Will TWC backpay benefits after 6-week decision delay if I just started new job?
Hey everyone, I'm in a weird situation with my TWC claim. I filed for unemployment about 6 weeks ago after being laid off from my warehouse position. My claim has been stuck in the 'pending' status this whole time with no updates or explanation. I've called dozens of times but couldn't get through to anyone who could help me. Here's my issue - I just started orientation at a new job today (thank goodness). But I'm wondering if TWC will still pay me benefits for all those weeks I was unemployed and actively looking for work? That's a month and a half of benefits I really need to catch up on bills. Does anyone know if they'll backpay me once they finally make a decision on my claim, even though I'm employed now? I documented all my work searches during those weeks.

same thing happened to my cousin last month. dont worry, they'll backpay you for the weeks you were eligable before you started working. just make sure u keep doing your payment requests for those weeks even though ur working now

Yes, you're entitled to back payments for the weeks you were unemployed and meeting all eligibility requirements (actively seeking work, able and available, etc.) - regardless of your current employment status. Here's what you need to do: 1. Continue requesting payments for ALL weeks you were unemployed, even though you're working now 2. When you request payment, accurately report when you started working and how much you earned 3. Make sure your work search activities are properly documented for each week TWC will pay you for any eligible weeks before your start date, minus any applicable waiting period. The fact that your claim was delayed due to TWC processing doesn't disqualify you from receiving those benefits.

DONT GET YOUR HOPES UP!!! TWC is a DISASTER with backpay!!! I waited 8 weeks for my determination last year and when they FINALLY approved me, they only paid me for 4 weeks claiming I "didn't properly request payment" for the others even though I DID!!! I had to file an appeal and it took ANOTHER 6 weeks to get resolved!!! The system is BROKEN!!!

I was in this EXACT situation in January. Filed in November, got stuck in review, started a new job in January while still waiting. HERE'S WHAT I DID: 1) I used Claimyr (claimyr.com) to actually get through to TWC after weeks of busy signals. They have a video that shows how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh 2) Once I got through, the agent confirmed I was eligible for all those weeks I was unemployed BEFORE starting my new job 3) I had to specifically request payment for each of those weeks (even retrospectively) and provide my work search contacts 4) I received payment for all eligible weeks about 10 days later Don't give up on those weeks you're owed just because your claim was delayed!

just FYI they always ask when u first started wrking during payment request process. u gotta be 100% honest about ur start date or they can hit u with overpayment later. they check with employers.

Trust me, calling that 800 number is USELESS unless you want to waste hours of your life! After 45 calls in one day, I finally used Claimyr and got through in about 20 minutes. Best decision I made during this whole unemployment nightmare. The agent was able to help me with backdating all my payment requests for weeks I'd missed.

One thing to keep in mind: when TWC finally processes your claim, you might receive all the back payments in one lump sum. This could potentially affect your tax situation for 2025, so you might want to set aside some of it for taxes next year. The standard withholding is often not enough, especially for lump sum payments covering multiple weeks.
