How to write a appeal letter for unemployment - Washington ESD denied my claim
My Washington ESD claim got denied last week and I need to file an appeal but I have no idea how to write the letter. The denial notice says I was 'voluntarily quit without good cause' but that's totally wrong - I was laid off due to budget cuts at my company. I have until next Friday to get this appeal submitted and I'm freaking out. Does anyone know what needs to be included in the appeal letter? Do I need to provide documentation right away or can I bring it to the hearing later?

You definitely need to appeal this! The appeal letter doesn't have to be fancy but it needs to clearly state that you disagree with the decision and explain why. Include your claim number, the date of the denial, and keep it factual. Mention that you were laid off, not quit voluntarily.

•Thank you! Should I include my layoff paperwork with the letter or wait for the hearing?

•Include copies with your appeal if you have them. It strengthens your case from the start.

Here's what you need in your appeal letter: 1) Your name and claim number 2) Statement that you're appealing the decision dated [date] 3) Clear explanation of why the decision is wrong 4) Any supporting evidence you have 5) Your signature and date. Keep it simple but thorough.

•This is super helpful! Do I mail it or can I submit online?

•You can fax it to the number on your denial notice or mail it, but fax is faster. Make sure you get confirmation it was received.

•I had trouble getting through to Washington ESD to confirm they got my appeal. Used claimyr.com to get connected to an agent who verified it was in their system. Saved me so much stress wondering if it went through properly.

THE SYSTEM IS SO BROKEN!!! They automatically deny half the claims just hoping people won't appeal. It's disgusting how they treat people who are already struggling.

•I know it's frustrating but the appeal process does work if you have documentation to support your case

•Yeah maybe but why should we have to fight for benefits we're entitled to??

Make sure you understand exactly why they denied you. Was it because they think you quit or because of some other issue? The appeal letter needs to address their specific reasoning. Also gather any witnesses who can testify about your layoff.

•The denial letter says voluntary quit but I have my termination letter that says budget reduction layoff. Should be pretty clear cut right?

•That sounds like strong evidence in your favor. Include that termination letter and any other HR documentation you have.

just went through this myself! here's a template that worked for me: 'I am writing to formally appeal the denial of my unemployment benefits claim #[number] dated [date]. I disagree with the determination that I voluntarily quit my employment. I was laid off due to [reason] as documented in the attached termination letter. I request a hearing to present evidence supporting my eligibility for benefits.

•This is perfect! Mind if I use this as my starting point?

•That's a solid template. Covers all the key points without being too wordy.

•Good point! I'll definitely keep copies of everything.

One more thing - don't wait until the last minute to submit. The deadline is firm and if you miss it, you lose your right to appeal. Submit it at least a few days early if possible.

•I'm planning to submit it tomorrow so I have plenty of time before the deadline

•Smart move. I waited until the last day once and was panicking when the fax kept failing. Had to drive to the office to hand deliver it.

Does anyone know if you can still file weekly claims while the appeal is pending? I don't want to mess up my case but I also need to keep claiming if I'm eligible.

•Yes, you should continue filing weekly claims during the appeal process. If you win the appeal, you'll get paid for those weeks retroactively.

•Thanks! I wasn't sure about that part.

This reminds me of when my brother got denied for 'job abandonment' when he was actually in the hospital. Sometimes their initial decisions are completely wrong and the appeal is your only chance to set the record straight.

•Wow that's terrible! Did he win his appeal?

Ella Cofer
•Yes but it took months and he had to provide hospital records and doctor statements. The system really needs reform.

For anyone else reading this thread, the key is being specific and factual in your appeal letter. Don't get emotional or go off on tangents. Stick to the facts of why the decision was wrong.

•Hard not to get emotional when they're screwing with your livelihood though

Fiona Sand
•I totally understand that frustration, but emotional appeals don't tend to work as well as factual ones in these hearings.

OP - have you tried calling Washington ESD to see if there was some kind of error in how they processed your initial claim? Sometimes it's just a miscommunication that can be fixed without going through the whole appeal process.

•I've tried calling but can never get through. It just hangs up after being on hold forever.

•Yeah their phone system is awful. I found claimyr.com helpful for actually getting connected to someone at Washington ESD when I needed to clarify something about my claim status.

•I'll check that out, thanks! Even if I still need to file the appeal, it would be good to understand exactly what happened.

Make sure you address the letter to the right office! The appeal address should be on your denial notice. Don't send it to the regular Washington ESD office or it might get delayed.

Ellie Kim
•Good catch! I'll double check the address on my denial letter.

Also document everything from here on out - dates you submitted the appeal, confirmation numbers, who you talked to, etc. This creates a paper trail in case there are any issues later.

Mohammad Khaled
•mine took about 6 weeks like i mentioned earlier. seems to vary though

Alina Rosenthal
•It can take anywhere from 4-8 weeks depending on how backed up they are. You should get a hearing notice in the mail with the date and time.

Thanks everyone for all the helpful advice! I'm going to write my appeal letter tonight using the template someone provided and fax it tomorrow morning. Feels much less overwhelming now that I know what to include.

One last tip - if you win your appeal, they'll owe you back pay for all the weeks you were wrongly denied. Make sure you keep filing your weekly claims during the process!

Ellie Kim
•Yes! Someone mentioned that earlier and I'm definitely going to keep filing. Thanks for the reminder.

Just to follow up on the claimyr thing - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works for getting through to Washington ESD. Might be worth checking out if you want to try talking to someone before your hearing.

•I'll definitely look into that. Even if I file the appeal, it would be good to understand what went wrong with my initial claim.
