How long does the appeal process take for unemployment with Washington ESD?

Filed an appeal with Washington ESD three weeks ago after my claim got denied for 'voluntary quit' even though I was laid off due to restructuring. Haven't heard anything back yet and my account still shows the disqualification. Starting to panic about bills piling up. Anyone know how long these appeals actually take to get resolved? The letter just said they'd schedule a hearing but gave no timeframe.

Mine took about 6 weeks from filing to getting the hearing scheduled, then another 2 weeks for the decision. Appeals are really backed up right now.

6 weeks just to get scheduled? That's brutal. Did you get approved after the hearing?

Yeah I won the appeal but it was stressful waiting. Make sure you have all your documentation ready.

The whole appeals process can take 8-12 weeks total in Washington. First they have to review your appeal, then schedule the hearing, then make a decision. If you're having trouble getting through to check status, I actually found this service called Claimyr that helped me reach an ESD agent directly. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

Thanks! I'll look into that. Getting through on the phone has been impossible.

Never heard of that service but anything to avoid sitting on hold for 3 hours.

During the appeal process, keep filing your weekly claims even though you're disqualified. If you win the appeal, those weeks will get paid retroactively. Don't skip filing or you'll lose those weeks permanently.

Really? The system lets me file even with the disqualification?

Yes, always keep filing. It protects your benefit weeks in case the appeal goes in your favor.

This is correct - I made the mistake of not filing during my appeal and lost 4 weeks of benefits even after winning.

ugh the whole system is so slow!! been waiting 2 months for my hearing date and still nothing. meanwhile rent is due and credit cards are maxed out. how are we supposed to survive this long without income???

I feel you. Look into local food banks and utility assistance programs while you wait. United Way has resources.

thanks, already doing that but its not enough. this whole thing is a nightmare

Just had my appeal hearing last week. The whole process took 10 weeks from filing to decision. Won my case though! The key is having all your employment records and any witnesses lined up. The administrative law judge was actually pretty fair.

What kind of evidence did you present? I have emails about the layoff but not sure what else I need.

Emails are great! I also had my final paycheck stub showing 'layoff' and a letter from my former supervisor. Anything showing you didn't quit voluntarily helps.

The appeals process varies but expect at least 2-3 months total. Washington ESD is understaffed and hearings get scheduled based on when you filed. Earlier appeals get priority.

2-3 months is insane. How is anyone supposed to wait that long for income?

It's ridiculous but that's the reality. I had to borrow money from family to survive the wait.

Pro tip: if you can't reach ESD to check your appeal status, try that Claimyr service someone mentioned earlier. I used it last month and actually got through to a real person who could tell me where my appeal stood in the queue. Way better than the automated system.

Did they charge you for that service?

Yeah there's a fee but honestly worth it to get real information instead of guessing. The peace of mind was worth it for me.

Mine took forever too - filed in October and didn't get my hearing until January. But I did win and got all my back pay. The waiting is the worst part.

At least there's hope at the end. Did you get interest on the back pay?

0 coins

No interest but got every penny I was owed from when I first filed. It was a nice chunk of money after waiting so long.

The timeline really depends on how complex your case is. Simple cases might get resolved faster but if there are multiple issues or your employer contests it heavily, expect longer delays.

My case seems straightforward - clear layoff with documentation. Hoping that speeds things up.

That should help. Voluntary quit cases with good evidence usually get resolved quicker than misconduct appeals.

just a heads up - even after you win your appeal, it can take another week or two for the payments to actually hit your account. don't expect money immediately after the decision

Good to know, thanks. Every bit of timeline info helps with planning.

I work for a nonprofit that helps people with unemployment appeals. The average time right now is about 8-10 weeks from filing to decision. Make sure you respond to any requests for additional information immediately or it will delay your case even more.

Haven't gotten any requests for more info yet. Should I be worried that means something's wrong with my appeal?

0 coins

Omar Zaki

•

Not necessarily. Sometimes they have enough information from your initial filing. No news can be good news in this case.

0 coins

What nonprofit do you work for? Could use some help with my own appeal process.

0 coins

Been through this twice unfortunately. First appeal took 3 months, second one took 6 weeks. Seems like timing just depends on their current workload and how backed up they are.

Yara Khoury

•

Why did you have to appeal twice? Different jobs?

0 coins

Yeah, different employers both tried to claim I quit when I was actually terminated. Won both appeals but what a hassle.

If anyone needs to check their appeal status and can't get through the normal way, I had success with Claimyr too. They connected me to an ESD rep who could actually look up my case details. Found out my hearing was scheduled for the following week - something I never would have known otherwise.

That's exactly what I need. The not knowing is driving me crazy.

Yeah the uncertainty is the worst part. At least when you know the timeline you can plan around it.

Keep your chin up OP. I know the waiting sucks but most people who were legitimately laid off win their appeals. Just takes time for the system to work through everything.

Thanks for the encouragement. Really needed to hear that today.

The appeals process has definitely gotten slower since COVID. Used to be 4-6 weeks total, now it's more like 8-12 weeks. Staffing issues at ESD are real.

Everything government-related seems slower these days. Frustrating when you need the money now.

Wish they'd hire more judges to handle the backlog. This is people's livelihoods we're talking about.

One thing that helped me was setting up direct deposit before my appeal was decided. That way when the back pay came through, it deposited automatically instead of waiting for a check in the mail.

Yara Khoury

•

Good tip! I think I already have that set up but I'll double check.

Yeah definitely verify it. Nothing worse than winning your appeal then waiting another week for a paper check.
