Can I draw unemployment if I was fired from my job in Washington?

I got terminated from my job last week and I'm wondering if I can still get unemployment benefits through Washington ESD. My manager said it was for performance issues but I feel like they were just looking for reasons to let me go. I've been working there for almost 2 years and never had any write-ups until last month. Does getting fired automatically disqualify you from UI benefits in Washington? I really need the income while I look for another job.

You can definitely still qualify for unemployment even if you were fired, but it depends on the reason. Washington ESD looks at whether you were terminated for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were willfully negligent or violated company policy on purpose.

That's reassuring to hear. They said it was performance but I was doing my best with the workload they gave me.

0 coins

Same thing happened to me - got fired for 'performance' but still got approved for benefits after they investigated

0 coins

File your claim right away! Don't wait because there's usually a waiting period anyway. Washington ESD will investigate your termination and make a determination. Your employer has to prove misconduct, not the other way around.

0 coins

Should I file online or call them? I've heard their phone system is impossible to get through.

0 coins

File online first at esd.wa.gov - it's much faster than trying to call. You can always call later if you have issues.

I've been trying to reach Washington ESD for weeks about my claim that's stuck in adjudication. Their phone lines are always busy and when I do get through, I get disconnected. It's so frustrating when you need answers about your benefits.

0 coins

I had the same problem until I found this service called Claimyr that helps you get through to Washington ESD agents. Check out claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

0 coins

Really? How does that work? I'm desperate at this point.

0 coins

They basically handle the calling and waiting for you, then connect you when they get an agent on the line. Saved me hours of frustration.

0 coins

ugh the whole system is so messed up. they make it impossible to get help when you need it most. good luck getting through to anyone who can actually help

0 coins

I know it's frustrating but try to stay positive. The system does work, it's just overwhelmed right now.

0 coins

easy for you to say when you're not the one trying to pay rent with no income

0 coins

When I got fired they tried to say it was misconduct but I appealed and won. Make sure you document everything - emails, performance reviews, anything that shows you were trying to do your job properly.

0 coins

How long did the appeal process take? I'm worried about how long I'll be without income.

0 coins

It took about 6 weeks total, but I got back pay for the whole period once I won the appeal.

0 coins

That's good to know. I do have some emails where my supervisor acknowledged I was doing good work.

0 coins

Just remember that even if Washington ESD initially denies your claim, you can appeal within 30 days. Many people win on appeal, especially for performance-related terminations. The burden of proof is on the employer to show actual misconduct.

0 coins

This is exactly right. I work in HR and we rarely fight unemployment claims unless there was clear misconduct like theft or harassment.

0 coins

That makes me feel more confident about filing. Thank you for the information.

0 coins

File ASAP and be completely honest about why you were terminated. Lying on your application is way worse than getting fired for performance issues.

0 coins

Definitely planning to be honest. I don't want to make things worse for myself.

0 coins

Smart approach. Washington ESD will find out the truth anyway when they contact your employer.

0 coins

I got fired from my retail job last year for being late too many times and still got unemployment. They said it wasn't misconduct because I wasn't doing it on purpose, just had childcare issues.

0 coins

That's interesting because I thought attendance issues would count as misconduct.

0 coins

It depends on the circumstances. If you have a legitimate reason and you weren't willfully violating policy, it might not be considered misconduct.

0 coins

Make sure you start looking for work right away too. Washington ESD requires you to do job search activities even while your claim is being processed.

0 coins

How many jobs do I need to apply for each week?

0 coins

I think it's 3 job search activities per week but check the WorkSourceWA website for the current requirements.

0 coins

The adjudication process can take forever. I've been waiting 3 weeks just to hear back about my claim. If you need to talk to someone about your case, that Claimyr service mentioned earlier actually worked for me.

0 coins

How much does something like that cost? I'm already broke from being unemployed.

0 coins

It's worth checking out their website for details. For me it was worth it just to get some answers instead of sitting in limbo.

0 coins

Don't let them intimidate you. Employers sometimes try to scare people into not filing by claiming it was misconduct when it really wasn't.

0 coins

That's exactly what I was worried about. They made it sound like I definitely wouldn't qualify.

0 coins

Of course they did. They don't want their unemployment insurance rates to go up. File anyway and let Washington ESD decide.

0 coins

i got fired for calling in sick too much but still got my benefits. turned out they couldn't prove i was faking being sick so it wasn't misconduct

0 coins

Did they ask for medical documentation during the investigation?

0 coins

yeah i had to get a letter from my doctor but it was worth it

0 coins

The key thing is whether your actions were willful or not. If you were genuinely trying to do your job and just couldn't meet their expectations, that's usually not considered misconduct under Washington state law.

0 coins

This is really helpful. I was definitely trying my best but they kept adding more responsibilities without training.

0 coins

That sounds like a legitimate case for unemployment benefits. Make sure to mention the lack of training in your application.

0 coins

Whatever you do, don't delay filing. Even if you think you might not qualify, it's better to file and get denied than to wait and miss out on benefits you could have received.

0 coins

You're right. I'm going to file today. Thank you everyone for the advice and support.

0 coins

Good luck! Keep us updated on how it goes.

0 coins

Just wanted to add that if you do get approved, make sure you understand the weekly claim process. You have to file every week even if you don't get paid right away.

0 coins

Thanks for the reminder. I'll make sure to read all the instructions carefully.

0 coins

And keep records of everything - all your job applications, any contact with Washington ESD, etc.

0 coins

I'm in a similar situation - got let go for 'performance' but I think they just wanted to get rid of me. Seeing all these responses gives me hope that I might still qualify for benefits.

0 coins

Definitely file your claim. Even if there's some question about eligibility, it's worth going through the process.

0 coins

I will. Thanks for sharing your experience OP, it helps to know others are going through the same thing.

0 coins

The worst they can do is say no, but you might be surprised. I know several people who got benefits after being fired for non-misconduct reasons.

0 coins

That's what I'm hoping for. I never had any disciplinary issues before this.

0 coins

That's a good sign. Document that fact when you file your claim.

0 coins

One thing to keep in mind is that if you do get benefits, they'll be based on your earnings from the past year. Make sure Washington ESD has accurate wage information for your calculation.

0 coins

How do I check if they have the right wage information?

0 coins

When you file your claim online, you'll be able to review your wage history. If something looks wrong, you can contact them to correct it.

0 coins

Good luck with your claim! Remember that getting fired doesn't automatically disqualify you. Focus on the fact that you were trying to do your job and weren't willfully violating company policy.

0 coins

Thank you! I feel much more confident about filing now after reading everyone's responses.

0 coins

You've got this! The unemployment system is there to help people in situations like yours.

0 coins

I used that Claimyr service someone mentioned earlier when I couldn't get through to Washington ESD about my adjudication. Definitely helped me get the answers I needed instead of waiting weeks for a callback that never came.

0 coins

I'll keep that in mind if I run into issues with my claim. Hopefully the online filing process goes smoothly.

0 coins

The online filing is pretty straightforward. It's getting help when you have questions that's the hard part.

0 coins

I went through something similar last year - got terminated for "performance issues" but it was really just a way for them to downsize without calling it layoffs. I filed for unemployment right away and was approved after about 3 weeks of review. The key is being honest about what happened and providing any documentation that shows you were making a good faith effort to do your job. Washington ESD really does look at whether you were willfully negligent or just unable to meet unrealistic expectations. Don't let your employer scare you into not filing - they often make it sound worse than it is to discourage claims.
