Washington ESD unemployment benefits after being fired - how can I get unemployment if I was fired?
I got terminated from my job last Friday and I'm wondering if I can still apply for unemployment benefits through Washington ESD. My supervisor said it was due to performance issues but I feel like they never gave me proper training or clear expectations. I've been working there for almost 2 years and this came out of nowhere. Does being fired automatically disqualify me from UI benefits? I really need the income while I look for another job. Has anyone successfully gotten unemployment after being terminated?

You can definitely still apply for unemployment benefits even if you were fired. Washington ESD looks at the reason for termination - if it was for misconduct they might deny your claim, but performance issues are usually different. You should file your claim right away since there's a waiting period anyway.

•Thanks! That's reassuring. Should I mention the lack of training in my application or keep it simple?

•Be honest but factual. If they contact you for more details during adjudication you can explain the training situation then.

I was in a similar situation last year - got fired for 'not meeting expectations' but Washington ESD approved my claim after about 3 weeks of adjudication. The key is that it wasn't willful misconduct on my part.

•That gives me hope! Did your employer try to contest it?

•They did contest it initially but I guess they didn't provide enough evidence of actual misconduct. Performance issues alone usually aren't enough to disqualify you.

The process can be frustrating though, especially if you need to talk to someone at Washington ESD. I spent weeks trying to get through on the phone when my claim went into adjudication. Eventually found claimyr.com which helped me actually reach an agent. There's a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•I've never heard of that service. How does it work exactly?

•Basically it calls the Washington ESD phone lines for you repeatedly until it gets through, then connects you to the agent. Saved me hours of redialing.

•Is it legit though? Seems too good to be true with how impossible it is to reach anyone at ESD.

File immediately! Even if there's a chance they might deny it, you want to get the process started. The worst thing that happens is they say no and you appeal. But honestly performance issues usually don't rise to the level of disqualifying misconduct.

•Good point about appealing if denied. How long does the appeal process typically take?

Tristan Carpenter
•Appeals can take 6-8 weeks for a hearing, but you should keep filing your weekly claims during the appeal process.

ugh the whole system is so confusing. i got fired too but for attendance and they denied my claim. now i'm trying to figure out if i should appeal or just give up

•Attendance issues can be trickier than performance issues, but it depends on the circumstances. Was it due to illness or transportation problems?

•mixture of both honestly. had some car trouble and got sick a few times but they said it was excessive

Whatever you do, don't lie on your application. Washington ESD will find out the truth anyway and lying can get you disqualified permanently. Just be honest about what happened.

•Definitely planning to be truthful. I have nothing to hide anyway.

The adjudication process is where they really dig into whether your termination disqualifies you. They'll contact your employer and possibly you for more details. It can take several weeks but don't panic if it goes into adjudication - that's normal for termination cases.

•Several weeks without income is scary but I guess there's no way around it.

•That's why it's important to file right away. The sooner you start the process, the sooner you'll know where you stand.

I was denied initially when I got fired but won on appeal. The hearing officer actually understood that my employer never gave me clear performance standards. Sometimes you have to fight for it.

Bethany Groves
•That's exactly my situation! No clear standards or proper training. Did you have a lawyer for the hearing?

Savannah Weiner
•Nope, represented myself. Just brought all my documentation and explained what happened honestly.

Make sure you document everything about your termination while it's fresh in your memory. Dates, conversations, who was present, etc. You might need those details later.

•Good thinking. I should write down exactly what my supervisor said during the termination meeting.

The Washington ESD website has good info about what constitutes misconduct vs. performance issues. Might be worth reading through their guidelines before you file.

•I'll definitely check that out. Thanks for the tip!

just my 2 cents but performance issues are usually not considered misconduct unless you were willfully not doing your job. sounds like you were trying but they didnt give you proper support

•Exactly! I was definitely trying my best with what little guidance they gave me.

I had to use that Claimyr service too after waiting weeks to talk to someone about my adjudication. It actually worked and I got through within a couple hours instead of spending all day redialing.

•How much does it cost though? I'm already broke from being unemployed.

•Worth checking their site for current info, but it was reasonable considering how much time it saved me.

Remember that even if you get approved, there's usually a one week waiting period before you start receiving benefits. Plan accordingly for that gap in income.

•Good to know about the waiting period. Every bit of info helps right now.

Start looking for work immediately too. Washington ESD requires you to be actively job searching and you'll need to log your job search activities for your weekly claims.

•Already started applying places but good reminder about the job search log requirement.

Don't get discouraged if it takes a while. The system is overwhelmed and everything moves slowly. Just keep filing your weekly claims even during adjudication.

•Thanks for the encouragement. This whole situation is pretty stressful.

If you do get denied and need to appeal, don't wait. You only have 30 days from the date of the determination letter to file your appeal.

•Good to know about the 30 day deadline. I'll keep that in mind.

honestly these days getting through to Washington ESD by phone is nearly impossible without some kind of help. that claimyr thing mentioned earlier might be your best bet if you need to actually talk to someone

•Yeah I'm definitely going to look into that if I can't get through the normal way.

•The phone system is absolutely broken. I tried for 3 weeks straight before giving up and using a service like that.

Keep copies of everything - your termination paperwork, any emails about performance, your unemployment application, etc. You never know what you might need later.

•Already started a file with all the documentation. Thanks for confirming that's the right approach.

The bottom line is that being fired doesn't automatically disqualify you. Performance issues are very different from misconduct in Washington ESD's eyes. File your claim and let them make the determination.

•That's what I needed to hear. Going to file my application today. Thanks everyone for all the helpful advice!
