My Washington ESD unemployment appeal was reversed - when do I get paid?
Finally got word that my appeal was approved and the judge reversed Washington ESD's decision to deny my claim! This has been going on for almost 4 months now. The hearing was last week and I just got the notice today saying the disqualification was overturned. My question is - how long does it take for Washington ESD to actually process this and start paying me? Do I get all the back pay from when I first filed? I'm so relieved but also broke from waiting this long. Has anyone been through this process before?

Congrats on winning your appeal! Usually takes 1-2 weeks for Washington ESD to process the reversal and update your account. You should get all the back pay from your original claim date if you've been filing your weekly claims this whole time. Check your SecureAccess Washington portal in a few days.

•Thank you! Yes I've been filing weekly claims even though they weren't paying me. Fingers crossed it shows up soon.

•Same thing happened to me last year - took exactly 10 days after the reversal notice for the first payment to hit my account.

You definitely get the back pay but sometimes Washington ESD is slow to process reversals. If it's been more than 2 weeks you might need to call them to push it through. The phone lines are impossible though - I've heard people use claimyr.com to get through faster. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•I'll keep that in mind if they take too long. Really hope I don't have to deal with their phone system again.

•Claimyr actually helped me get through when my payments were delayed after an appeal. Worth checking out if you need to reach someone.

•How much does that cost though? I'm already broke from waiting months for this appeal.

What was your original disqualification for? Just curious because I'm waiting for my appeal hearing next month and trying to understand what to expect.

•They said I was fired for misconduct but it was really just a personality conflict with my supervisor. Had to prove it wasn't actually misconduct.

•Thanks for sharing. That gives me hope since my situation is similar - wrongful termination claim.

•Make sure you have all your documentation ready for the hearing. Email records, witness statements, anything that supports your side.

•3 weeks?? That's way too long. Did you try calling them?

•tried calling like 50 times, never get through. might try that claimyr thing someone mentioned

•Definitely try Claimyr for situations like this. They specialize in getting people through to Washington ESD when there are payment delays.

The back pay should be automatic once they process the reversal. Mine came in 3 separate payments over about a week. First was the most recent weeks, then older weeks, then the waiting week payment. Total was about $6800 after they took out taxes.

•Good to know it might come in chunks. I'll watch for that pattern.

•Wait, they pay the waiting week too after an appeal reversal?

Yuki Sato
•Yes, if your appeal overturns the disqualification completely, you get the waiting week payment back too.

I'm still confused about the whole appeal process. If Washington ESD denies your claim and you appeal, do you keep filing weekly claims during the appeal? What if you get a job while waiting?

Ethan Wilson
•Yes, you should keep filing weekly claims during the appeal process. If you get a job, report it on your weekly claim like normal.

CyberSamurai
•Thanks, that makes sense. I was worried about filing claims while the appeal was pending.

Aisha Rahman
•Definitely keep filing! That's how you preserve your right to back pay if you win the appeal.

Congrats! Appeals are stressful but sounds like you had a good case. The judge probably saw right through Washington ESD's decision. Most employers don't show up to hearings anyway so that helps.

Aisha Rahman
•Actually my employer did show up but their story kept changing during questioning. I think that's what convinced the judge.

Andre Dubois
•Even better! When employers contradict themselves it makes your case stronger.

How long did the whole appeal process take from start to finish? I just filed my appeal last week and trying to figure out the timeline.

Aisha Rahman
•Filed my appeal in September, hearing was in December, got the decision this week. So about 4 months total.

•Wow that's a long time to wait. Hope mine goes faster.

•Appeal timelines vary a lot. Some take 2-3 months, others take 6+ months depending on their backlog.

Make sure to save copies of everything - the reversal notice, your appeal documents, all of it. Washington ESD sometimes has "computer glitches" that make things disappear.

•Good advice! I've been screenshotting everything just in case.

•Smart. I learned that lesson the hard way when they claimed they never received my job search logs.

Did you have to do job searches during the appeal process? I'm getting conflicting information about whether that's required.
0 coins
Aisha Rahman
•I kept doing them just to be safe. Figured it couldn't hurt and might help if they asked about it.

Ethan Wilson
•The job search requirement continues even during appeals. Better to do them than risk another issue later.

•Ok thanks, I'll keep logging my job searches then.

This gives me hope! My appeal hearing is next Friday and I'm so nervous. Any tips for the actual hearing?

Aisha Rahman
•Be honest and stick to the facts. Don't get emotional even if the employer says frustrating things. The judge will ask specific questions so just answer directly.

•Thanks! Did you have any witnesses or just represent yourself?

Aisha Rahman
•Just me. I had some coworkers who could have testified but the judge seemed to have enough information without them.

The waiting is the worst part. I won my appeal 6 months ago and it was such a relief to finally get that back pay. Hang in there, it should come soon!

Question - do they pay interest on the back pay since they held it up for so long? Seems like they should considering the delays.
0 coins
Ethan Wilson
•No, Washington ESD doesn't pay interest on delayed unemployment benefits. You just get the original weekly benefit amounts.

Dylan Cooper
•That's annoying but I guess better than nothing.

Aisha Rahman
•Yeah no interest but at this point I just want my money back!

I'm dealing with a similar situation but my appeal was denied. Can you appeal the appeal decision or is that it?
0 coins
Ethan Wilson
•You can file a petition for review with the Commissioner's Review Office if you disagree with the appeal decision. There's another level after that too.
0 coins
Sofia Perez
•Thanks, I'll look into that. This whole process is exhausting.

•Don't give up if you think you have a good case. The system is frustrating but sometimes persistence pays off.

When you get your back pay, remember that taxes weren't taken out during the delay. You might want to set aside some money for tax season.
0 coins
Aisha Rahman
•Good point! I forgot about that. I'll make sure to save some for taxes.
0 coins
Yuki Sato
•Actually they did take taxes out of my back pay automatically. Might depend on your withholding settings.

Dmitry Smirnov
•Oh really? That's good to know, mine didn't have taxes taken out.

Has anyone had issues with their claim going back to pending after a successful appeal? Asking because I'm paranoid about everything going wrong again.
0 coins
Ethan Wilson
•That's pretty rare. Once an appeal reversal is processed, the claim should stay active as long as you keep filing weekly.
0 coins
ElectricDreamer
•Ok good, I've been stressed about that possibility.

•I understand the paranoia! This whole process makes you expect the worst.

For anyone reading this who's going through an appeal - document everything and don't give up. The system is slow but it can work if you have a legitimate case.

Aisha Rahman
•Absolutely! Keep every email, every document, every notice. You never know what might be important.

•Exactly. And don't let them intimidate you during the hearing. You have rights.
