TWC unemployment pending after ID.me verification - do I get approved if employer doesn't respond?

I submitted my unemployment application on July 21 and went through the ID.me verification right after. When I called TWC on Monday, the rep told me my former employer has until today to respond to my claim. I'm wondering what happens next - if my employer doesn't reply by the deadline today, does that mean my claim automatically gets approved? Has anyone been through this waiting period? Getting really anxious since rent is coming up and I need to know if I can count on these benefits.

Your claim doesn't automatically get approved just because your employer doesn't respond by the deadline. TWC still has to make a determination on your eligibility based on the information they have. That said, if your employer doesn't contest your claim by providing contradicting information about why you're no longer employed, it generally improves your chances. TWC typically takes 2-3 weeks to make a determination after the employer response deadline passes. Keep requesting payments on your scheduled days even while waiting for the determination!

Yes, you absolutely need to be doing work search activities while waiting for determination. Texas requires 3 work search activities per week. Document everything carefully - job applications, interviews, networking events, etc. Make sure to register with WorkInTexas.com too, as that's required. Regarding backpay - if approved, you'll receive benefits for all the weeks you properly requested payment (which you should be doing every two weeks on your assigned day), as long as you met the work search requirements for those weeks.

lol good luck actually getting through to TWC when you need to ask them something. i spent THREE WEEKS trying to reach someone about my employer response issue. kept getting busy signals or disconnected after waiting 2+ hours.

I went thru the EXACT situation last month!!! My employer had until Aug 10 to respond and they never did. TWC finally made a determination on Aug 24 (so like 2 weeks after employer deadline). I got approved BUT then had this weird issue where my payment request wasnt going thru because of some ID.me glitch. Had to call again and fix that before I got paid. The system is SO FRUSTRATING!!! Just a warning that even when your employer doesnt respond there could still be more delays.

Everyone's timeline is different. My employer didn't respond and I was approved 3 days after their deadline, while my husband's took almost a month after the employer deadline. It really depends on how backed up TWC is and if there are any flags on your claim. One important thing to remember: if you worked for multiple employers during your base period, ALL of them get contacted, not just your most recent employer. So the timeline could be affected by any of them responding or not responding.

I didn't realize all my base period employers would be contacted! That makes sense though. I worked for two different companies last year before my most recent job. Guess I'll just keep requesting payments and doing my work searches while I wait.

Once your employer's deadline passes, keep an eye on your claim status in the TWC portal. It will change from "pending" to either "approved" or there might be an issue that requires additional information. If there's no change after 2 weeks, that's when I'd recommend trying to contact TWC directly to check if there's a hang-up somewhere. Also - start documenting your work searches immediately if you haven't already. Use the WorkInTexas.com system to track them, as TWC can directly verify those searches if they audit your claim later.
