How long does it take for unemployment appeal decision - Washington ESD timeline?

Filed an appeal with Washington ESD back in October after getting denied for supposedly quitting voluntarily (which I didn't - was laid off due to restructuring). My hearing was scheduled for mid-November and went pretty well I thought. The administrative law judge seemed to understand my situation and my former employer didn't even show up to defend their side. That was almost 6 weeks ago now and I'm still waiting for the written decision. Is this normal? How long do these appeal decisions usually take? I'm getting really anxious because I've been without benefits this whole time and bills are piling up.

Appeal decisions can take anywhere from 4-8 weeks after your hearing date. The administrative law judges have a heavy caseload and they need to review all the evidence and testimony before issuing their written decision. Since your hearing was in mid-November, you're getting close to that typical timeframe.

That's somewhat reassuring I guess. Just wish there was a way to check the status or get an update.

0 coins

You can try calling the appeals office directly but good luck getting through. I waited on hold for 3 hours last month.

I had my appeal hearing in September and didn't get my decision until early December, so about 10 weeks. But mine was more complicated with wage issues and multiple employers. If yours was straightforward like you described, hopefully it'll be faster.

0 coins

10 weeks?? That's insane. How did you survive that long without benefits?

0 coins

Credit cards and borrowed money from family. Not ideal but what choice did I have?

0 coins

Had similar frustration trying to get updates on my appeal status. Someone in another thread mentioned using claimyr.com to actually get through to Washington ESD agents by phone. I was skeptical but tried it and actually got connected to someone who could check my appeal status. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Worth a shot if you're tired of getting hung up on.

0 coins

Never heard of that service before. Does it actually work or is it just another scam?

0 coins

No it's legit, I was surprised too. They somehow get you through the phone queue and connected to a real person. Saved me hours of trying to call.

0 coins

Might have to try that. I've called the appeals line probably 20 times and never gotten through to anyone.

The standard timeframe for appeal decisions is 45 business days from the hearing date, but that's not a guarantee. Complex cases can take longer. You should receive your decision by mail, and if you win, any back benefits will be processed within a few days of the decision being issued.

0 coins

45 business days puts me right around early January then. Fingers crossed it comes soon.

0 coins

When you say back benefits, does that include the weeks during the appeal process?

0 coins

Yes, if you win your appeal you'll get paid for all the weeks you were denied benefits, assuming you continued filing your weekly claims.

0 coins

this is exactly why the unemployment system is broken. 6+ weeks to decide on something that should be obvious?? if the employer doesn't even show up to defend themselves that should be an automatic win for the claimant

0 coins

I agree it's frustrating but they still have to review all the documentation and make sure everything is properly recorded.

0 coins

meanwhile people are going hungry and losing their homes because of bureaucratic delays

0 coins

Did you continue filing your weekly claims during the appeal process? That's really important because if you win, you won't get back pay for weeks you didn't file.

0 coins

Yes I've been filing every week even though I'm not getting paid. Someone told me that was crucial.

0 coins

Smart move. I know people who stopped filing during appeals and lost out on thousands in back pay.

0 coins

Check your SecureAccess Washington account regularly. Sometimes the decision gets posted there before you receive the physical letter in the mail.

0 coins

I check it obsessively lol. Still just shows 'appeal pending' status.

0 coins

Same here, been checking daily for weeks. The waiting is the worst part.

0 coins

If it makes you feel any better, the fact that your employer didn't show up to the hearing is usually a really good sign. Hard to defend their position when they don't even bother to participate.

0 coins

That's what I'm hoping! The judge even commented that they had no evidence to support the voluntary quit claim.

0 coins

Sounds like you have a strong case then. Just gotta wait it out unfortunately.

0 coins

Washington ESD is so understaffed right now. I heard they're processing appeals from August and September. The whole system is backed up.

0 coins

That's crazy. How are people supposed to survive these delays?

0 coins

The backlog has definitely gotten worse lately. They need more administrative law judges but the state hasn't allocated funding for additional positions.

0 coins

I used that claimyr thing someone mentioned earlier and finally got through to check on my appeal status. Turns out my decision was actually ready but there was an issue with my mailing address. Would never have known if I hadn't called.

0 coins

Oh wow, that's good to know. Maybe I should try calling to make sure there aren't any issues like that.

0 coins

Definitely worth checking. The system has all kinds of weird glitches.

0 coins

Have you considered contacting your state representative? Sometimes they can help expedite things or at least get you information about delays.

0 coins

Didn't think of that. Do they actually help with individual cases?

0 coins

Yes, constituent services is part of their job. Worth a try if you've been waiting an unusually long time.

0 coins

The administrative law judges are supposed to issue decisions within 30 days of the hearing, but that's more of a guideline than a hard deadline. With the current backlog, 6-8 weeks seems to be the new normal.

0 coins

30 days would be reasonable. 8+ weeks is just cruel when people are struggling financially.

0 coins

Exactly. I understand they need time to review everything but this is taking forever.

0 coins

hang in there! I know its stressful but try to stay positive. from what you described it sounds like you have a really strong case

0 coins

Thanks for the encouragement. Some days I wonder if I should just give up and look for any job instead of waiting.

0 coins

Don't give up! You're entitled to those benefits and shouldn't let them deny you what you've earned.

0 coins

When you do get your decision, make sure to read it carefully. Even if you win, sometimes there are conditions or requirements you need to follow.

0 coins

Good point. I'll definitely read every word when it finally arrives.

0 coins

And if you lose, you can appeal to the Board of Tax Appeals within 30 days. Don't give up if the first decision doesn't go your way.

0 coins

Just wanted to add that I also tried claimyr.com after seeing it mentioned here and was able to get an update on my appeal. The agent told me my decision would be mailed within the next week and sure enough it arrived 5 days later. Sometimes calling really does help move things along.

0 coins

Okay you guys have convinced me. I'm going to try calling through that service today.

0 coins

Let us know how it goes! I'm curious to hear if it works for everyone or just some people.

0 coins

Update: Just called using claimyr and got through to someone at Washington ESD! They confirmed my appeal decision is completed and should be mailed out tomorrow. So relieved to finally get some concrete information instead of just waiting and wondering.

0 coins

That's awesome! Hopefully it's good news when you get the letter.

0 coins

Wow that was fast! I'm definitely calling them tomorrow morning.

0 coins

Fingers crossed for a favorable decision! Keep us posted when you get the letter.

I'm going through something very similar right now. Filed my appeal in September after being wrongly denied for "job abandonment" when I was actually terminated. My hearing was in early October and went well - I had documentation showing I was let go, not that I quit. But it's been over 8 weeks now and still no decision. The financial stress is really getting to me. Seeing everyone mention claimyr.com is encouraging though - I think I'll try that tomorrow to see if I can get any updates. Thanks for sharing your experience, it helps to know I'm not the only one dealing with these ridiculous delays.

0 coins

I'm so sorry you're dealing with this too! It's incredibly frustrating when you have clear documentation proving your case but still have to wait months for a decision. The financial stress is the worst part - I've been struggling to keep up with bills while waiting. Definitely try claimyr.com, it seems like several people here have had success getting through to actual ESD agents that way. Job abandonment claims are usually pretty easy to disprove when you have termination paperwork, so hopefully your decision comes through soon. We shouldn't have to jump through all these hoops just to get benefits we're entitled to.

0 coins

@Carmella Popescu I feel for you - 8+ weeks is just unacceptable when people are struggling to survive. Job abandonment is such a common wrongful denial they use, especially when they know most people won t'appeal. Since you have the termination docs, you should be in good shape once they finally get around to reviewing your case. I m'definitely going to try that claimyr service tomorrow after seeing all the success stories here. This whole system is so broken - we pay into unemployment insurance our whole working lives and then get treated like we re'trying to scam them when we actually need it.

I'm dealing with almost the exact same situation. Filed my appeal in late September after being denied for "voluntary quit" when I was actually laid off due to company downsizing. Had my hearing in November and it went really well - provided all my layoff paperwork and the judge seemed convinced. My former employer also didn't participate in the hearing. It's been about 7 weeks now and I'm still waiting for the decision. The uncertainty is killing me financially and emotionally. I've been continuing to file my weekly claims but getting $0 each week. Reading through all these responses is both reassuring and frustrating - reassuring to know the timeline I'm experiencing is unfortunately normal, but frustrating that the system is so backed up. I think I'm going to try that claimyr service everyone's mentioning to see if I can at least get a status update. Thanks for posting this - it really helps to know others are going through the same ordeal.

@Aisha Rahman I m'in almost the exact same boat as you! Filed my appeal around the same time after a wrongful voluntary quit denial when I was actually laid off. It s'so frustrating that we all seem to be dealing with these ridiculous wait times. The financial stress is really getting to me too - I ve'been living off credit cards and help from family while waiting. At least we re'all continuing to file our weekly claims, that seems to be crucial for getting back pay if we win. I m'definitely going to try calling through claimyr tomorrow after seeing so many people here have success with it. Hopefully we ll'both get our decisions soon - sounds like we have strong cases with the layoff documentation and employers not showing up to defend themselves.

0 coins

@Aisha Rahman Your situation sounds almost identical to mine! I was also laid off due to company downsizing but initially denied for voluntary "quit -" it s'like they use that as a default denial hoping people won t'appeal. The fact that your employer didn t'show up to the hearing is definitely a good sign, same as what happened with Layla. I ve'been surviving on savings and borrowing money from friends, which is really stressing me out. Seven weeks is way too long when people are struggling to pay rent and buy groceries. I m'going to try that claimyr service too after seeing all the positive feedback here. Hopefully we ll'both get our favorable decisions soon and can finally get some financial relief. Keep hanging in there!
