NY unemployment says I owe $220 - will they deduct it all from next week's payment?

So my ny unemployment portal is showing that I owe them $220. I got a letter in the mail about 2 weeks ago saying they overpaid me back in August because I reported some part-time hours incorrectly. My regular weekly benefit is supposed to be $490. What happens when I certify next week? Will they take the entire $220 from my payment and give me $270? Or will they take it in smaller chunks? I'm seriously stressing because rent is due soon and I need to know exactly how much I'll be getting. Has anyone dealt with this before? The website doesn't explain the repayment process clearly at all.

they usually take it all in one shot unless you call and set up a payment plan. happened to me in April - they said I owed $268 and then when I certified the next week, my payment was short exactly that amount. Its BS that they don't make this clearer on there site.

Damn that's what I was afraid of. Did you have to call them or did they just automatically take it all?

0 coins

they just took it. Didn't even get a warning or nuthin. Just opened my acct and saw less money 😒

This happened to me too. You can call and arrange payments if you need to, but good luck getting thru to an actual person 🙄

I was facing the exact same issue where I owed them money (around $300). Was on hold for hours but couldn't get through to anyone. Finally tried this service called Claimyr (claimyr.com) and they got me a callback with a real agent within an hour. Talking to the agent got my issue fixed way faster than I expected! You can check out how it works here: https://youtu.be/Rdqa1gKtxuE - it was honestly the only way I could talk to someone when I really needed to.

Does this actually work? I've been trying to reach NY unemployment for 3 weeks now 😫

0 coins

Yeah it worked for me! I was skeptical too but I was desperate after trying for days. They basically call for you and when they get through, they connect you with the agent. The callback came in about 40 mins for me.

idk sounds sketchy... another "magic solution" that probly doesnt work 🤔

0 coins

I get why you'd think that. I was hesitant too. But talking to an agent got my $ unlocked so fast it was worth it to me. Not trying to convince anyone, just sharing what helped me 🤷‍♀️

wait hold up - this sounds like some kinda scam. has anyone else used this?

0 coins

I actually used it last month. Got a callback in like an hour and managed to fix my claim issue. Saved me days of calling and getting disconnected.

They took all of mine at once. It was $176 out of my $435 payment. I was PISSED cause I had bills due and wasn't expecting that hit. The system is designed to screw us over I swear.

Here's what you need to know about overpayments with NY unemployment: By default, they will withhold the ENTIRE amount owed from your next payment if possible. However, you do have options: 1. You can contact them BEFORE your next certification to set up a repayment plan. This allows smaller deductions over multiple weeks. 2. If taking the full $220 at once would cause financial hardship, make this clear when you call. They can sometimes adjust based on hardship. 3. You can also request a waiver if the overpayment wasn't your fault, but this takes time to process. 4. Document everything. Take screenshots of your portal showing the overpayment notice. The most important thing is to be proactive and contact them BEFORE you certify. If you wait until after they've taken the money, it's much harder to fix. I recommend using claimyr.com to get through to an agent quickly - the regular phone lines are a nightmare and you'll waste hours. Getting this resolved now will save you a lot of stress.

Thank you so much for this detailed answer! Definitely going to try to contact them before I certify. Didn't know about the hardship option.

0 coins

This is gold! I had no idea about the waiver option. My overpayment was totally their mistake.

0 coins

Happy to help! And yes, the waiver option isn't advertised much but it's definitely available if the overpayment wasn't your fault or if repayment would cause significant financial hardship.

Y'all are lucky if its just $220. NY unemployment hit me with a $1700 overpayment notice last month! 😭 Said I didn't report some income from Feb. I'm still fighting it cause I DEFINITELY reported everything correctly.

0 coins

You should appeal that! I had a similar situation and won my appeal because they made a mistake.

Already did but the appeal process is taking FOREVER. Going on 6 weeks now with no update.

0 coins

Try reaching out to your state representative. That's what got my appeal moving after it was stuck for weeks!

Just FYI I've been through this. They took the full amount out of my next payment but when I called they said I could have set up a payment plan BEFORE they took it. The system is designed to take full payment unless you intervene. Call them ASAP!!

to answer ur original question, yes they will take the WHOLE $220 at once unless u call them and set up a payment plan. and u better call BEFORE u certify again or it'll be too late

Thanks for the straight answer. Guess I'll be spending tomorrow on the phone...

good luck getting through... took me 2 days of calling last time 👀

Use claimyr.com - saved me hours of being on hold when I had to deal with an overpayment issue.

I hate how NY Unemployment dosent explain this stuff clearly. The whole system feels designed to confuse people so they can take more money back. Its like they WANT us to mess up so they can claim "overpayments" 🙄

0 coins

THIS!!! Happened to my cousin too. They make it so complicated on purpose!

0 coins

Facts. The website looks like it was designed in 1995 and they never bothered to update it.

0 coins

they will 100% take all of it in one shot unless you call and set up a payment plan. its in the fine print of that letter they sent you. i had to borrow money from a friend when they did this to me cause my rent was due the same week 😡

If you received an overpayment notice, you should check if you qualify for a WAIVER! A lot of people don't know this exists. If the overpayment wasn't your fault or would cause financial hardship, you can apply for a waiver and potentially not have to pay it back at all. Worth checking into!

0 coins

Really? I didn't know about this! The mistake was partially my fault since I reported wrong hours, but it wasn't intentional.

0 coins

Even if it was partially your fault, you can still apply! The worst they can say is no. But if you can prove it was an honest mistake and repayment would cause hardship, you have a chance.

0 coins

I got a waiver approved last year! Took about 4 weeks but they eventually forgave the whole amount.

0 coins

i was in the EXACT same situation in september. owed them $185 and they took it all at once from my next payment. i tried calling but couldnt get through. The system is rigged against us frfr

0 coins

When I had an overpayment, I used a trick I learned. Request a hearing to dispute it - this puts the collection on hold while your case is pending. Buys you time to save up to pay it back or work out a payment plan. Just an option if you're desperate.

0 coins

Smart move! I did something similar and it gave me enough time to get my finances straight.

0 coins

Be careful with this though. If you lose the dispute they can charge interest on the original amount.

0 coins

Good point about the interest - they didn't charge me any but maybe rules have changed or vary by circumstance.

0 coins

CALL THEM! Don't just accept they'll take it all. But don't waste time trying their useless phone system. I found this service called Claimyr that got me through to an agent in under an hour when I was dealing with an overpayment problem. Totally worth it - claimyr.com saved me a ton of headache.

0 coins

another day, another company promising to fix the unfixable unemployment system lol

0 coins

Nah man, I was skeptical too but it's just a service that sits on hold for you. When they get an agent they call you. Saved me from the 3+ hour hold times.

0 coins

Can confirm this works. Unemployment finally fixed my backpay issue after months because I was able to actually talk to someone.

0 coins

sorry your dealing with this! unemployment system is such a mess these days. and yeah they take it all at once usually. happened to me back in july.

0 coins

In my experience they take maximum 50% of your weekly benefit amount for overpayments. So with $490 benefit, they shouldn't take more than $245 per week.

0 coins

That's not true. They took 100% of my friend's payment last month for an overpayment. Unless there's a new rule?

0 coins

Maybe it varies by situation? My neighbor had an overpayment in May and they only took half her payment each week until it was paid off.

0 coins

It depends if you set up a payment plan or not. If you don't arrange anything, they'll take it all at once if possible.

0 coins

This whole system is BROKEN. I had a similar issue and spent WEEKS trying to talk to someone. When I finally got through, they admitted it was their error but still made me pay it back. New York unemployment is a joke.
