How long does an appeal decision take for unemployment benefits in Washington ESD?

My unemployment claim got disqualified three weeks ago and I immediately filed an appeal with Washington ESD. The letter said I'd hear back within a reasonable timeframe but didn't give specifics. My savings are running out and I'm getting really anxious about how much longer this might take. Has anyone been through the appeal process recently? What should I realistically expect for timing?

Appeals can take anywhere from 4-8 weeks depending on the complexity of your case and current caseload. What was your disqualification for?

0 coins

They said I quit voluntarily but I was actually laid off due to restructuring. I have all the documentation to prove it.

0 coins

That should be pretty straightforward to overturn with proper documentation. Those usually resolve faster than misconduct cases.

I went through this exact situation last year. Took about 6 weeks for my appeal decision but it was worth the wait - they reversed the disqualification and I got all my back pay. The key is making sure you submitted all your evidence with the initial appeal.

Did you have to do a phone hearing or was it just based on documents?

0 coins

I had a phone hearing with an administrative law judge. It was actually less intimidating than I expected - just answered questions about what happened.

The wait is brutal but hang in there. I've been tracking my appeal for 5 weeks now with no update. The Washington ESD phone lines are useless for getting status updates too - just tells you to wait for a decision letter.

Try using Claimyr to get through to an actual agent. I found out about it when I was in your situation - it's at claimyr.com and they have a demo video at https://youtu.be/7DieNd3C7zQ. Finally got a real person who could check my appeal status.

0 coins

Never heard of that but at this point I'll try anything. The regular phone system is a nightmare.

0 coins

That actually sounds really helpful. I've been calling for weeks with no luck getting through.

currently week 7 waiting for my appeal decision and its driving me insane!!! why does everything with unemployment take forever

0 coins

I know it's frustrating but they have to review all the evidence and sometimes schedule hearings. The system is backed up from all the pandemic claims too.

0 coins

i get that but 7 weeks seems excessive for what should be a simple review

0 coins

The timing really depends on whether you need a hearing or not. Document-only appeals can be faster, maybe 4-5 weeks. If they schedule a hearing it adds time for scheduling and preparation.

0 coins

How do you know if they'll want a hearing? They haven't contacted me about scheduling anything yet.

0 coins

They'll send you a notice if a hearing is required. Since yours is about voluntary quit vs layoff, they might want to hear from both you and your former employer.

0 coins

My employer never showed up to my hearing and I won by default. Sometimes that works in your favor.

0 coins

Just went through this whole process. Took 6 weeks total but I used Claimyr halfway through to actually talk to someone about my case status. Worth every penny to get real information instead of just waiting blindly.

0 coins

How much does something like that cost? I'm already broke from not getting benefits.

0 coins

It's not about the cost - it's about finally getting answers. Check out their demo video to see how it works.

Appeals are taking longer than usual right now. My cousin waited 9 weeks for hers to get resolved. The good news is if you win, you get all the back pay from when you should have been receiving benefits.

0 coins

That's somewhat reassuring. At least I won't lose out on the money if I win the appeal.

0 coins

exactly, and it includes the waiting week too if your state has one

0 coins

Been waiting 8 weeks for my appeal decision. This is ridiculous. How are people supposed to survive without income for this long?

0 coins

Have you looked into emergency assistance programs while you wait? Some local organizations help with utilities and food.

0 coins

Yeah I've been hitting up food banks. It's just frustrating that the appeal process takes so long.

0 coins

The system definitely needs improvement. But once it's resolved you'll get a lump sum of all the back pay.

0 coins

I won my appeal after 5 weeks but it was nerve-wracking the whole time. Make sure you keep filing your weekly claims even while the appeal is pending - that's important for getting your back pay.

0 coins

Wait, I'm supposed to keep filing weekly claims? I thought I couldn't since my claim was disqualified.

0 coins

Yes! You have to keep filing to maintain your claim. It will show $0 but you need to do it for each week you want back pay if you win.

0 coins

This is really important - I almost missed out on 2 weeks of back pay because nobody told me this initially.

0 coins

The wait time seems to vary a lot by case type. Misconduct appeals take longer than separation issue appeals in my experience.

0 coins

That makes sense. Misconduct cases probably require more investigation.

0 coins

Exactly. Layoff vs quit determinations are usually more straightforward if you have documentation.

0 coins

My appeal took exactly 6 weeks and 2 days. I was tracking it obsessively lol. Won the case and got $4,200 in back pay deposited the same week as the decision letter.

0 coins

That gives me hope! Did you have a phone hearing or was it decided on documents alone?

0 coins

Phone hearing. Lasted about 20 minutes. The judge asked me to explain what happened and reviewed my employer's response.

0 coins

Phone hearings aren't too bad. I was nervous but it was pretty straightforward questions.

0 coins

Still waiting on week 4 of my appeal. The uncertainty is the worst part - not knowing if it'll be next week or next month.

0 coins

I felt the same way until I used Claimyr to get through and ask about timing. At least then I had some idea of where things stood.

0 coins

I keep seeing people mention that service. Might be worth looking into just for peace of mind.

0 coins

For what it's worth, every appeal I've seen in my situation (wrongful disqualification) has been resolved in the claimant's favor. The wait is awful but the outcome is usually good if you were truly laid off.

0 coins

Thanks for the encouragement. I definitely have strong documentation that it was a layoff, not a voluntary quit.

0 coins

Same here. My company provided a letter confirming the layoff and I still had to wait 7 weeks for the appeal. But I won and got full back pay.

0 coins

The appeals process in Washington is slower than other states I've dealt with. But they're pretty thorough which usually works in favor of legitimate claims.

0 coins

I'd rather have it be slow and fair than fast and wrong I guess.

0 coins

Exactly. And the administrative law judges seem to actually review the evidence carefully.

0 coins

My advice is to use the waiting time productively - job search, skill building, networking. Makes the time pass faster and you'll be in better shape when the appeal resolves.

0 coins

Good point. I've been so focused on the appeal that I haven't been as active with job searching.

0 coins

Yeah and if you win the appeal you'll need to meet job search requirements anyway, so might as well get started.

0 coins

Just got my appeal decision after 8 weeks - I won! The back pay deposited 3 days later. Hang in there, it's worth the wait if you have a legitimate case.

0 coins

Congratulations! That gives me a lot of hope. Were you able to get any updates on timing before the decision came?

0 coins

Not really through regular channels, but I did use one of those callback services someone mentioned earlier to check status once.

0 coins

That's awesome news. I'm at week 6 now so hopefully mine comes soon too.
