How long does it take for an appeal for unemployment with Washington ESD?

My unemployment claim got denied last month and I filed an appeal right away. It's been 3 weeks now and I haven't heard anything back from Washington ESD. I'm really stressed about this because I need these benefits to survive. Does anyone know how long the appeal process usually takes? I'm worried I did something wrong or that my appeal got lost in the system.

Appeals typically take 4-8 weeks depending on how backed up the Administrative Law Judge (ALJ) office is. You should receive a notice scheduling your hearing within 30 days of filing. Check your SecureAccess Washington account for any updates.

Thanks! I've been checking my account daily but nothing new yet. Should I be worried that it's taking this long?

0 coins

Three weeks is still within normal range. The holidays might have slowed things down a bit too.

I went through this last year and it took almost 6 weeks before I got my hearing notice. The actual hearing was scheduled for 3 weeks after that. So total time from filing appeal to hearing was about 9 weeks.

0 coins

Did you win your appeal? I'm so nervous about the hearing process.

0 coins

Yes I did! Make sure you have all your documentation ready. The ALJ was actually pretty fair and listened to my side of the story.

If you need to talk to someone at Washington ESD about your appeal status, I found this service called Claimyr that actually gets you through to a real person. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than sitting on hold for hours.

0 coins

Really? I've been trying to call for weeks and can never get through. How does it work?

0 coins

You just go to claimyr.com and they handle getting you connected to an actual Washington ESD representative. Saved me so much time and frustration.

0 coins

This sounds too good to be true. How much does it cost?

0 coins

The whole appeal system is ridiculous. I've been waiting 7 weeks for my hearing and still nothing. Meanwhile I'm broke and can't pay my rent. Washington ESD needs to hire more judges.

0 coins

7 weeks?! That's way longer than what others are saying. Did you call to check on it?

0 coins

I've called probably 50 times and can never get through. The system is completely broken.

0 coins

Just to clarify - when you filed your appeal, did you file it within the 30-day deadline? And did you receive a confirmation that it was received? Sometimes appeals get delayed if there are issues with the initial filing.

0 coins

Yes, I filed it within 2 weeks of getting the denial letter. I got an email confirmation with a case number.

0 coins

Good, then you're in the system. The case number means they received it properly.

same boat here, filed appeal 4 weeks ago and nothing yet. this is so stressful when you have bills to pay

0 coins

Exactly! I don't understand why it takes so long just to schedule a hearing.

0 coins

This is exactly why I recommend using Claimyr to get through to Washington ESD. At least you can get status updates instead of waiting in the dark.

I had my appeal hearing last month and won. From filing to hearing was about 8 weeks, then it took another 2 weeks to get the decision letter. Total time was about 10 weeks but I got all my back pay once it was approved.

0 coins

That's encouraging! What was the hearing like? Was it scary?

0 coins

It was actually pretty straightforward. The judge asked questions about why I disagreed with the denial. Had it over the phone which made it less intimidating.

0 coins

Same experience here - phone hearing was much easier than I expected.

0 coins

Wait, are we talking about the first level appeal or the second level? Because those have different timelines. First level goes to an ALJ, second level goes to the Board of Appeals.

0 coins

First level I think? I just got denied and filed an appeal. I didn't know there were different levels.

0 coins

Yeah first level is what you want. That goes to an Administrative Law Judge for a hearing. Much faster than the Board of Appeals.

Pro tip: start preparing for your hearing NOW even though you haven't gotten the notice yet. Gather all your documents, write down a timeline of what happened, and practice explaining your side clearly.

0 coins

Good advice! What kind of documents should I gather?

0 coins

Anything related to your job separation - emails, texts, employment records, witness statements if you have them. Basically anything that supports your version of events.

UPDATE: I finally got my hearing notice today! 8 weeks after filing. Hearing is scheduled for next Friday. So relieved to finally have a date.

0 coins

That's great news! Gives me hope that mine will come soon too.

0 coins

Good luck with the hearing! You'll do great.

I'm a former Washington ESD employee and can tell you that appeal processing times have gotten longer since COVID. They're still catching up on the backlog. 6-10 weeks is pretty normal now unfortunately.

0 coins

That's frustrating but good to know it's not just me. Thanks for the inside info.

0 coins

Why don't they hire more judges if there's such a backlog? This is people's livelihoods we're talking about.

0 coins

Budget constraints and the hiring process for ALJs is pretty complex. It's not as simple as just posting a job opening.

0 coins

Don't give up! I know the waiting is horrible but the appeal process does work. I got my benefits restored after winning my hearing. Just hang in there.

0 coins

Thank you for the encouragement! I really needed to hear that today.

0 coins

Just wanted to follow up on the Claimyr thing - I used it again yesterday to check on a different issue and got through to Washington ESD in under 10 minutes. So much better than the endless hold times.

0 coins

I'm seriously considering trying this. The not knowing is driving me crazy.

0 coins

I was skeptical but tried Claimyr last week and it actually worked. Got connected to someone who could look up my appeal status.

0 coins

My appeal took 9 weeks total and I just got my decision last week. Won the appeal and got all my back pay deposited yesterday. The wait was horrible but worth it in the end.

0 coins

Congratulations! That gives me hope. What was the reason for your original denial if you don't mind me asking?

0 coins

They said I quit voluntarily but I was actually laid off. Had to prove it with documentation from my employer.

0 coins

Just remember that even if your appeal takes a while, if you win you'll get all the back pay from when you first filed. So you're not losing money, just having to wait for it.

0 coins

That's true, but waiting is still really hard when you have bills due now.

0 coins

I totally understand. See if you can get help from local food banks or assistance programs while you wait.

0 coins

Mine took exactly 6 weeks from filing to hearing notice, then 2 more weeks until the actual hearing. Timeline seems pretty consistent across everyone's experiences here.

0 coins

That matches what others have said too. I guess I just need to be patient for a few more weeks.

0 coins

The hardest part is not knowing. I kept checking my account obsessively until I finally got the hearing notice. Try to stay busy and not think about it too much.

0 coins

Easier said than done but you're right. The constant checking isn't helping my stress levels.

0 coins

Quick question - did you continue filing weekly claims while waiting for your appeal? I wasn't sure if I should keep doing that.

0 coins

Yes, I've been filing every week. The denial letter said to keep filing to preserve my claim.

0 coins

Correct, you should always continue filing weekly claims during an appeal. Otherwise you might lose those weeks even if you win.

0 coins

I won my appeal and it was such a relief! The judge was really understanding and I felt like I got a fair hearing. Don't stress too much about the process itself.

0 coins

Thank you! All these success stories are really helping me feel more confident.

0 coins

For what it's worth, I think the appeal process is actually pretty fair once you get to the hearing. The ALJs seem to really listen to both sides and make thoughtful decisions.

0 coins

That's reassuring. I was worried it would be biased against claimants.

0 coins

Not at all. They're independent judges, not Washington ESD employees. Big difference in how they approach cases.
