Can you collect unemployment if you're fired Washington ESD eligibility question
Got terminated from my job last Friday and I'm wondering if I can still file for unemployment benefits through Washington ESD. My supervisor said it was due to performance issues but I feel like they never gave me proper training or feedback. I've been working there for 8 months and this came out of nowhere. Does being fired automatically disqualify you from getting UI benefits in Washington? I really need the income while I look for another job.

You can definitely still file for unemployment even if you were fired. Washington ESD looks at the reason for termination. If it was for performance issues rather than misconduct, you should be eligible. File your claim as soon as possible since there's a waiting period.

•That's a relief! I was worried being fired meant I couldn't get any benefits. Should I mention the lack of training in my application?

•Yes, include all relevant details about your termination when you file. The more context you provide, the better Washington ESD can evaluate your claim.

The key distinction is between being fired for misconduct vs. being fired for other reasons like performance or lack of work. Misconduct would disqualify you but performance issues usually don't. Your employer will have a chance to contest your claim if they disagree.

•What exactly counts as misconduct? I was never written up or anything, just had that one conversation about my performance.

Miguel Alvarez
•Misconduct typically means things like theft, violence, or willful violation of company policy. Poor performance without willful negligence usually doesn't qualify as misconduct.

•I got denied initially when I was fired but won on appeal. Don't give up if your first claim gets rejected!

I had a similar situation last year and was stuck calling Washington ESD for weeks trying to get through to someone about my claim status. If you run into issues reaching them, I found this service called Claimyr that actually got me connected to an agent. You can check it out at claimyr.com - they have a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works.

•Thanks for the tip! I'll keep that in mind if I have trouble getting through to Washington ESD.

•How much does that service cost? Seems like we shouldn't have to pay extra just to talk to unemployment.

•I was frustrated about that too but honestly it was worth it to actually get my issues resolved instead of calling for hours every day.

Make sure you file your weekly claims even while your initial claim is being processed. I made the mistake of waiting and it delayed my payments by weeks. The Washington ESD website walks you through the whole process step by step.

•Good point - I'll start filing weekly claims right away. Do I need to be actively job searching immediately?

Keisha Taylor
•Yes, you need to be able and available for work and actively seeking employment. Keep detailed records of your job search activities.

ugh the whole system is so confusing. I got fired 3 months ago and still fighting with them about my claim. they keep asking for more documentation and then take forever to review it
0 coins
Ava Thompson
•That sounds really frustrating. What kind of documentation did they ask for?
0 coins
StardustSeeker
•employment records, tax forms, proof of job search... basically everything. then they put it in adjudication for weeks

•Adjudication can take time but stay on top of it. Call regularly to check on your status and provide any additional info they request promptly.

I was terminated for attendance issues and still got approved for benefits. The hearing officer said my employer didn't provide adequate documentation that it was willful misconduct. Don't assume you're automatically disqualified!

•That's encouraging! Did you have to go through an appeal process or hearing?

Zainab Yusuf
•Yes, I had to request a hearing after my initial denial. It was nerve-wracking but the hearing officer was fair and listened to both sides.

File your claim ASAP because there's a one week waiting period before benefits start. Even if you're not sure you qualify, it's better to apply and let Washington ESD make the determination.

Ava Thompson
•I'll file today then. Better safe than sorry. Thanks for all the advice everyone!

Paolo Marino
•Exactly! The worst they can do is say no, but you might be pleasantly surprised.

One thing to keep in mind - if your employer contests your claim, it could take several weeks to resolve during the adjudication process. Be prepared for potential delays and maybe look into temporary work if you need immediate income.

•How likely is it that they'll contest it? My old boss seemed pretty irritated when they fired me.

Miguel Alvarez
•It varies by employer. Some contest everything, others don't bother unless it's clear misconduct. You won't know until you file.

Just went through this exact situation 2 months ago. Got fired for performance but was approved for UI benefits. The key is being honest about why you were terminated and providing your side of the story.

•How long did it take to get approved? I'm worried about how I'll pay rent if it takes too long.

•Mine took about 3 weeks from filing to first payment. Would have been faster but my employer contested it initially.

whatever you do don't lie on your application. they cross-reference everything with your employer and if you get caught lying you'll be disqualified and might have to pay back benefits

•Definitely planning to be completely honest. Not worth the risk of making things worse.

•Good approach. Honesty is always the best policy with Washington ESD claims.

If you end up needing to speak with someone at Washington ESD about your claim status or any complications, that Claimyr service I mentioned earlier really helped me get through. Their system basically calls repeatedly until you get connected to an actual person instead of busy signals.

•I might need to try that if my claim gets complicated. The phone system is impossible to navigate.

•Yeah, I was spending hours every day trying to get through before I found them. Much easier than the constant redialing.

Performance issues are usually not considered misconduct unless there was willful neglect or refusal to follow instructions. Sounds like you have good chances of approval based on what you described.

•That's what I'm hoping. I really was trying my best at the job, just felt like I never got proper guidance.

•Document everything you can remember about your employment and termination. It'll help if there are any questions later.

The whole unemployment system is such a mess. They make it so hard to get benefits even when you deserve them. But yeah, being fired doesn't automatically disqualify you - I learned that the hard way.

•It does seem like they make it more complicated than it needs to be. Hopefully my case will be straightforward.

File online at esd.wa.gov if you haven't already. The website walks you through everything step by step. Make sure you have your social security number, employment history, and details about your termination ready.

•Perfect, I'll gather all that information before I start the application. Thanks for the website link!

•No problem! The online system is pretty user-friendly once you get started.

I was denied initially when I got fired but then used Claimyr to finally get through to someone at Washington ESD who explained I could appeal. Ended up winning my appeal and getting all my back pay. Sometimes you just need to talk to an actual person who can explain your options.
0 coins
Ava Thompson
•Good to know about the appeal option if I need it. Sounds like that service helped you navigate the system.
0 coins
LunarLegend
•Exactly - I had no idea I could appeal until I actually spoke with someone. The automated system doesn't give you all the information you need.

been there! got fired from retail job last year for being 'too slow' but still got unemployment. employer didn't even contest it. you'll probably be fine especially if you were trying your best

The most important thing is to apply right away and then file your weekly claims consistently. Even if there are delays with your initial claim, you want to make sure you're eligible for back pay once it's approved.
0 coins
Ava Thompson
•Makes sense - I'll start the application process today and stay on top of the weekly filings.

Isabella Oliveira
•That's the smart approach. Better to have everything in order from the beginning.

Remember you also need to register with WorkSource Washington for job search requirements. It's part of maintaining your eligibility for benefits.
0 coins
Ava Thompson
•I hadn't heard about that requirement. Is that something I do right away or after my claim is approved?
0 coins
Ravi Patel
•You should register as soon as possible. It's one of the requirements for maintaining eligibility, so don't wait.

Your situation sounds very similar to mine from a few months ago. Performance termination without misconduct usually results in approved claims. Just be prepared for the possibility of a phone interview if they need more details.
0 coins
Ava Thompson
•What kind of questions do they ask in phone interviews? I want to be prepared.
0 coins
Freya Andersen
•They'll ask about the circumstances of your termination, what efforts you made to improve performance, and whether you violated any company policies.

Good luck with your claim! The majority of people who are fired for performance issues do get approved for benefits. Just stay persistent and don't give up if there are initial complications.
