

The appeal process has several stages. First there's the administrative review, then if that doesn't go your way, you can request a hearing with an administrative law judge. The whole process can take 2-4 months unfortunately.

•Do I need a lawyer for the hearing? I can't really afford one right now.

•You don't need a lawyer but it can help. You can represent yourself and present your evidence. Make sure you have documentation proving you were laid off, not that you quit.

I had to deal with this nightmare too. Couldn't get through to anyone at Washington ESD to check on my appeal status. Finally used this service called Claimyr that helped me get connected to an actual person. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

•Is that legit? I'm desperate enough to try anything at this point.

•Yeah it worked for me. They basically help you get through the phone system to talk to someone who can actually check your appeal status.

•I'm skeptical of services like that but honestly the Washington ESD phone system is so broken I might try it too.

Make sure you keep filing your weekly claims even while your appeal is pending! A lot of people don't realize this and miss out on benefits.

•Really? Even though I'm disqualified? Won't that mess things up?

•Nope, you should keep filing. If you win your appeal, you'll get paid for all those weeks. If you don't file, you can't get paid for those weeks later.

ugh this is exactly what happened to me 6 months ago!! took FOREVER and they kept asking for more documentation. i swear they just hope you give up

•What kind of additional documentation did they want? I'm worried they'll ask for stuff I don't have.

•they wanted like a letter from my old employer confirming it was a layoff, pay stubs, stuff like that. some of it was hard to get

The key is having solid documentation. Get a letter from your former employer stating you were laid off due to downsizing. Also gather any emails or written communication about the layoff. The more evidence you have, the stronger your case.

•My old company is being really uncooperative about giving me documentation. Any other options?

•Try contacting your former coworkers who were also laid off. Their testimony could help support your case. Also check if you have any emails or texts about the layoff saved.

Just went through this whole mess. Appeal took 10 weeks total but I won and got all my back pay. Worth the wait but man it was stressful.

•That's encouraging to hear! What was the hearing like?

•It was actually pretty straightforward. Done over the phone, lasted maybe 30 minutes. Just had to explain what happened and show my evidence.

The whole Washington ESD system is such a joke. They deny people first and ask questions later, knowing most people won't appeal.

•That's so frustrating. I almost didn't appeal because it seemed so complicated.

•Don't give up! The appeal process exists for a reason and you have a good case if you were actually laid off.

btw you can check your appeal status online sometimes. login to your esd account and look under appeals section

•I've been checking but it just says 'appeal received' with no other updates.

•yeah thats normal, they dont update it much until theres actual movement

Seriously though, if you need to talk to someone about your appeal status, that Claimyr thing I mentioned earlier really does work. Saved me hours of trying to call Washington ESD myself.

•How much does something like that cost? I'm already broke from being unemployed.

•It's way cheaper than sitting around waiting with no income. Check out their website for details.

Also make sure you're meeting the job search requirements during your appeal period. You still need to be actively looking for work and logging your job search activities.

•Do I need to do the full 3 job searches per week even while appealing?

Amina Toure
•Yes, you need to treat it like you're still an active claimant. Keep doing your job searches and logging them in WorkSourceWA.

I'm going through the same thing right now! Filed my appeal 5 weeks ago and still waiting. This is so nerve-wracking.

•At least we're not alone in this. What was your disqualification for?

Emma Anderson
•They said I was fired for misconduct but I was actually let go due to budget cuts. So frustrating!

One thing to keep in mind - if your appeal is successful, Washington ESD will pay you for all the weeks you were eligible but didn't receive benefits. So don't panic about the delay, you'll get your money eventually if you have a valid case.

•That's reassuring. I just wish I knew when to expect the hearing to be scheduled.

Yara Khalil
•They're supposed to give you at least 10 days notice before the hearing date. You should get a letter in the mail when it's scheduled.

whatever you do dont miss the hearing if you get one scheduled!! i missed mine by accident and had to start the whole process over

The good news is that most people who appeal wrongful disqualifications end up winning, especially if they have documentation. Just be patient and keep all your paperwork organized.

•That's encouraging! I have emails from my supervisor about the layoffs so hopefully that will be enough.

•That sounds like solid evidence. Email documentation is usually very convincing to the hearing officers.

I used Claimyr last month when I was dealing with an appeal issue. Actually got through to someone at Washington ESD who could tell me exactly where my appeal was in the process. Worth every penny.

Connor O'Neill
•Did they give you a timeline for when your hearing would be scheduled?
0 coins
Isabella Ferreira
•They told me it would be about 6-8 more weeks, which turned out to be pretty accurate. At least I knew what to expect instead of just wondering.

hang in there! the waiting is the worst part but if you were really laid off you should win your appeal

•Thanks for the encouragement. Some days I feel like giving up but I know I was wrongfully denied.

•dont give up! you deserve those benefits if you were laid off through no fault of your own

One more tip - when you do get your hearing scheduled, write down all the key points you want to make beforehand. It's easy to forget important details when you're nervous on the call.

•Good advice! I'll start making notes now about exactly what happened with my layoff.

•Yeah, and practice explaining it clearly and concisely. You want to sound confident and prepared.

The wait is brutal but try to stay positive. I know it's hard when bills are piling up but you'll get through this.

I'm in a similar situation - filed an appeal 4 weeks ago after being wrongfully denied for "voluntary quit" when I was actually laid off due to company restructuring. The waiting is absolutely brutal, especially with rent due soon. From what I'm reading here, it sounds like I need to brace myself for potentially 2-3 more months of waiting. Has anyone had success getting any kind of interim assistance while waiting for the appeal to go through?

Eva St. Cyr
•I don't think there's any interim assistance specifically for unemployment appeals, but you might want to look into emergency rental assistance programs in your area or contact 211 for other resources. Some food banks and utility assistance programs don't have income requirements if you're unemployed. It's tough but try to document everything during this waiting period - keep records of your job searches and any communication about your layoff.
