Will TWC pay retroactive benefits if I find a job before my appeal hearing?
I got fired from my job on August 28th and immediately filed for unemployment. TWC denied my claim saying I was fired for misconduct (which is NOT true - my boss just didn't like me). I filed an appeal right away and finally got a hearing date of January 11th, 2025. That's over 4 months of waiting! Here's my situation - I'm actively job hunting and might get an offer next week. If I start working BEFORE my appeal hearing, would I still get backpay for all those weeks between August 28th and whenever I start the new job IF I win my appeal? Or am I just out of luck for those months? This is my first time dealing with unemployment and the appeal process. The TWC website doesn't clearly explain what happens with backpay if you find work before your appeal is decided. Has anyone been through this before?

Yes, if you win your appeal, TWC should pay you for all the weeks you were eligible between when you initially filed (August) and when you start your new job. You just need to have been requesting payment for those weeks all along. You HAVE been requesting payment every two weeks, right?

TWC IS TERRIBLE AT COMMUNICATING THIS STUFF!!!! I got screwed over the EXACT same way last year. Appeal took 3.5 months, won my case, but only got paid for the 2 weeks I remembered to request payment. Lost out on THOUSANDS because no one bothered to tell me I needed to keep requesting even though I was initially denied. The whole system is designed to make people give up!!!!!

I went through this exact situation in September. You absolutely need to call TWC and explain that you weren't properly informed about continuing payment requests during appeal. Pro tip: getting through to TWC by phone is nearly impossible using the regular number. After wasting 3 days trying, I used a service called Claimyr (claimyr.com) that got me connected to a TWC agent in about 20 minutes. I just want to emphasize how INSANE it is that TWC doesn't make this clear!!! The determination letter should say in HUGE BOLD LETTERS that you need to keep requesting payments during appeal. They deliberately make this confusing so people miss out on benefits they deserve. It's total BS that we have to learn this stuff from random internet strangers instead of the actual agency that's supposed to help unemployed people!

One more thing - when you talk to TWC about the missed payment requests, make sure you specifically ask for a "backdated payment request" form. They can email it to you. Fill it out for each missed week, explaining that you weren't informed of the requirement to continue requesting during appeal. Be very specific with dates and include any proof that you were job searching during those weeks.
