Fired for performance issues - will TWC approve my claim? Determination letter coming tomorrow

Just applied for Texas unemployment on Oct 13th after getting fired from my sales job. My manager said I wasn't meeting targets for 3 consecutive months, but honestly the goals kept changing and I was hitting about 80% of them. They documented everything in my personnel file with those "performance improvement plans" but I really was trying my best. My determination letter is supposed to arrive tomorrow and I'm freaking out! Will TWC approve my claim if I was fired for performance reasons? I've got bills due next week and my savings are basically gone. This is my first time ever filing for unemployment and I have no idea what to expect. Anyone been through something similar?

THEY WILL DENY YOU!!! TWC sides with employers 99% of the time!! My company fired me for "performance" but it was really because I took medical leave and they didn't want to accommodate my restrictions. TWC rubber-stamped their BS reason and denied me! Took me 3 MONTHS of appeals to finally get approved. The whole system is BROKEN! Still can't believe they get away with treating people like this when we're at our most vulnerable. Make copies of EVERYTHING and be prepared for a fight!

For performance-based terminations, they look at whether you were capable of meeting the standards, whether you knew about the standards, and whether you made a good faith effort to meet them. I went through almost the exact same situation in December. Sales targets that were impossible to hit, constantly changing metrics, and got fired right before the holidays. The key to my approval was proving the targets were unreasonable and changed frequently. This is SO helpful, thank you! I'll start gathering all my performance review emails now. My manager actually admitted in an email once that the new targets were "ambitious" after the company lost a client. Going to save that one for sure! I'll check out that Claimyr thing if I can't get through - I tried calling TWC yesterday and gave up after being on hold for an hour.

The HR lady told me it would come tomorrow, but maybe she was just saying that? I don't know if she actually knows the TWC timeline or was just trying to get me out of the office faster lol. I'll update when/if I actually get it!

Quick update for you: performance-based terminations are typically handled as misconduct cases, but there's an important distinction in Texas law. If you were genuinely trying to meet the standards but simply couldn't despite your best efforts, that's usually NOT considered misconduct. Misconduct requires some element of willful disregard or negligence. When you get your determination letter, if they deny you, you'll have 14 calendar days to appeal. During appeal, focus on these points: 1. You made consistent efforts to meet standards 2. The goals changed frequently (provide documentation) 3. You were meeting a reasonable percentage of the goals 4. You never intentionally underperformed And keep doing your payment requests while appealing! Many people win on appeal even after initial denial.

UPDATE: Got my determination letter today! I was APPROVED!!! The letter said something about "insufficient evidence of misconduct" and that my "inability to meet performance standards alone does not constitute misconduct." Thank you all so much for your help and advice! I'm going to keep documenting everything in case my employer appeals, but for now I'm just relieved. My payment request day is Monday, so I'll be doing that and making sure I keep up with my work search requirements (already applied to 5 jobs yesterday just to be safe).
