Can TWC backdate my unemployment claim after being fired 3 weeks ago?
I got fired from my warehouse job on October 9th but I've been so overwhelmed trying to find new work that I just applied for unemployment benefits today. Will TWC give me backpay for the weeks I've already missed since being let go? I'm really struggling with rent coming up and didn't realize I should apply right away. Does anyone know if they automatically backdate claims or do I need to do something special when requesting payment? This is my first time filing for unemployment in Texas.

TWC generally doesn't automatically backdate claims. When you file, your claim is effective from the Sunday of the week you apply. You'll need to specifically request backdating by calling TWC and explaining why you delayed filing (legitimate reason needed). I had to do this last year when I waited about a month to file because I thought I'd find work quickly. However, even if they approve backdating, you'll still need to certify for those past weeks and verify you met all eligibility requirements during that time (like work search activities). Did you happen to be looking for work during those weeks you didn't file?

•Thank you for explaining! I've been applying to a few places each week but wasn't keeping good records because I didn't know I needed to. Will that be a problem? Also how do I certify for those past weeks if they do backdate my claim?

GOOD LUCK with that! TWC barely processes regular claims correctly, much less backdating. I waited 2 weeks to file after being laid off last spring and they flat out REFUSED to backdate even though I had a perfectly good reason (was in the hospital). The system is DESIGNED to deny you money any way they can. Just warning you not to get your hopes up.

•Same happened to my brother-in-law. TWC is super strict about the backdating rules especially since the pandemic ended.

Ugh that sucks about the timing... I just applied 3 days after getting laid off and I'm already stressed about missing those few days lol. Wondering the same thing about backdating!

•Just to clarify for everyone: TWC can backdate claims in certain situations, but they require good cause for the delay. Missing a few days is different from missing multiple weeks. For the original poster, you'll need to provide a compelling reason why you waited 3+ weeks to file. Acceptable reasons might include illness, technical issues accessing the system, or receiving incorrect information about your eligibility. As for work search requirements, you should have been doing at least 3 work search activities each week, and you'll need to report those if your claim gets backdated. If you can't document your job search efforts for those weeks, that could unfortunately impact your eligibility for those backdated weeks.

I had the same problem but finally got through to a TWC agent who helped me with backdating my claim. Calling their regular number was impossible - busy signals for days. I used a service called Claimyr (claimyr.com) that got me connected to a TWC rep in about 15 minutes. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh The TWC agent had me explain why I delayed filing (in my case I was waiting for severance details from my employer) and they backdated my claim by 2 weeks. Worth trying if you have a legitimate reason for the delay.

•Thanks for the tip! I'll check out that service since I've already tried calling twice and couldn't get through. Did you have to provide any proof of your reason for filing late?

i think u have 2 call them asap, the longer u wait the harder itll be. when i filed last yr i was told u gotta file within like the first week or 2 of losing ur job. but maybe they changed the rules idk

•You're right about calling ASAP. The basic rule is that claims start from the Sunday of the week you file, not the date you lost your job. Backdating requires a specific request and approval.

I'm just wondering did they give you a reason when they fired you? Because that might affect your claim more than the backdating issue. If they fired you for misconduct, TWC might deny your claim entirely.

•They said it was for 'performance issues' but honestly my manager had it out for me from day one. I was meeting all my quotas except for the last week when they suddenly increased them without proper training. Should I be worried about getting denied?

To directly answer your question: Yes, TWC can potentially backdate your claim, but it's not automatic and not guaranteed. Here's what you need to know: 1. Call TWC as soon as possible and specifically request backdating. Explain why you delayed filing (they'll need a good reason) 2. If approved for backdating, you'll need to certify for those missed weeks by requesting payment for each week individually 3. You must have been eligible during those weeks, including meeting the work search requirement (3 work search activities per week) 4. Document whatever job search activities you can remember doing during those weeks (applications, interviews, resume submissions, networking) 5. Be prepared that they might only approve partial backdating or none at all depending on your circumstances The most important thing now is to start requesting payments on your current claim according to your payment request schedule and continue meeting work search requirements going forward.

•This is super helpful, thank you! I'll call tomorrow and see what they say about backdating. I've started keeping better records of my job applications now too.
