How long does an unemployment appeal take with Washington ESD?

I got disqualified from my unemployment benefits last month and filed an appeal right away. Washington ESD said they received it but I haven't heard anything since. My savings are running out and I'm getting really stressed about how long this is taking. Does anyone know the typical timeline for appeal hearings? I'm worried I'm going to lose my apartment if this drags on much longer.

Appeals usually take 6-8 weeks from the time you file to actually get a hearing date. Then you have to wait another 2-3 weeks for the judge's decision after the hearing. So you're looking at about 2-3 months total unfortunately.

0 coins

Oh no, that's way longer than I expected. I thought it would be like 2-3 weeks max.

0 coins

Yeah the backlog is pretty bad right now. My cousin waited 10 weeks just for her hearing date.

0 coins

The good news is if you win your appeal, you'll get backpay for all the weeks you were denied. Make sure you keep filing your weekly claims even while the appeal is pending or you won't get paid for those weeks.

0 coins

Wait, I have to keep filing weekly claims? Nobody told me that when I filed the appeal.

0 coins

Yes absolutely! You have to continue filing every week or Washington ESD won't pay you for those weeks even if you win. It's in the appeal paperwork but easy to miss.

If you're having trouble getting through to Washington ESD to check on your appeal status, I used this service called Claimyr that helped me get through to an actual person. They have a website at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. I was able to get an update on my appeal timeline that way.

0 coins

Thanks, I'll check that out. I've been trying to call for weeks but always get the busy signal or get disconnected.

0 coins

Is that service free? I'm already broke from being denied benefits.

0 coins

It's not free but it's way cheaper than losing weeks of benefits. Plus they actually get you through to someone who can help.

What was your disqualification for? That can affect how long the appeal takes. Some issues are more complex than others.

0 coins

They said I was fired for misconduct but it was totally bogus. I was late a few times but never got written up or anything official.

Mei Lin

Misconduct appeals can take longer because they have to investigate more thoroughly. Make sure you have documentation of your employment history and any communications with your employer.

0 coins

The whole appeals process is such a joke. I waited 3 months for my hearing and then the judge ruled against me anyway. Now I have to appeal to the Board of Appeals which takes even longer!

0 coins

There's another level of appeals after the hearing? This is getting ridiculous.

0 coins

Yes, if you lose at the hearing level you can appeal to the Board of Appeals, but that can take another 3-6 months. It's a long process.

0 coins

i'm in the same boat, filed my appeal 7 weeks ago and still nothing. this is so stressful

0 coins

At least I'm not alone in this. The waiting is the worst part.

0 coins

yeah and nobody at esd will tell you anything when you call. if you even get through

0 coins

One thing to keep in mind is that Washington ESD has to schedule hearings in the order they were received, so filing early helps. Also make sure you submitted all required documentation with your appeal or it could cause delays.

0 coins

I think I submitted everything but how do I know for sure? They haven't asked for anything additional.

0 coins

You should have received a confirmation notice listing what documents they received. If you didn't get that, you might want to follow up.

0 coins

My hearing was scheduled for next week but just got postponed because the judge is sick. Now I have to wait another month. This system is broken.

0 coins

That's so frustrating! Can you request a different judge?

0 coins

Nope, you get whoever they assign you. No choice in the matter.

0 coins

For what it's worth, about 60% of appeals are successful if you show up prepared with documentation. The key is having evidence to support your case, not just your word against your employer's.

0 coins

That's encouraging at least. I've been gathering emails and my work schedule to show I wasn't as bad as they claimed.

0 coins

Those statistics sound made up. Where did you get 60%?

0 coins

It's from Washington ESD's annual report. The exact number varies year to year but it's usually around 50-65%.

0 coins

Pro tip: when you get your hearing notice, it will have a phone number you can call to check if there are any earlier time slots available due to cancellations. I got my hearing moved up by 2 weeks that way.

0 coins

Good to know! I'll definitely try that when I get my hearing notice.

0 coins

How often do you have to call to check for cancellations?

0 coins

I called every few days and got lucky after about a week. Worth the effort to get it over with sooner.

0 coins

The appeals process is designed to wear you down so you give up. They're hoping you'll just find a job and stop pursuing it. Don't let them win!

0 coins

I'm definitely not giving up but it's hard to stay motivated when everything takes so long.

0 coins

That's a pretty cynical view. The delays are mostly due to high volume, not some conspiracy.

0 coins

Just wanted to follow up on the Claimyr thing I mentioned earlier - I used them again yesterday to get an update on my appeal and they were able to tell me exactly where I am in the queue. Definitely worth it for peace of mind.

0 coins

That's really helpful to know where you stand in line. I'm going to try that service.

0 coins

Seems like you're really pushing this Claimyr thing. Do you work for them or something?

0 coins

No, I'm just a regular person who was frustrated with not being able to get through to Washington ESD. I understand the skepticism though.

0 coins

I won my appeal last month and got $4,800 in backpay. The wait was awful but worth it in the end. Hang in there!

0 coins

That gives me hope! How long did your whole process take from filing the appeal to getting paid?

0 coins

About 11 weeks total - 8 weeks to get the hearing, then 3 weeks for the decision and payment. The backpay came all at once.

0 coins

make sure you're doing your job searches while waiting for the appeal too. they can deny you for not looking for work even if you win the misconduct appeal

0 coins

Wait, I have to do job searches while my claim is denied? That doesn't make sense.

0 coins

Yes, you still have to meet all the requirements including job searches. It's confusing but that's how the system works.

0 coins

The hearing itself is usually pretty quick, like 30-45 minutes. It's the waiting to get scheduled that takes forever. At least once you have a date you know it's almost over.

0 coins

Good to know it's not a long hearing. I was worried it would be like a court trial or something.

0 coins

It's more informal than a court but still official. The judge will ask you and your employer questions and then make a decision.

0 coins

If you're really struggling financially while waiting, you might qualify for food stamps or other assistance. Don't suffer in silence.

0 coins

I hadn't thought about other assistance programs. I'll look into that, thanks.

0 coins

Also check with local food banks and churches. Many have programs to help people in situations like this.

0 coins

I tried using Claimyr after seeing it mentioned here and it actually worked! Got through to someone at Washington ESD who confirmed my appeal hearing is scheduled for next month. Finally some answers!

0 coins

That's great! I'm definitely going to try it. Did they charge you right away or after they got you through?

0 coins

They explained everything upfront and I felt comfortable with it. Much better than spending hours trying to call myself.

0 coins

Just remember that even if you lose your appeal, you can still apply for benefits again in the future if you become unemployed for a different reason. This isn't permanent.

0 coins

That's somewhat reassuring at least. I'm just hoping I won't need to worry about that.

0 coins

True, but you still have to pay back any overpayments if you lose the appeal and had been receiving benefits before.

0 coins

The most important thing is to show up for your hearing! I know someone who missed theirs because they forgot and had to start the whole appeal process over again.

0 coins

Oh wow, that would be a disaster. I'll definitely put it in my calendar as soon as I get the notice.

0 coins

You can usually reschedule if you have a good reason, but it's better to just make sure you're available when they call.

0 coins

Keep all your documentation organized and ready. During the hearing you'll need to reference specific dates, emails, and conversations quickly. Being prepared makes a huge difference.

0 coins

Good advice. I've been keeping everything in a folder but I should probably organize it better.

0 coins

Yeah, create a timeline of events with supporting documents for each date. It helps you tell your story clearly during the hearing.
