Fired from job & TWC says 'potentially eligible' - what does this really mean?

Just got fired last week (my manager said it was for 'performance issues' but I never even got a warning). I filed for unemployment and called TWC to check on my claim status. The automated system told me I'm 'potentially eligible' - does anyone know what that actually means? Is that good news or just standard language? Also, they asked me to submit ID verification docs through ID.me about 4 days ago. I uploaded my driver's license and social security card right away. How long does this verification usually take? The waiting is killing me because I have rent due next week. This is my first time filing for unemployment in Texas so I'm completely lost about what comes next or how long everything takes. Any help would be appreciated!

potentialy eligible just means ur case is under review. thats what mine said 2 when i got laid off. they gotta talk 2 ur employer b4 making final decision

Oh that makes sense. Do you know if they'll contact me again before making a decision? I'm worried my former employer will lie about why they fired me.

"Potentially eligible" means TWC has received your initial claim and it appears to meet the basic requirements, but they haven't made a final determination yet. They'll contact your employer for their side of the story regarding your separation. Since you were fired for alleged performance issues, TWC will need to determine if this was misconduct (which would disqualify you) or simply not meeting expectations (which usually qualifies). The key is whether you were deliberately violating policies or just couldn't meet their standards despite trying. ID.me verification typically takes 2-7 days to process, though it can sometimes take longer if there are system backlogs. You should receive an email once it's complete. Keep requesting payments on your scheduled days even while waiting for the final determination. If approved, you'll receive backpay for any eligible weeks you properly requested.

Thank you so much for explaining! I definitely wasn't violating any policies - I was just struggling to hit their unrealistic sales targets that they kept increasing every month. Hopefully TWC understands that's not misconduct. I'll make sure to keep requesting payments while I wait.

I was in the EXACT same boat last November!! My boss fired me for "not meeting expectations" but really I think he just hired his nephew and needed my position. Anyway, mine said potentially eligible too and I freaked out but then got approved after like 2.5 weeks. The ID.me thing took forever tho, like 8 days for me, so annoying!

Wait seriously? Companies can just fire you to hire family members? Is that even legal in Texas? That seems so unfair! Did you try to fight it at all?

Yep, Texas is an at-will state so they can fire you for pretty much anything as long as it's not discrimination against a protected class. I couldn't prove it was because of the nephew thing anyway - that was just my suspicion. But TWC still approved my benefits because they didn't consider underperformance as misconduct.

Just so you know, "potentially eligible" is the standard status everyone gets at first. It doesn't mean much by itself. The real decision comes after TWC investigates. When you were fired for performance, did you get any written warnings before? Did they have a progressive discipline policy? The key factor for TWC is whether your firing was for misconduct or just not meeting standards. Misconduct means intentionally doing something wrong, not just being bad at your job. As for ID.me, it's been taking longer lately. I've seen verification take anywhere from 3 days to 2 weeks. Keep checking your TWC correspondence inbox for updates. For now, focus on these things: 1. Document everything about your firing (emails, performance reviews, etc.) 2. Request payment on your assigned days even before full approval 3. Start your work search activities (minimum 3 per week) and document them 4. Be ready for a potential phone interview about your job separation

Thanks for the detailed advice! No, I never received any written warnings - just verbal feedback during meetings that I needed to improve my numbers. There wasn't a clear progressive discipline policy that I was aware of. I'll definitely follow your checklist and start documenting everything.

UGH the ID.me verification is THE WORST!! I had to wait 2 whole weeks in February because their system kept glitching during my face verification step. Then TWC claimed they never got the verification even though ID.me said it went through! I kept calling TWC but could NEVER get through - just busy signals for DAYS!! So frustrating!!!!

I had the same problem with ID.me and TWC not communicating properly. If this happens to you, try using Claimyr to get through to a TWC agent (claimyr.com). I was skeptical at first, but they got me connected to an actual TWC representative in about 25 minutes instead of spending days getting busy signals. There's a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh The agent I spoke with was able to manually verify that my ID.me was complete on their end, which fixed my claim status right away.

Don't get too excited about "potentially eligible" - I got that status too and ended up being denied because my employer claimed I was on my phone too much which they called "misconduct" 🙄 Hope you have better luck though!

Did you appeal the decision? Phone usage would only be misconduct if they had a clear policy against it that you were warned about previously. Many people successfully appeal initial denials for these types of issues.

One more important thing - make sure you're logging into your TWC account regularly to check for correspondence. They might send you questionnaires about your work separation that have strict deadlines. Missing these can result in benefit denials. Also, when you say "called TWC and it says potentially eligible" - did you actually speak to a representative or just hear the automated system? The automated system only gives basic status updates, while a representative can tell you more details about what's happening with your claim.

I only heard the automated system - I couldn't get through to an actual person. I'll try calling again and will definitely check my correspondence daily. I didn't realize they might send time-sensitive questionnaires. Thank you!

I didn't know that! I thought I only had to start work searches after being approved. I'll start looking right away. Thanks for the heads up!
