Can you get fired and still get Washington ESD unemployment benefits?
I got terminated from my job last week and I'm wondering if I can still file for unemployment benefits through Washington ESD. My manager said it was due to performance issues but I feel like they never gave me proper training or feedback. I've been working there for almost 2 years and this came out of nowhere. Does being fired automatically disqualify you from getting UI benefits in Washington? I really need the income while I look for another job.

You can definitely still get unemployment if you were fired, but it depends on the reason. Washington ESD will review your case during adjudication to determine if you were terminated for misconduct or just poor performance. Performance issues usually don't disqualify you unless there was willful misconduct involved.

•That's a relief to hear. How do I prove it wasn't misconduct? I never got any written warnings or anything.

•Keep any documentation you have about your employment. Washington ESD will contact your employer for their side of the story during the fact-finding process.

I was fired for attendance issues last year and still got approved for unemployment. It took about 3 weeks for adjudication but they determined it wasn't misconduct since I had legitimate reasons for my absences.

NebulaNomad
•Did you have to provide documentation for your absences?

Nia Wilson
•Yeah I had to send in some medical records and stuff. The adjudication process is pretty thorough.

File your claim ASAP even if you're not sure about eligibility. The worst they can do is deny it, but if you wait too long you might miss out on benefits you're entitled to. I made that mistake once and lost two weeks of payments.

•Good point, I'll file tomorrow morning. How long does the process usually take?

•If there's no issues, you might get paid within a week or two. But if it goes to adjudication like yours probably will, could be 3-6 weeks before you see money.

The key thing Washington ESD looks for is whether you were fired for 'misconduct connected with work.' Simple poor performance or inability to do the job usually doesn't count as misconduct. Things like theft, violence, or repeatedly violating company policies would be misconduct.

•What about if you're fired for being late too many times? Is that misconduct?

Aisha Hussain
•It depends on the circumstances. If you were repeatedly warned and continued to be late without good cause, it could be considered misconduct. But if there were legitimate reasons like childcare issues or transportation problems, you might still qualify.

ugh this whole system is so stressful! I've been trying to get through to Washington ESD for weeks about my claim that's stuck in adjudication. The phone lines are always busy and when I finally get through they just tell me to wait.

•Have you tried calling right when they open at 8am? That's usually the best time to get through.

•I've tried everything - calling at different times, using the online chat, sending messages through my account. Nothing works!

•I was having the same problem until someone told me about Claimyr. It's a service that helps you get through to Washington ESD agents when you can't reach them yourself. I used it last month and actually got to talk to someone within a few hours. Check out claimyr.com - they have a video demo that explains how it works: https://youtu.be/7DieNd3C7zQ

Thanks everyone for the advice! I'm definitely going to file my claim tomorrow. Just to be clear - I should be honest about being fired when I file the application, right? I don't want to lie and make things worse.

Luca Ferrari
•Absolutely be honest. Washington ESD will find out anyway when they contact your employer. Lying on your application is fraud and could get you in serious trouble.

•Yeah don't risk it. Just tell the truth and let the adjudication process work. If you're entitled to benefits you'll get them.

I got fired from three different jobs and got unemployment every time lol. As long as you weren't stealing or punching your boss you're probably fine.

Aisha Hussain
•That's... not exactly how it works. Each case is reviewed individually and past approvals don't guarantee future ones.

What if your employer lies about why they fired you? Like they tell Washington ESD you were stealing when you weren't?

•That's what the fact-finding interview is for. You'll get a chance to tell your side of the story and provide any evidence you have. Washington ESD adjudicators are pretty good at sorting out the truth.

•That makes me feel better. I was worried my old boss would make stuff up about me.

Been there! Got fired for 'not being a good fit' which basically meant my supervisor didn't like me. Still got approved for unemployment because it wasn't misconduct. The waiting during adjudication was awful though - I was so stressed about money.

•How long did your adjudication take? I'm already worried about paying rent next month.

•About 4 weeks for me. I know it's scary but try to apply for any emergency assistance programs in the meantime if you need help with bills.

Make sure you keep track of all your job search activities from day one. Washington ESD requires you to look for work and keep a log of your applications. Don't wait until they ask for it.

•Do I need to start looking for work immediately even if my claim is still being reviewed?

Zoe Alexopoulos
•Yes, the job search requirement starts right away. You need to apply for at least 3 jobs per week and keep detailed records.

THE WHOLE SYSTEM IS RIGGED AGAINST WORKERS! They make it so hard to get benefits even when you've been paying into the system for years. My claim took 2 MONTHS to get approved!

•I mean, it's frustrating but they have to investigate to prevent fraud. At least you got approved eventually.

•TWO MONTHS WITHOUT INCOME! I almost lost my apartment waiting for them to decide I deserved my own money back.

Quick question - do you have to pay taxes on unemployment benefits? I forgot about that part last time and got hit with a huge tax bill.
0 coins
Aisha Hussain
•Yes, unemployment benefits are taxable income. You can choose to have taxes withheld from your weekly payments or pay them when you file your tax return.
0 coins
Mei Wong
•Thanks, I'll definitely have them withhold taxes this time. That tax bill was a nightmare.

My neighbor got fired for sleeping on the job and still got unemployment somehow. I don't understand how these decisions get made.

•There might have been circumstances you weren't aware of. Maybe they had a medical condition or other factors that influenced the decision.

•Maybe, but it seemed pretty cut and dried to me. Oh well, not my business I guess.

Does anyone know if you can work part-time while collecting unemployment? I might be able to get some gig work while I look for a full-time job.
0 coins
Luca Ferrari
•Yes, you can work part-time but you have to report all your earnings on your weekly claim. They'll reduce your benefit amount based on how much you earn, but you might still get some unemployment money.

•Good to know! I was worried any work would disqualify me completely.

If you're having trouble reaching Washington ESD about your claim status, I had good luck with Claimyr after trying everything else. It's a service that calls for you and gets you connected to an actual person. Saved me hours of frustration trying to get through myself.

StarStrider
•Is that the same service someone mentioned earlier? How much does it cost?

Amara Eze
•Yeah same one. It's worth checking out their website claimyr.com - they explain how it works. For me it was worth it just to talk to someone and get answers about my claim.

Whatever you do, don't give up if you get denied initially. A lot of people don't realize you can appeal the decision. My friend got fired and was denied at first but won on appeal.

NebulaNomad
•How long do you have to file an appeal if you get denied?
0 coins
Giovanni Greco
•I think it's 30 days from when you get the determination letter. Don't wait though - file as soon as you can if you disagree with their decision.

Just want to add that even if you think you might not qualify, it's worth applying anyway. The worst they can do is say no, but you might be surprised. Washington ESD looks at each case individually.
0 coins
NebulaNomad
•That's what I'm thinking. Better to try and get denied than not try at all.
0 coins
Fatima Al-Farsi
•Exactly! And if you do get denied, you learn something about what they're looking for if you need to file again in the future.

Make sure you file your weekly claims even while your initial claim is being reviewed. I made the mistake of waiting until I was approved and lost out on some benefits.
0 coins
NebulaNomad
•Wait, I can file weekly claims before my initial claim is approved?
0 coins
Dylan Wright
•Yes! You should file weekly claims starting the week you become unemployed. If you're approved, you'll get paid for all those weeks retroactively.

Good luck with your claim! It's stressful going through this process but most people who were fired for performance reasons do get approved eventually. Just be patient with the adjudication process.

One more thing - if you do get approved and start receiving benefits, make sure you keep all your documentation. Sometimes they do audits later and you want to have everything ready if they ask questions.

NebulaNomad
•What kind of documentation should I keep?

GalacticGuardian
•Job search logs, any correspondence with Washington ESD, records of your weekly claims, and anything related to why you were fired. Better to have too much than not enough.
