Can you collect unemployment if you are fired - Washington ESD eligibility?
Got terminated from my job last Friday and wondering if I can still file for unemployment benefits through Washington ESD. My manager said it was due to 'performance issues' but I feel like they were just looking for reasons to let me go. Does being fired automatically disqualify you from getting UI benefits? I've been working for 2 years at this company and really need the income while I look for something new.

You can definitely still file for unemployment even if you were fired. Washington ESD will determine if your termination was for 'misconduct' or not. Performance issues usually don't count as misconduct unless you were deliberately doing something wrong. File your claim right away - the worst they can do is deny it, but you might be surprised.

•That's encouraging to hear! I was worried I'd be automatically disqualified. How long does it usually take for them to make a decision?

•Usually 2-3 weeks if there's no issues, but if your employer contests it, it could go to adjudication which takes longer.

File immediately! I was fired for attendance issues last year and still got approved. The key is that Washington ESD looks at whether you were fired for 'misconduct' vs other reasons. Poor performance, not being a good fit, or even attendance problems often don't rise to the level of misconduct.

•Thanks for sharing your experience! Did your employer try to fight your claim?

•They did initially, but after the phone interview with Washington ESD, I was approved. Just be honest about what happened.

I've been trying to get through to Washington ESD for weeks about my own termination case. The phone lines are impossible! Has anyone found a way to actually talk to someone there? I keep getting disconnected after being on hold for hours.

•I had the same problem until I found Claimyr. It's a service that calls Washington ESD for you and gets you connected to an actual agent. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works. Saved me so much time and frustration.

•Really? That sounds too good to be true. How much does it cost?

•It's worth it just to avoid the endless hold times. I was able to get my adjudication issue resolved in one call instead of weeks of trying.

The Washington ESD system is so frustrating. I was fired for allegedly violating company policy but it was really retaliation for reporting safety issues. Been waiting 6 weeks for them to make a decision on my claim.

•That sounds like wrongful termination territory. Have you thought about talking to an employment lawyer?

•I did consult with one but they said it would be expensive to pursue. Hoping Washington ESD sees through the company's BS excuse.

•Document everything! Keep copies of all your communications with Washington ESD and your former employer.

depends on the reason honestly. if you were stealing or fighting or something obvious like that, probably not. but if it was just not meeting expectations or personality conflicts, you should be fine

•Exactly right. Washington ESD defines misconduct pretty narrowly - has to be willful or deliberate violation of company rules.

•Mine was definitely performance related, not anything intentional or malicious.

File your claim TODAY if you haven't already. You can backdate but only for a limited time. Even if you're not sure about eligibility, let Washington ESD make that determination. I waited too long to file when I was fired and missed out on benefits for those weeks.

•Good point! I was planning to wait until I had all my paperwork together but I should just file now.

•Yes, file the claim first, then gather documents. You can always provide additional information later.

I got fired for being 5 minutes late one too many times and Washington ESD still approved my claim. The adjudicator said tardiness wasn't willful misconduct in my case since I had transportation issues. Every situation is different though.

•That gives me hope! Sounds like they really do look at the specific circumstances.

•They're supposed to but some adjudicators are stricter than others. It's kind of a crapshoot.

The thing about getting fired is that your employer has to prove it was misconduct. They can't just say 'performance issues' and automatically disqualify you. Washington ESD will ask for documentation and specifics.

•That's reassuring. My company wasn't great about documenting things so hopefully that works in my favor.

•Exactly! If they can't prove misconduct with actual evidence, you should be approved.

JUST FILE THE CLAIM! Stop overthinking it. Even if you get denied initially, you can appeal. I've seen people get approved on appeal even after being denied the first time.

•You're right, I'm probably overthinking this. Going to file tonight.

I had a similar situation and used Claimyr to get through to Washington ESD when I had questions about my termination case. The agent was able to explain exactly what they needed from me to process my claim. Made the whole process much less stressful.

•I keep hearing about Claimyr in these threads. Might be worth trying if I run into issues.

•It's especially helpful for complex cases like terminations where you need to talk through the details with an actual person.

Washington ESD approved my claim even though I was fired for missing too much work due to my kid being sick. They said it wasn't misconduct because I was dealing with family obligations. Don't assume you're disqualified just because you were terminated.

•That's a great example of how they look at the full context. Thanks for sharing!

•Family obligations are usually protected. Glad it worked out for you.

One thing to remember is that even if you're approved, your former employer might appeal the decision. Be prepared for that possibility and keep all your documentation organized.

•Good point. I should start gathering everything now just in case.

•Yes, and if they do appeal, you'll likely have a phone hearing. Stay calm and stick to the facts.

The Washington ESD website has a good explanation of what counts as misconduct vs. other reasons for termination. Might be worth reading through that before you file your claim.

Bottom line: file the claim and let Washington ESD decide. You paid into the system through your payroll taxes, so you deserve a fair review of your case. Don't let your employer intimidate you into not filing.

Sofia Martinez
•You're absolutely right. I earned those benefits and deserve a fair shot at getting them.

I was skeptical about services like Claimyr at first, but after spending literally days trying to get through to Washington ESD about my termination case, I finally tried it. Got connected to an agent within an hour and got my questions answered. Sometimes you just need to talk to a real person to understand your situation.

Remember to keep filing your weekly claims even if your initial claim is under review. You don't want to miss out on benefits for weeks you're eligible for just because the adjudication process takes time.

Sofia Martinez
•Good reminder! I wouldn't have thought about that.

•Yeah, lots of people make that mistake. Keep filing weekly even during adjudication.
