How long does it take to get unemployment appeal decision from Washington ESD?

I filed an appeal with Washington ESD about 6 weeks ago after they denied my unemployment claim. My former employer contested it saying I was fired for misconduct, but that's not true - I was laid off due to budget cuts. The hearing was scheduled and completed 3 weeks ago but I still haven't received the appeal decision. Is this normal? How long should I expect to wait for the administrative law judge's ruling? I'm really stressed about this because I've been without income this whole time.

Appeal decisions from Washington ESD typically take 4-8 weeks after the hearing date. The administrative law judge has to review all the evidence and testimony before issuing a written decision. Since you had your hearing 3 weeks ago, you're probably looking at another 1-5 weeks depending on their current caseload.

Thank you, that helps ease my mind a bit. Do you know if they send the decision by mail or email?

0 coins

They send it by regular mail to your address on file. You should also be able to see it in your eServices account once it's issued.

I went through the same thing last year - took exactly 7 weeks from my hearing date to get the decision. The waiting is brutal especially when you're not getting paid during the appeal process.

0 coins

Did you win your appeal? I'm so worried they'll side with my employer even though I have documentation showing it was a layoff.

0 coins

Yes I won! Make sure you submitted all your documentation during the hearing. The judge will consider everything that was presented.

If you're having trouble getting updates on your appeal status, I had success using Claimyr to get through to an actual Washington ESD representative who could check on my case. It's at claimyr.com and they have a video demo at https://youtu.be/7DieNd3C7zQ that shows exactly how it works. Way better than spending hours on hold.

Interesting, I hadn't heard of that service. Do they actually help you get through to Washington ESD?

0 coins

Yeah they handle the calling and waiting for you, then conference you in when they get an agent on the line. Saved me tons of time and frustration.

0 coins

How much does something like that cost though? I'm already broke from not getting benefits.

0 coins

THE WHOLE APPEAL PROCESS IS RIDICULOUS!! I've been waiting 9 weeks for my decision and Washington ESD just keeps saying 'it's under review.' Meanwhile I can't pay rent or buy groceries. This system is broken!

0 coins

I understand your frustration, but 9 weeks isn't unheard of for complex cases. Sometimes they need additional time to review evidence or if there are multiple issues to consider.

0 coins

Complex cases?? My employer lied and said I quit when I was clearly fired. How is that complex?

0 coins

Just got my appeal decision yesterday after 6 weeks exactly. Won my case! The key was having all my documentation organized and presenting a clear timeline during the hearing. Don't give up hope!

0 coins

Congratulations! That gives me hope. Did you get backpay for all the weeks you were waiting?

0 coins

Yes, they paid me for all the weeks from when I first filed my claim. It was a nice chunk of money after waiting so long.

For what it's worth, Washington ESD has been running behind on appeal decisions since they're still dealing with higher than normal caseloads. The standard timeframe used to be 30-45 days but now it's commonly 6-10 weeks. Keep checking your eServices account for updates.

0 coins

I check eServices daily but it just shows 'Decision Pending' still. Is there any way to expedite the process?

0 coins

Unfortunately no, unless there are extenuating circumstances like medical emergencies. The appeals process has to follow due process requirements.

0 coins

mine took 8 weeks but that was during covid so maybe things are faster now?? idk the whole system seems slow no matter what

0 coins

COVID definitely slowed things down, but they're still not back to pre-pandemic processing times unfortunately.

I'm dealing with the same waiting game right now. Had my hearing 4 weeks ago and nothing yet. At least I know I'm not alone in this frustrating process. My employer contested saying I was fired for attendance but I have medical documentation for all my absences.

0 coins

Medical documentation should definitely help your case! Did you submit all of that during the hearing?

0 coins

Yes, I sent everything to the judge beforehand and brought copies to the hearing. Hopefully it's enough.

0 coins

Quick question - do you have to keep filing your weekly claims during the appeal process? I wasn't sure if I should continue or wait for the decision.

0 coins

Yes, you absolutely should keep filing your weekly claims! If you win your appeal, you'll get paid for all those weeks. If you don't file them, you lose those weeks forever.

0 coins

Oh wow, good to know! I almost stopped filing them. Thanks for the heads up.

My friend used that Claimyr service someone mentioned earlier and actually got through to someone who could check the status of her appeal. Apparently the judge had already made a decision but it was stuck in processing. Worth a try if you're really anxious about the timing.

0 coins

That's interesting - so they can actually check on appeal status too, not just regular claims?

0 coins

Yeah, the Washington ESD agent she talked to could see that the decision was ready but just needed final approval. Helped her know what to expect.

I waited 11 weeks for my appeal decision last year. ELEVEN WEEKS! By the time I got it (which I won, thankfully), I had already found a new job. The backpay was nice but the stress of waiting was terrible.

0 coins

11 weeks is insane! I hope mine doesn't take that long. Did you ever get an explanation for why it took so long?

0 coins

Never got a clear answer. Just kept getting told it was 'under review' whenever I called.

0 coins

Pro tip: if you win your appeal, make sure to check that your backpay is calculated correctly. Washington ESD made an error on mine and I had to call to get it fixed. Count up all your weekly claim amounts and compare to what they deposit.

0 coins

Good advice! I did the math on mine and it was correct, but definitely worth double-checking.

0 coins

The uncertainty is the worst part. I keep checking my mail every day hoping to see that envelope from Washington ESD. At least when you're waiting for a regular claim decision there's usually some indication of progress.

0 coins

Exactly! The eServices account doesn't give you any real information about where things stand in the process.

0 coins

Just remember that if you lose the appeal, you can appeal again to the Board of Appeals. But hopefully it won't come to that. The administrative law judge decisions are usually pretty thorough.

0 coins

I didn't know there was another level of appeal. How long does that take if needed?

0 coins

Board of Appeals can take even longer - usually 8-12 weeks. But they only review for legal errors, not the facts of the case.

0 coins

hang in there! i know the waiting sucks but most people who were truly laid off win their appeals. sounds like you have good documentation so that should help

0 coins

Thanks for the encouragement! I just wish there was more transparency in the process.

0 coins

My advice is to try to stay busy while you wait. I drove myself crazy checking eServices and the mail constantly. The decision will come when it comes, and worrying won't speed it up.

0 coins

You're right, I need to try to distract myself more. It's just hard when money is tight.

0 coins

I tried using Claimyr after seeing it mentioned here and it really did help me get through to Washington ESD to check on my appeal. The agent told me my decision was actually ready and would be mailed out within a few days. Got it 3 days later!

0 coins

That's exactly what I need to know! I'm going to try that service. Better than wondering for weeks more.

0 coins

Definitely worth it. The peace of mind alone was worth using the service.

0 coins

Keep us posted on when you get your decision! I'm rooting for you. Sounds like you have a solid case if you were truly laid off due to budget cuts.

0 coins

Will do! Thanks everyone for all the support and information. This thread has been really helpful.

0 coins

One more thing - when you do get your decision, read it carefully even if you win. Sometimes there are conditions or requirements mentioned that you need to follow going forward.

0 coins

Good point, I'll make sure to read through everything thoroughly when it arrives.

0 coins

I'm in a similar boat - filed my appeal 5 weeks ago after being denied, and had my hearing 2 weeks ago. The waiting is absolutely nerve-wracking, especially when you're struggling financially. From what I'm reading here, it sounds like 4-8 weeks is pretty typical for Washington ESD appeal decisions. I've been checking eServices obsessively but it just keeps saying "Decision Pending." At least it's reassuring to know this timeline is normal and that many people here have won their appeals. Keeping my fingers crossed for both of us!
