Can you file for unemployment if you're fired - Washington ESD eligibility rules?

I got terminated from my job last Friday and I'm wondering if I can still apply for unemployment benefits through Washington ESD. My supervisor said it was due to performance issues but I feel like they never gave me proper training or feedback. Does being fired automatically disqualify you from getting UI benefits? I'm really stressed about how I'm going to pay my bills while looking for another job.

You can definitely file for unemployment even if you were fired! It depends on WHY you were fired though. Washington ESD will review your case during adjudication to determine if you were terminated for misconduct or not. Performance issues usually don't count as misconduct unless you were willfully negligent.

That's a relief to hear. How long does the adjudication process usually take? I need to know if I should start looking into other options.

0 coins

Adjudication can take anywhere from 2-6 weeks depending on how complex your case is. File your claim as soon as possible though because benefits are backdated to when you first became eligible, not when you actually file.

The key distinction Washington ESD looks for is whether you were fired for misconduct connected to your work. Things like attendance issues, insubordination, or violating company policy could be considered misconduct. But poor performance, lack of skills, or personality conflicts usually aren't disqualifying.

0 coins

What if they say you violated company policy but you disagree with their interpretation? Can you still get benefits?

0 coins

Yes, you can appeal their decision if Washington ESD initially denies your claim. You'll have the opportunity to present your side of the story during the appeal process.

I was in a similar situation last year - got fired for supposedly not meeting sales targets but really my manager just didn't like me. I tried calling Washington ESD for weeks to check on my claim status but could never get through. Finally used this service called Claimyr that actually got me connected to a real person at Washington ESD. You can check it out at claimyr.com and they have a demo video at https://youtu.be/7DieNd3C7zQ. Made the whole process so much easier.

Did you end up getting approved for benefits? I'm worried they'll side with my employer automatically.

0 coins

Yeah I got approved! The adjudicator said that not meeting performance standards isn't the same as misconduct. Just be honest about what happened and provide any documentation you have.

0 coins

Never heard of Claimyr before but might be worth trying. The Washington ESD phone system is absolutely brutal to get through.

0 coins

File immediately!! Even if there's a chance you might be denied, you should still file your claim right away. If you wait and then get approved later, you'll lose out on weeks of benefits. The worst they can say is no, but at least you'll have started the process.

0 coins

Good point, I'll file today. Do I need any specific documentation from my employer?

0 coins

You'll need your termination letter if you have one, and any documentation about the reasons for termination. But don't delay filing just to gather paperwork - you can submit additional info later.

0 coins

been fired twice and got unemployment both times so dont worry about it too much

0 coins

That's encouraging! Were the circumstances similar to mine?

0 coins

first time was attendance second time was they said i had bad attitude but adjudicator said neither was misconduct

0 coins

Just to add - when you file your initial claim, be completely honest about the circumstances of your termination. Don't try to sugarcoat it or leave out important details. Washington ESD will contact your employer anyway and any inconsistencies could hurt your case.

0 coins

This is so important! I know someone who got denied because their story didn't match what their employer told Washington ESD.

0 coins

Should I mention that I think the firing was unfair or just stick to the facts?

0 coins

Stick to facts but definitely explain your perspective. If you think the performance issues were due to lack of training or unclear expectations, mention that.

0 coins

The whole system is so confusing though. Like what exactly counts as misconduct? I feel like every employer is going to claim misconduct just to avoid having their unemployment insurance rates go up.

0 coins

Washington state law defines misconduct pretty specifically. It has to be a willful or wanton disregard of your employer's interests, or a deliberate violation of reasonable workplace rules.

0 coins

Okay so being bad at your job isn't the same as misconduct then?

0 coins

Exactly! Poor performance due to inability or lack of skills is not misconduct. It only becomes misconduct if you were deliberately doing poor work.

ugh this happened to my friend and it took forever to get resolved. she kept trying to call washington esd but the lines were always busy. someone told her about claimyr and she finally got through to talk to someone about her adjudication. wish i remembered the details but she said it really helped speed things up

0 coins

Was she able to get her benefits in the end?

0 coins

yeah she did! took a few weeks but once she actually talked to someone at washington esd everything got sorted out pretty quick

0 coins

I'm dealing with something similar right now. Got fired three weeks ago and my claim is still in adjudication. The waiting is killing me because I have no idea which way it's going to go.

0 coins

Have you been able to talk to anyone at Washington ESD about your case?

0 coins

No, I've called dozens of times but never get through. Thinking about trying that Claimyr thing someone mentioned earlier.

0 coins

Definitely try Claimyr! I was skeptical at first but it actually works. Being able to talk to a real person made such a difference in understanding what was happening with my claim.

0 coins

Here's what I learned from my experience: even if you think you might not qualify, file anyway. The adjudication process exists specifically to determine eligibility on a case-by-case basis. Every situation is different and you might be surprised by the outcome.

0 coins

That's good advice. I guess I have nothing to lose by filing.

0 coins

Exactly! And remember, you can always appeal if the initial decision isn't in your favor. The appeals process gives you another chance to present your case.

0 coins

The Washington ESD website has a good section explaining misconduct vs non-misconduct terminations. Might be worth reading through before you file so you know what to expect during the adjudication process.

0 coins

Thanks for the tip! I'll definitely check that out before I file my claim.

0 coins

The more you understand the process upfront, the better you can present your case. Knowledge is power when dealing with unemployment claims.

0 coins

also make sure you start doing your job search activities right away even before your claim gets approved. washington esd requires you to search for work every week

0 coins

How many job searches do I need to do per week?

0 coins

i think its 3 per week but check the website to be sure. and keep good records of where you applied

0 coins

Don't let your employer intimidate you into not filing either. I've seen companies try to convince people they won't qualify just to avoid the hassle. Let Washington ESD make the determination, not your former boss.

0 coins

My supervisor did seem pretty confident that I wouldn't get benefits. Makes me wonder if they were trying to discourage me from filing.

0 coins

Exactly! They have a financial incentive to discourage claims. Don't let them make that decision for you.

0 coins

Quick question - if you get approved for unemployment after being fired, do you still have to look for work or can you take some time to figure things out?

0 coins

You definitely still have to actively search for work and be available for work. Unemployment benefits aren't meant to be a break from working, they're temporary assistance while you find new employment.

0 coins

Got it, that makes sense. Just wasn't sure about the requirements.

0 coins

The most important thing is to file your weekly claims even while your initial claim is being adjudicated. If you don't file those weekly claims, you'll lose out on benefits for those weeks even if you eventually get approved.

0 coins

So I should file weekly claims before I even know if I'm approved?

0 coins

Yes! You file them and if you get approved, you'll get paid for all those weeks retroactively. If you don't file them, those weeks are lost forever.

0 coins

I wish there was better communication about timelines from Washington ESD. The uncertainty of not knowing when you'll hear back about adjudication makes everything so much more stressful.

0 coins

Totally agree! The waiting period is the worst part. At least if they gave you a better estimate of how long it would take, you could plan accordingly.

0 coins

This is why I'm thinking about trying Claimyr to actually talk to someone. The uncertainty is driving me crazy.

0 coins

Just want to say good luck with your claim! Being fired is stressful enough without having to worry about whether you'll get benefits. At least you know now that it's worth filing and seeing what happens.

0 coins

Thank you! I feel much better about the whole situation after reading everyone's responses. Going to file my claim today.

0 coins

That's great! Hope everything works out for you. Keep us updated on how it goes.
