When can unemployment be denied by NYS Department of Labor?

I got fired from my retail job last month and applied for unemployment benefits. My manager said I was terminated for attendance issues but I think it was unfair since I had to miss work when my kid was sick. Now I'm worried my claim might get denied. What are the main reasons NYS Department of Labor can deny unemployment claims? I've never filed before so I don't know what to expect during this whole process.

NYS Department of Labor can deny unemployment for several key reasons: voluntary quit without good cause, being fired for misconduct, not being able and available to work, or failing to meet job search requirements. For attendance issues, it depends on whether they consider it misconduct. If you missed work for legitimate family reasons and followed company policy for calling out, that might not be considered misconduct.

I did call in each time but my manager said it was still too many absences. Do I need to provide medical documentation or something to prove my kid was sick?

The adjudication process will look at all the details. Common denial reasons include: not earning enough in your base period, being fired for willful misconduct, quitting without good cause, refusing suitable work, or not actively seeking employment. They'll contact both you and your employer to get their side of the story.

How long does adjudication usually take? I've been waiting 2 weeks already and getting anxious about bills.

Been through this before - NYS Department of Labor is pretty thorough. They denied my first claim because I quit to take care of my mom but didn't have proper documentation. Had to appeal and provide medical records. Also got denied once for not doing enough job searches - they require 3 work search activities per week now.

Wait, 3 job searches per week?? I thought it was just registering with the job center. What counts as a work search activity?

If you're having trouble getting through to NYS Department of Labor to check on your adjudication status, I found this service called Claimyr that helps you get connected to agents faster. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really helped when I was stuck in adjudication limbo for weeks.

Thanks, I'll look into that if I can't get through on my own. The phone lines are always busy.

ugh the system is so frustrating!!! they denied me because they said I didnt look for work enough but I applied to like 20 jobs. apparently you have to log everything in their stupid system or it doesnt count

You have to keep detailed records in the work search log on the NYS Department of Labor website. Just applying isn't enough - you need to document company names, contact info, dates, and method of contact for each search activity.
