Washington ESD unemployment benefits after being fired - can I still collect?
Got terminated from my job last week and wondering if I can still file for unemployment with Washington ESD. My supervisor said it was for performance issues but I feel like they were just looking for reasons to let me go. I've been working there for almost 2 years and never had any formal write-ups or warnings. Does being fired automatically disqualify me from getting UI benefits? I really need to know before I waste time filing a claim.

You can definitely still apply! Washington ESD doesn't automatically deny claims just because you were fired. They'll look at whether it was for misconduct or not. Performance issues that aren't willful misconduct usually don't disqualify you from benefits.

•That's a relief to hear. What exactly counts as misconduct though? I was never written up formally.

•Misconduct has to be willful violation of company policy or deliberate acts that harm the employer. Poor performance or inability to meet standards usually isn't misconduct unless you were deliberately doing bad work.

File your claim ASAP! Even if your employer contests it, you can appeal. I got fired for supposedly being late too much and still got my benefits after they reviewed everything.

•How long did the whole process take for you?

•About 6 weeks total including the appeal process. The initial determination took 3 weeks, then another 3 for the appeal hearing.

I had a similar situation and couldn't get through to Washington ESD for weeks to check on my claim status. Finally used Claimyr (claimyr.com) and got connected to an actual person within minutes. They have this demo video that shows exactly how it works: https://youtu.be/7DieNd3C7zQ. Made the whole process so much easier when I needed to explain my termination circumstances.

•Never heard of that service before. Is it legit?

•Yeah it's real. Basically they call Washington ESD for you and connect you when they get through. Saved me hours of trying to call myself.

•I was skeptical too but ended up trying it when I couldn't reach anyone at Washington ESD for 2 weeks straight. Actually worked and helped me get my adjudication issue resolved.

ALWAYS file your claim immediately regardless of circumstances. Let Washington ESD make the determination about eligibility. The worst thing you can do is wait and lose out on potential benefits you're entitled to.

•Good point. I was worried about filing if I might get denied anyway.

•Never assume you'll be denied. File within the first week after separation to avoid any delays in potential payments.

ugh this whole system is so confusing... how do you even know if they'll approve it or not?? I'm in the same boat got let go last month and still haven't heard anything

•You should receive a determination letter within 2-3 weeks of filing. If your claim is under adjudication it might take longer.

•mine just says pending for like 3 weeks now... should I be worried?

•That's exactly when I used Claimyr to get through and check what was happening with my claim. Turned out they needed additional documentation I didn't know about.

The key thing is being honest about the circumstances of your termination when you file. Washington ESD will contact your employer anyway so don't try to hide anything.

•Should I mention that I think they were just looking for excuses to fire me?

•Just stick to the facts about what happened. Let Washington ESD determine if the termination was justified or not.

Been through this twice unfortunately. First time I got denied initially but won on appeal. Second time I was approved right away. Really depends on the specific circumstances and how your employer responds to Washington ESD's inquiry.

•What was different between the two situations?

Keisha Johnson
•First time was for attendance issues and my employer had documentation. Second time was performance related with no formal discipline on record.

Whatever you do, don't let them intimidate you into not filing. Some employers will try to tell you that you can't get benefits if you were fired but that's not always true.

•My supervisor did say something like that when I was leaving. Made me think I had no chance.

•Yeah they do that to discourage claims. File anyway and let Washington ESD make the call.

Just make sure you have all your documentation ready - pay stubs, any written warnings or performance reviews, dates of incidents they mentioned, etc. The more organized you are the better.

•I don't have any formal write-ups since there weren't any. Should I mention that?

Oliver Fischer
•Absolutely. The lack of progressive discipline can actually help your case.

same thing happened to my brother last year... performance issues but no warnings, got approved after like a month of back and forth with Washington ESD

•That gives me hope. Was he able to get benefits backdated to when he filed?

Natasha Petrova
•yeah they paid him from the date he originally filed once it got approved

Also remember you'll need to do your weekly claims even while your initial claim is being reviewed. Don't miss those or you could lose benefits for those weeks.

•Good reminder. I'll make sure to stay on top of that.

•Yeah I made that mistake and lost 2 weeks of benefits because I thought I didn't need to file while it was pending.

The Washington ESD system is ridiculous... they make you jump through so many hoops just to get benefits you paid into. But don't give up, keep fighting for what you're owed.

•It does seem overly complicated for something that should be straightforward.

•It's designed to be confusing so people give up. Don't let them win.

One more thing - if you do get into adjudication or need to speak with someone at Washington ESD about your case, that Claimyr service I mentioned earlier really does work. I was skeptical at first but it beats sitting on hold for hours.

•How much does something like that cost though?

•It's worth it when you need to actually reach someone and can't get through the normal way. Check out their site for details.

File immediately and don't overthink it. You've got nothing to lose and potentially benefits to gain. The worst they can say is no, and even then you can appeal.

Hope it works out for you! The system is frustrating but it does work sometimes. My neighbor got approved after being fired for performance issues too.

Don't forget to register with WorkSourceWA too if you haven't already. That's required for maintaining your benefits once approved.

•Yeah it's one of those things they don't always tell you upfront but it's mandatory.

Just went through this whole process myself. Even if your employer contests it initially, stay persistent. The appeals process exists for a reason.

•Did you end up needing to do an appeal hearing?

•Yeah, but it was just a phone call and pretty straightforward. They asked me to explain what happened and I got approved.

Performance issues are usually not considered misconduct unless you were deliberately doing bad work. Sounds like you have a good case based on what you described.
