If you get terminated can you get unemployment in Washington state?
I just got fired from my job last week and I'm wondering if I can still apply for unemployment benefits through Washington ESD. My manager said it was due to poor performance but I feel like they were just looking for reasons to let me go. Does getting terminated automatically disqualify you from getting UI benefits? I've been working there for 2 years and never had any written warnings before this. Really stressed about paying my bills and need to know if it's even worth applying.

You can definitely still apply for unemployment even if you were terminated. Washington ESD will investigate the circumstances of your termination to determine if you're eligible. If you were fired for reasons beyond your control or for reasons that don't constitute 'misconduct', you should qualify for benefits. Poor performance usually doesn't count as misconduct unless it was willful.

•That's a relief to hear. Should I mention in my application that I feel the termination was unfair or just stick to the basic facts?

•Just stick to the facts when you file your initial claim. If your employer contests it, you'll have a chance to present your side during the adjudication process.

Same thing happened to me 6 months ago. Got fired for 'attitude problems' but still got approved for unemployment. The key is that Washington ESD has to determine if what you did rises to the level of misconduct. Simple poor performance or personality conflicts usually don't qualify as misconduct.

•How long did it take for your claim to get approved? I'm worried about the waiting period.

•It took about 3 weeks because my employer contested it and it went to adjudication. But I eventually got all my back pay once it was approved.

If you're having trouble getting through to Washington ESD to discuss your claim, I used a service called Claimyr that helped me reach an actual agent. You can check them out at claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that explains how it works. Really saved me hours of trying to call and getting busy signals.

•Never heard of that before. Is it legit? I've been dreading having to deal with the phone system.

•Yeah it's legit. They basically handle the calling for you and connect you when an agent is available. Beats sitting on hold for hours.

•How much does something like that cost? I'm already strapped for cash.

DEFINITELY apply! The worst they can say is no, but you have a good chance if it was just performance related. I got fired for being late too many times and still got unemployment because Washington ESD determined it wasn't willful misconduct.

•That gives me hope. I was never late or anything, just struggled with some of the new software they implemented.

The unemployment system is so broken. They make you jump through hoops even when you clearly deserve benefits. I had to wait 2 months for mine to get approved and by then I was behind on everything.

•The system definitely has its issues, but it's still worth applying. Most people do eventually get approved if they qualify.

•I guess. Just frustrated that people who need help the most have to wait the longest.

Apply as soon as possible because there's a waiting week before benefits start anyway. Even if your employer contests it, you want to get the process started. Make sure you keep filing your weekly claims even during adjudication or you'll lose those weeks.

•Good point about filing weekly claims during adjudication. I didn't know you had to do that.

•Yeah, that's a common mistake. You have to keep certifying even while they're investigating your eligibility.

What kind of poor performance were they claiming? That could make a difference in how Washington ESD views your case.

•They said I wasn't meeting productivity targets with the new system they installed. But half the office was struggling with it.

•That sounds like a training issue, not misconduct. You should be fine.

Pro tip: when you file your claim, be honest about why you were terminated but don't volunteer extra negative information. Just answer what they ask.

•Should I mention that other employees were having the same issues?

Genevieve Cavalier
•Only if they specifically ask about it during the investigation process.

I used Claimyr last month when I couldn't get through to check on my adjudication status. Worked great and saved me so much time trying to call myself.

•Seems like a few people here have used that service. Might be worth looking into if I run into issues.

The fact that you had no written warnings is definitely in your favor. Usually employers have to show a pattern of documented issues for it to be considered misconduct.

•That's what I was thinking too. Seems like they just wanted to make budget cuts and used performance as an excuse.

•That happens a lot unfortunately. But Washington ESD usually sees through those situations.

File online at secure.esd.wa.gov as soon as you can. The process is pretty straightforward and you'll know within a few weeks if it's going to be contested.

•Already bookmarked the site. Planning to file tomorrow morning.

Just remember that even if your employer contests your claim, that doesn't mean you won't get benefits. They have to prove misconduct, not just that they fired you. Poor performance without willful misconduct usually still qualifies you for unemployment.

washington esd is actually pretty fair about these things compared to some other states ive heard about

•That's encouraging to hear. I was worried they'd automatically side with the employer.

If you do end up needing to talk to someone at Washington ESD about your claim, definitely consider using Claimyr. The phone system there is notorious for being hard to get through to, and this service actually gets you connected to a real person.

•I was skeptical about using something like that at first but it really did work. Got connected within an hour instead of spending days trying to call.

•I'll keep that in mind if I run into phone issues. Thanks for the recommendation.

Document everything you can remember about your termination while it's still fresh in your mind. If it goes to adjudication, having detailed notes will help your case.

•Great idea. I'll write down everything I can remember about the meeting where they fired me.

The whole system is designed to make you give up and not apply. Don't let them intimidate you - if you worked and paid into unemployment insurance, you deserve benefits when you lose your job through no fault of your own.

•You're right. I've been paying into this system for years, so I shouldn't feel bad about using it when I need it.

Start looking for work immediately too, because you'll need to show job search efforts once your claim is approved. Washington has specific requirements for how many jobs you need to apply for each week.
0 coins
Cassandra Moon
•Good point. How many job applications do you need to do per week?
0 coins
Camila Castillo
•I think it's 3 job search activities per week, but check the current requirements when you file your claim.

Been there, done that. Got fired for 'not being a good fit' which is basically the same as poor performance. Still got unemployment because Washington ESD knows that's not misconduct.

•How long ago was this? Just wondering if the rules have changed recently.

•About 8 months ago. The basic eligibility rules haven't changed much.

Make sure you file your weekly claims on time every week once you start the process. Missing even one week can mess up your benefits.

Cassandra Moon
•When do you usually have to file the weekly claims? Is there a specific day?

JaylinCharles
•You can file anytime during the week for the previous week, but I always do mine on Sundays to stay consistent.

honestly the worst part is the waiting and not knowing. but once you get approved the benefits are decent and help cover basic expenses

Good luck with your claim! Most people in your situation do get approved eventually. The key is just being honest about what happened and not giving up if your employer contests it.

Don't let them discourage you from applying! I was in a very similar situation - got terminated for "performance issues" after working somewhere for over a year with no prior warnings. Washington ESD approved my claim because they determined it wasn't willful misconduct. The fact that you had no written warnings and were struggling with new software (which sounds like a training/system issue) actually works in your favor. File your claim ASAP and be straightforward about what happened. Even if your employer contests it, you have a good chance of winning during adjudication. The worst case scenario is they say no, but you'll never know unless you try!

•This is exactly what I needed to hear! It's so reassuring to know someone else went through the same thing and got approved. The part about it being a training/system issue rather than misconduct makes total sense. I'm feeling much more confident about filing now. Thank you for sharing your experience!

•This gives me so much hope! I was really worried that being terminated would automatically disqualify me, but hearing about your success makes me feel like I actually have a chance. The new software thing is exactly what happened to me - they implemented this system that half the team was struggling with but somehow I'm the only one who got fired for it. I'm definitely going to emphasize that it was a training issue when I file my claim tomorrow. Thanks for the encouragement!
