How long is the appeal process for unemployment in Washington ESD?
My Washington ESD claim got denied two weeks ago and I filed an appeal immediately. The denial letter said I was disqualified for 'voluntary quit without good cause' but I was actually laid off due to company restructuring. I have all the documentation from my employer including the layoff notice. Does anyone know how long the appeal process typically takes? I'm getting really anxious because I need to know if I should look into other options or just wait it out.

Appeals can take anywhere from 4-8 weeks depending on how backed up they are. I went through this last year and it was about 6 weeks before I got my hearing scheduled.

•Did you win your appeal? I'm worried they won't believe me even though I have the paperwork.

•Yes I won! The key is having documentation like you do. Make sure you submit everything before the deadline.

The appeal process has two stages - first you get a hearing with an administrative law judge, then if either party disagrees with that decision, you can appeal to the Board of Appeals. Most cases get resolved at the first hearing stage though.

•So the hearing is where they actually review all my documents? How does that work exactly?

•Yes, you'll present your case over the phone or video call. The judge will ask questions and review your evidence. Your former employer will also have a chance to present their side.

I had a similar situation last month and couldn't get through to Washington ESD to check on my appeal status. Someone on here recommended Claimyr (claimyr.com) and they actually got me connected to a real person who could tell me where my appeal stood in the process. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How much does that cost? I'm already stressed about money.

•It's worth it if you need to actually talk to someone. Way better than spending hours on hold just to get disconnected.

Keep filing your weekly claims while you wait! Even if you're not getting paid, you need to maintain your claim. If you win the appeal, you'll get backpay for all those weeks.

•Really? I didn't know I could still file weekly claims while appealing. That's good to know.

•Yes this is super important! I made the mistake of not filing and had to do a whole separate process to get those weeks back.

•That seems unusually long. You might want to check if there's an issue with your appeal paperwork or contact information.

Update: I just checked my account and my hearing is scheduled for next week! So it ended up being about 3 weeks total. Thanks everyone for the advice about continuing to file weekly claims.

•That's great! Make sure you have all your documents organized and ready to reference during the hearing.

•Good luck! With layoff documentation you should be fine. The judge will see right through any employer BS.

I won my appeal but it took 2 months total. The hearing itself was only 20 minutes but waiting for the decision after that was another 2 weeks.

•How long after the hearing did you get your backpay? I'm hoping it's not another long wait.

•About a week after the decision was mailed. The backpay came as a lump sum.

Make sure you understand the difference between quitting and being laid off. Sounds like you have good documentation but be prepared to explain the circumstances clearly.

•Yeah I have the official layoff notice and a letter from HR explaining the restructuring. Should be pretty clear cut.

I'm going through the same thing right now! Filed my appeal 5 weeks ago and still waiting. This is so stressful when you need the money.

•Have you tried checking your account online? Mine showed the hearing date before I got the letter.

•I check every day but it just says 'appeal pending' still. Maybe I should try calling again.

If you need to check on your appeal status and can't get through the regular way, I'd definitely recommend trying Claimyr again. They've been a lifesaver for actually reaching Washington ESD when I need answers.

•I was skeptical about using a service like that but honestly it saved me so much time and frustration. Worth every penny.

The appeal process is designed to be thorough but it's also overwhelmed right now. Just be patient and make sure you have strong documentation of the layoff.

•I'm trying to be patient but bills don't wait unfortunately. At least I know it's moving forward now.

does anyone know if you can have a lawyer for the hearing? seems like it might be worth it

Maxwell St. Laurent
•You can but it's usually not necessary for straightforward cases like layoffs. The hearings are designed for regular people to represent themselves.

•ok good to know. probably not worth the cost then

Final update: Had my hearing yesterday and WON! The judge was very fair and my employer didn't even show up to contest it. Should get my backpay within the next week or two. Thanks again everyone!

•Congratulations! That's awesome news. Employers often don't show up when they know they're wrong.

•Great outcome! Now you know for future reference that Washington ESD appeals do work when you have the right documentation.

This thread is super helpful. I'm in a similar situation and was worried the appeal would take forever. Sounds like 3-6 weeks is typical.

•Yeah just make sure you keep filing weekly claims during the process. That was the best advice I got here.

Washington ESD appeals are actually pretty fair if you have documentation. The problem is just getting information about the process and timeline. Most people give up too early.

•Exactly! The system works but they make it hard to navigate. Having a resource like Claimyr to actually talk to someone makes a huge difference.

I lost my initial appeal but won at the Board of Appeals level. Don't give up if the first hearing doesn't go your way - you have options.

•How long did the Board of Appeals process take? Hopefully I won't need to go that far.

•Another 6-8 weeks but totally worth it. They overturned the judge's decision and I got all my backpay.

For anyone reading this later - the key things are: 1) File your appeal within 30 days, 2) Keep filing weekly claims, 3) Organize your documentation, 4) Be patient with the timeline.

•Perfect summary! I wish I had known all this from the start.

•Adding to this - if you can't get through to check status, services like Claimyr can help you actually reach someone at Washington ESD.
