How long does it take for unemployment appeal in Washington ESD?
Filed an appeal with Washington ESD 6 weeks ago after getting disqualified for 'voluntary quit' even though I was laid off due to company downsizing. Still haven't heard anything back and my account just shows 'appeal pending'. Getting really stressed about finances - anyone know how long these usually take? Should I be worried that it's taking this long?

Appeals can take anywhere from 6-12 weeks typically. The hearing office is pretty backed up right now. Make sure you have all your documentation ready - layoff notice, final paystub, any emails about the downsizing.

•I have the layoff letter but didn't think to save emails. Hope that's enough proof.

•Email screenshots would definitely help your case if you can still access them from your work account or personal email.

Mine took 8 weeks last year and that was for a much simpler issue. The appeals process is just slow unfortunately. But the good news is if you win, you'll get backpay for all the weeks you've been waiting.

•That's reassuring about the backpay at least. Did you have a phone hearing or in-person?

•Phone hearing. It was actually pretty straightforward once I got to talk to the judge. Just be prepared to explain your side clearly.

If you're having trouble reaching Washington ESD about your appeal status, I used a service called Claimyr that helped me get through to an actual agent. They have a system that calls for you and connects you when someone picks up. Check out claimyr.com - there's even a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

•How much does something like that cost? I'm already strapped for cash waiting for this appeal.

•It's worth it when you need answers. Much better than spending hours on hold just to get hung up on.

•Honestly anything that helps you get through to ESD is valuable right now. Their phone system is a nightmare.

what documentation do you need for the appeal hearing? i got disqualified too and want to make sure i have everything ready

•For a voluntary quit dispute, you'll want: termination letter, final paystub, any documentation about company layoffs, witness statements if possible, and your original unemployment application.

•thanks! i definitely have most of that stuff saved

The appeals process is a joke. I waited 10 weeks for mine and when I finally got the hearing, the judge barely listened to my side of the story. Washington ESD just wants to deny as many claims as possible to save money.

•That's not true - appeals judges are independent from ESD. Sounds like you might not have presented your case well.

•I had all the right documents. The whole system is rigged against workers.

•Appeals judges do rule in favor of claimants when there's sufficient evidence. The key is being prepared and organized.

My appeal took exactly 7 weeks. Got the hearing notice in week 6, had the hearing in week 7. Won the appeal and got 2 months of backpay. Just be patient and don't give up.

•This gives me hope! What was your disqualification reason?

Olivia Evans
•Job separation issue - they said I quit but I was actually terminated for attendance (which was due to medical issues I had documentation for).

You can also check the status of your appeal online through your SecureAccess Washington account. Sometimes they update it there before they send you mail.

•I've been checking but it just says 'pending' still. No other details.

•Yeah the online system doesn't give much detail unfortunately. You really need to call to get specific timeline info.

Pro tip: when you do get your hearing notice, respond immediately. They usually give you a few weeks but if you need to reschedule it can add more time to the process.

•Good point. Also make sure your contact info is updated with ESD so you don't miss the hearing notice.

•I'll double check my address on file. Last thing I need is to miss the hearing notice.

I've been through this twice now and both times it was around 8-9 weeks. The first time I tried calling ESD dozens of times to check status but could never get through. Second time I used that Claimyr service someone mentioned and actually got to talk to someone who could give me a timeline.

•Was it helpful talking to an ESD agent about your appeal status?

Christopher Morgan
•Yeah they could see exactly where it was in the process and gave me a realistic timeframe. Definitely worth it for peace of mind.

Appeals are taking longer than usual right now because of the backlog from the pandemic. But don't worry - if your case is solid (sounds like it is since you were laid off), you should win.

•That's what I'm hoping. I have the layoff notice and my supervisor said they'd be a witness if needed.

•Having a witness from your former employer is huge. That should definitely help your case.

same boat here - filed appeal 5 weeks ago for misconduct disqualification that was total BS. this waiting is killing me financially

•Have you tried applying for emergency assistance while you wait? Some counties have programs for people waiting on appeals.

•didn't know that was a thing, i'll look into it thanks

The worst part about appeals is you can't file weekly claims while it's pending, so you're just stuck waiting with no income. At least when you win you get backpay for all those weeks.
0 coins
Vanessa Chang
•Yeah that's exactly my situation. Bills are piling up but I can't do anything except wait.
0 coins
Julian Paolo
•Actually you should still file your weekly claims even with a pending appeal. If you win, those weeks will be payable retroactively.

Eli Wang
•Oh really? I thought you couldn't file during appeals. Good to know!

Check your mail every day - sometimes the hearing notice comes earlier than expected. My friend almost missed hers because she wasn't paying attention to the mail.

•Good reminder. I've been checking religiously but good to know it could come at any time.

Appeals are definitely slow but hang in there. I won mine after 9 weeks and got almost $4000 in backpay. Made the wait worth it even though it was stressful.

•That's encouraging! I'm hoping for a similar outcome. The stress is real though.

If anyone needs to talk to ESD about their appeal status and can't get through by calling, definitely try Claimyr. I was skeptical at first but it actually worked - got connected to an agent in about 20 minutes instead of wasting hours on hold.

•Did they charge you right away or only if they get you connected?

•They handle all the calling frustration for you. Much better than the endless busy signals and disconnects.

Been waiting 11 weeks now for my appeal hearing. This is ridiculous. How are people supposed to survive with no income for this long?
0 coins
Julian Paolo
•11 weeks is unusually long. You might want to contact your state representative's office - they can sometimes help expedite things.

Nathaniel Stewart
•Didn't think of that. Worth a try at this point.

Just wanted to update - my appeal was finally scheduled after 7 weeks of waiting. Hearing is next week. Fingers crossed!

The appeal process is frustrating but it does work if you have a legitimate case. Just be prepared to wait 2-3 months total from filing to resolution.

Vanessa Chang
•2-3 months seems to be the consensus. I'm at 6 weeks so hopefully getting close to the hearing notice.

Success story: waited 8 weeks for hearing, won my appeal, got $3200 in backpay. Keep all your documentation organized and don't give up. The system is slow but it can work in your favor.

Final thought - while you're waiting, keep looking for work and document your job search activities. Even if you win the appeal, you'll need to show you've been actively searching.

Vanessa Chang
•Good point. I've been applying to jobs but haven't been keeping detailed records. I should start doing that.
0 coins
Julian Paolo
•Yes, keep a job search log. Washington ESD requires 3 job search activities per week minimum.
