How long does Washington ESD unemployment appeal take - been waiting 2 months
Filed an appeal with Washington ESD back in October after they denied my claim for allegedly quitting without good cause. It's now December and I haven't heard anything back. The appeal confirmation letter just said they'd schedule a hearing but no timeline was given. My savings are completely drained and I'm getting desperate. Does anyone know how long these unemployment appeals actually take to process? I called the appeals office but just get a recording saying they're experiencing high volume.

Appeals can take anywhere from 6-12 weeks in my experience. The hearing itself is usually scheduled within 4-6 weeks of filing, then you wait another 2-4 weeks for the decision.

•That's longer than I hoped but at least gives me a timeframe. Did you win your appeal?

Hazel Garcia
•Yes I did, but it took about 10 weeks total. The hearing was via phone and lasted maybe 20 minutes.

Check your SecureAccess Washington account regularly. Sometimes they update the status there before sending mail. You should also receive a Notice of Hearing at least 10 days before your scheduled hearing date.

•I check SAW every few days but it still just shows 'appeal pending' with no hearing date yet.

•That's normal. The hearing scheduling can take 4-8 weeks depending on their backlog.

I've been trying to call Washington ESD appeals office for weeks about my case and can never get through. Has anyone found a way to actually talk to someone? This waiting with no communication is driving me insane.

•I found this service called Claimyr that helps you get through to Washington ESD. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Might be worth checking out if you need to speak with someone about your appeal status.

•Thanks, I'll look into that. At this point I'm willing to try anything to get some answers.

•Wait, you have to pay someone just to make a phone call? That seems ridiculous.

The whole appeals process is a joke. They deny your claim then make you wait months just for a hearing. Meanwhile you're supposed to survive on what exactly?

•I understand the frustration but appeals do take time to review properly. At least Washington has a relatively fair appeals process compared to some states.

•Fair? I've been waiting 3 months for my hearing. Nothing fair about that.

Make sure you're prepared for your hearing when it comes. Gather all documentation about your separation from work, any emails or texts with your employer, witness statements if you have them.

•Good point. I've been collecting everything but wasn't sure what would be most important.

•Focus on proving you had good cause for leaving or that you were actually terminated. The burden of proof varies depending on your situation.

•Also write down a timeline of events before the hearing. It helps you stay organized when explaining what happened.

I had success using Claimyr to reach the appeals office directly. Got through to someone who could at least confirm my hearing was scheduled for the following month. The website is claimyr.com if anyone wants to check it out.

•Did they charge you much? I'm pretty broke right now but desperate to get some information.

•It was worth it for the peace of mind. Much better than spending hours trying to call myself.

Appeals are taking longer than usual right now. I work at a legal aid office and we're seeing 8-12 week wait times for hearings.

Salim Nasir
•That's really discouraging. Is there any way to expedite the process?
0 coins
Hugo Kass
•Not really, unless you have extreme hardship circumstances. The appeals office is just backed up.

•Can you request an expedited hearing for financial hardship? I thought that was an option.

Update: I tried that Claimyr service and actually got through to someone at Washington ESD appeals. They confirmed my hearing is scheduled for January 15th. Finally have a date!

•That's great news! I might have to try that service too. Still no hearing date for me.

•Glad it worked for you. Still think it's crazy we have to pay a third party service just to make a phone call.

•I agree it shouldn't be necessary, but at least I finally have answers instead of sitting in limbo.

For what it's worth, most appeals that go to hearing are decided in favor of the claimant. The initial determination is often wrong, especially in quit vs. discharge cases.

•That's encouraging to hear. I was worried I was fighting a losing battle.

•Just make sure you have your facts straight and can clearly explain what happened. The hearing officer wants to get to the truth.

I won my appeal last month after a 10 week wait. The actual hearing was pretty straightforward - they asked me questions about why I left my job and I explained the hostile work environment. Decision came 2 weeks later.

•How did you prepare for the hearing? I'm nervous about what they'll ask.

•I wrote out a timeline of events and practiced explaining the situation clearly. Also had emails from my supervisor that showed the problems.

The key is staying on top of your case. Check your mail daily for the hearing notice and make sure Washington ESD has your current address and phone number.

Salim Nasir
•Good reminder. I did update my address recently so hopefully that won't cause any delays.

Jacinda Yu
•Address changes can sometimes slow things down, but as long as you updated it in the system you should be fine.

Three months waiting for my hearing and counting. Meanwhile my former employer gets to keep operating like nothing happened while I can't pay my bills.

Won my appeal after 9 weeks. The hearing was conducted by phone and lasted about 30 minutes. Judge asked detailed questions about my employment situation and reasons for leaving.
0 coins
Salim Nasir
•What kind of questions did they ask? I want to be prepared.
0 coins
Landon Flounder
•Mostly about the specific incidents that led to me quitting, whether I tried to resolve issues with management, and if I considered other options before leaving.

Appeals can also be delayed if your former employer requests postponements or fails to participate. That adds weeks to the process.

Salim Nasir
•My employer said they would participate. Hopefully they don't try to delay things further.

•Most employers do show up since they have a vested interest in the outcome. It affects their UI tax rate.

Just got my hearing scheduled for next month after filing my appeal in early October. About 2.5 months total wait time.

•Keep checking your mail. The hearing notice came with about 3 weeks advance notice.

Does anyone know if you can have a representative at the hearing? Like a lawyer or advocate?
0 coins
Laila Fury
•Yes, you can have representation but you have to notify Washington ESD in advance. Most people represent themselves though.

Ally Tailer
•Thanks. I was thinking about it since my case involves some complex employment law issues.

My appeal took 11 weeks total from filing to final decision. Hearing was scheduled at week 7, held at week 9, decision at week 11.

Salim Nasir
•Did you win your case? What was the main factor in the decision?

•Yes, I won. The key was showing that I had no reasonable alternative but to quit due to unsafe working conditions.

Check if your case qualifies for an expedited hearing due to financial hardship. Worth asking about when you finally get through to someone.
0 coins
Salim Nasir
•How do you request that? I definitely qualify based on my financial situation.
0 coins
Cass Green
•You need to contact the appeals office directly and explain your circumstances. They'll review it on a case by case basis.

Simon White
•This is another situation where Claimyr could help you get through to make that request.
