Wait I'm confused - if you're applying for disability doesn't that mean you CAN'T work? How can you also say you're able and available for work for unemployment? This seems like fraud to me.
It's not fraud if you're honest about your limitations. Disability and unemployment have different definitions of 'unable to work.' You can be disabled from your previous job but still able to do other types of work. The key is transparency with both agencies.
If you're having trouble reaching someone at NYS Department of Labor by phone, I recently discovered this service called Claimyr (claimyr.com) that helps you get through to an actual agent. They have a demo video at https://youtu.be/qyftW-mnTNI showing how it works. Might be easier than trying to rush to the office after work, especially since most claim issues need to be handled by phone agents anyway.
Never heard of that before. Is it legit? I'm desperate at this point because my adjudication has been pending for weeks.
i went through this whole process last year when my company downsized. honestly the hardest part was just getting through to someone at NYS Department of Labor when I had questions. their phone lines are always busy and the wait times are ridiculous. ended up using this service called claimyr.com that helped me get through to an actual agent. they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. was way easier than sitting on hold for hours
Just to add - there are different types of unemployment situations. Regular UI is what most people think of, but there's also partial unemployment if your hours get cut, and standby status for temporary layoffs where you expect to return to the same job. Each has slightly different rules but all go through NYS Department of Labor.
The NYS Department of Labor phone lines have different hours than the online system. If you need to speak to someone, they're typically open Monday-Friday 8am-5pm, but the my.ny.gov portal for weekly claims is always available. Just make sure you file before your weekly deadline.
Speaking of phone lines, I've been trying to reach them for weeks about my adjudication issue and can never get through. The hold times are insane and half the time I just get disconnected.
I had the same problem with getting through to NYS Department of Labor by phone. I ended up using a service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me hours of trying to call myself.

I had such a nightmare trying to reach someone at NYS Department of Labor when my claim got stuck in adjudication. Spent weeks calling and either got busy signals or got hung up on after waiting an hour. Finally found this service called Claimyr that basically calls for you and gets you connected to an actual agent. They have a website at claimyr.com and there's a demo video showing how it works at https://youtu.be/qyftW-mnTNI. Saved me so much stress honestly.

•Is that legit? Sounds too good to be true with how impossible it is to get through to NYS Department of Labor.

•Yeah I was skeptical too but it actually worked. Got connected to an agent within a few hours instead of calling for days myself.

Just be patient with the process. The NYS Department of Labor is dealing with a lot of claims right now. As long as you filed everything correctly and keep filing your weekly claims, you should be fine.
