NY unemployment overpayment of $220 - will I get partial benefit payment next week?
So I just got notified that NY unemployment claims I owe them $220 for an overpayment. I'm planning to certify next week as usual. If my weekly benefit amount is $504, will they just take the $220 I owe and give me the rest ($284)? Or will they take my entire payment until the overpayment is paid? I really need at least some money coming in next week. Has anyone dealt with this situation recently?

Yes, NYSDOL will typically just deduct what you owe from your next payment. So if your weekly benefit is $504 and you owe $220, you should receive $284 for that week. They won't withhold your entire benefit amount unless the overpayment is equal to or greater than your weekly benefit amount.

I had something similar happen in January 2025. The DOL took exactly what I owed from my payment (it was around $175) and gave me the rest. On my payment history, it showed the full benefit amount, then a line item for the overpayment recovery, and then the net payment amount. You should be fine!

Did you get a determination letter? It should say exactly how they're going to recoup the money. Some letters say 50% of your weekly benefit, others say 100%. Check the paperwork they sent you.

Unemployment is IMPOSSIBLE to deal with!!! I had an overpayment last year and tried calling to set up a payment plan because I couldn't afford to lose ANY of my weekly benefit and guess what??? Could NOT get through to a real person!!! Sat on hold for HOURS multiple days!!! Their system is designed to FRUSTRATE PEOPLE!!!!

Just make sure ur not certifying anything wrong next time or theyll add more overpayments. Double check everything before u submit. My cousin had like 5 overpayments cause he kept making mistakes when certifying
