im going through this right now too!!!! so annoying. finally had to have my state rep's office call them to get the date because they never sent the letter. might be worth contacting your local representative if you keep hitting walls.
how do you find your state rep? and what info do you need to give them?
just google "NY state representative" + your address. you'll need your claim ID, contact info, and a brief explanation of your issue. they have caseworkers who handle this stuff all day.
FYI for anyone getting these scams - NY DOL has an actual alert about this on their website right now. They specifically mention DocuSign scams that reference tourism funds. NEVER click links in these emails!!!
Ugh the absolute state of ny unemployment that we cant even tell whats real anymore. The legitimate communications are so confusing and the website is so bad that scammers can easily make fake stuff that looks just as official as the real thing 😩
THIS!!! 👆 The real website looks like it was made in 1998 so when scammers make something slightly better looking, people assume it's legit lol
Pro tip: if your hearing is by phone, use earbuds/headphones so your hands are free to look through your documents while talking. Sounds obvious but I didn't think of it until halfway through my hearing and was struggling to juggle everything.
Ok but has anyone actually WON one of these hearings when the employer showed up? My old boss is def gonna be there with HR and probably a lawyer. I feel like I don't stand a chance.
I lost mine when going against a company lawyer. Wish I'd had my own representation. Don't underestimate how prepared they'll be.
It really depends on the specifics of your case. If you were genuinely laid off and have any proof, that should be enough regardless of who they bring. The burden of proof is on the employer to show why you shouldn't get benefits.
Any updates on this? I'm in the exact same situation and wondering if i should change my withholding for future payments at least
Not sure if this helps but I was in a similar situation... had taxes taken out and then heard something about a tax break. Turns out the tax break was only for 2020 unemployment during COVID times. For 2021-2023, unemployment is fully taxable again. You're probably better off having kept the withholding on so you don't owe a bunch when tax season comes around.

the state never makes it easy to get whats yours... typical ny unemployment nonsense. try twitter - seriously. i tweeted at NYSDOL and surprisingly got a DM asking for my info. worth a shot when nothing else works.

Have you tried checking if your partner has multiple accounts in the system? Sometimes when people reapply it creates a duplicate account and the benefits get stuck in limbo between them. Ask specifically about this when you call.
